When I learned that you copied from others without attribution

Not once,

Not twice,

But thrice.

All I could think of was this

senator

Of course, as my hubby Alan later told me –

You can very well say – IT’S NOT PLAGIARISM because Senator Robert F. Kennedy is dead.

Thank you for making me laugh on this rather stressful day.

Of course the last laugh is on Senate President Juan Ponce Enrile because this is happening under his watch on his last term . And he’s tolerating it.

Except during the time of Senate President Jose Avelino who to this day is remembered for his famous “What are we in power for” speech,  never  in the history of the Philippine Senate  has this body been so debased as now.

You will also be long remembered for saying – “walang krimen (na) plagiarism sa Pilipinas.”

Do you think your lolo, Senator Vicente Sotto, is now spinning in his grave? Lolo authored  the Press Freedom Law and now his grandson  recently threatened to limit the freedom of expression of his cyber-critics.

Way to go, Senator.

UPDATE AS OF 10:21 pm, Sept. 5, 2012

A commenter named Evenstarwen   thought of a new word inspired by  Senator Vicente Sotto III:

when one translates an english text to Filipino, does that mean copying?
So Translating and copying are the same? Hmmm….

      September 9, 2012 at 7:45 PM

      Without attribution.

      That’s the key.

      • snv says

        September 9, 2012 at 8:13 PM

Yes. Translation is copying. It copies the idea, the expression, the look and feel, in the words of Apple lawyers.

Shakespeare in Russian is still Shakespeare, not Druzhinin (translator of King Lear) or Averkiev (translator of Hamlet).

Similarly, Andres Bonifacio and Jose Gatmaitan wrote “Ang Huling Paalam ni Jose Rizal” (salin ni xxx or yyy).

So this could have been “Talumpati sa South Africa” salin ni Tito Sotto (or xxx the speech writer).

He should have chosen to translate JFK not RFK, and translated “Ich bin ein Berliner”.

“Ako ay isang dunkin donut.” Jelly doughnut actually.

If one goes to a physical bookstore, or Amazon, one can order “The Unbearable Lightness of Being”; and the author is said to be Milan Kundera.

But Kundera never wrote “The Unbearable Lightness of Being”. Kundera wrote “Nesnesitelna lehkost byti” (Czech). It is only when one opens the book that the book states that it was translated to English by MIchael Henry Heim.

Same thing if you buy “Slowness”. It credits Milan Kundera, although he never wrote “Slowness”. Milan Kundera wrote “La Lenteur”. It was translated from the French to English by LInda Asher. So is “Slowness” Asher’s? The translation, yes. But the novel is still Kundera’s.

        • raissa says

          September 9, 2012 at 8:32 PM

As you yourself pointed out – the translator’s name was stated and so was the alleged source of the translation.

IN Sotto’s case, he never made mention that he was translating someone else. What does it cost him to mention that it was a translation of Bobby Kennedy? Nothing.

It’s actually cheating. Those words, whether in English or Filipino, conveyed a series of thoughts and those thoughts did not originate from his brain.

          That’s all.

Let us turn the tables around.

What if somebody had a melody, and the lyricist gave the tunesmith the lyrics that go:

      There is nothing more enjoyable
      than this relationship of ours.
      I hope it never ends,
this song of love of ours.

      Refrain:

Oh Oh Oh Ah Ah Ah
Sing it and I will dance to it.

Does the English lyricist get to own the lyrics? Or is it still owned by Tito or brother Vic, for being a translation of “Awitin Mo at Isasayaw Ko”?

      • tristanism says

        Hahahaha.

I tried singing it. It doesn’t work. But it was fun.

        Also, the refrain killed me.

I don’t think Tito will ever get the point. He’s not stupid. (seriously, he can’t be that stupid.) I think he knows he’s botching everything up. He’s simply too arrogant to admit his mistakes.

      @mariatiu89,

Essem Solomon at Comment No. 121.2 already answered your question before you asked. A part of her comment follows:

With attribution, the legislator simply becomes a translator. Without attribution, however, as is the case in question, the legislator irresponsibly copied lines from Kennedy. In public speaking, when someone copies portions of one speech and presents them as his own, he/she is guilty of incremental plagiarism (Griffin, 2012).

Her comment was actually an excerpt from her recent blog post. The link to her blog was supplied at Comment No. 121.2 which she posted on September 8, 2012 at 4:43 am.

There’s far too many speculations going around, I myself can’t help to do the same. What interests me is whether PNoy has been kept in the dark regarding USEC Puno’s questionable activities or has he been turning a blind eye to protect his “buddy.” Hopefully, your report will touch on that aspect.

Does he possess qualifications that are rare and hard to find? Does he have any special capabilities that when lost will greatly disadvantage the Filipino people? What makes him so unexpendable?

Why must it fall on the Filipino people to be his employer and have their taxes go towards the salary of this friend of the President?

That recent Puno brouhaha brought about some issues and valid questions.

While we support and recognize the prinicpled questioning of some of our members here, may we request them to be more circumspect and sober about it next time. It actually plays into the hands of the likes of Tiglao, et al who have nothing but the worst intentions for the administration.

Let the ax fall where it needs to fall. Puno must go and must be prosecuted if warranted. But overzealous speculation may result in more damage than you think, rendering everything that has been built up and gained since 2010 useless.

Nixon got the boot for cover-up (and the destruction of the damning tapes) more than anything else. It has been common knowledge to many – and this was confirmed by the media and historians – that both the Republican and Democratic parties have engaged in such illegal activity in the past – breaking in and stealing important info and documents from the opposing party’s headquarters.

I supported Pnoy too, but not his KKK buddies. To really make a semblance of the Watergate scandal – Pnoy should utter the words that will forever be linked with Nixon’s presidency and forced resignation “I am not a crook!”

It will take one thing for me to totally lose hope on what is now fast-becoming baloney aka Tuwid na Daan – Aquino on national TV flatly telling all Filipinos that “PUNO IS NOT A CROOK”

You are so wrong Rolly. I supported Pinoy all the way. I had high hopes for a better Philippines when he ran and ultimately won. I thought that his first speech was spot on – when he said no more WANG-WANGs – for its literal wang-wang in traffic meaning – and the more encompassing Wang-Wang (or mga mali) in our society and government.

There have been lots of flaws in the way he handled some appointments. And the way he cuddled his KKK. Di ko alam ang KKK during the campaign and after victory.

I still hope Pnoy recovers from all of these – pero dapat tanggalin na ang mga sumisira sa kanyang inner circle tulad nina Puno (Llamas at Torres, Panganiban at BJMP, et al)

NEVER.

Puno committed an act of “Attempt” to violate the right of privacy! SEC. 2 ART III 1987 Philippine Constitution. Regardless of his “signing” the Registry (in fact, this proves the attempted act) so as to enter the Condo, does not help him. He had no permission from the owner of the Condo or from the wife of Mr. Robredo. The children cannot give consent unless expressly given by the owner, in writing, etc.

Puno does not show any knowledge of respect for other people’s right to privacy! Very clear on that. And he’s a gov’t Undersectary of DILG! What would happen if Mr. Robredo came back alive and kicking, knowing his Condo was “search, etc.”?

If Mr. Puno is an ordinary cop, he should be kicked out for such attempt toviolate on rights to privacy.

But Mr. Puno is Undersecretary of DILG, How should he be “disposed?” PNoy can make him “a target” at the Shooting Range with live ammo! Puno has that potential to be bad and he is bad…Joker! ..what’s it again?…..

The latest news is he will be out of DILG and transfer to another department. WOW! just a slap on the hand.
I am very dismayed on Mr. President statement. This is the guy who is under investigation for illegal Arm dealings and Jueteng and he still have trust on him? That contradicts his slogan of MATUWID NA DAAN.
I guest Archbishop Suarez is right that there is really an exemption on MATUWID NA DAAN. Mr. Puno should be ousted right away, finish the investigation started by Secretary Robredo, and if found guilty should never be on any government posting.
He disgusted me. And I hope our President is not involve in anything….but I have a second thought. Looks like there is a conspiracy and cover up, a copy cat of Watergate Scandals that ousted President Nixon because of his involvement.

to some extent i agree with your and andrew lin’s points – pero kumbaga, sa isang criminal case – “preponderance of evidence” ang katumbas nito.

isa pang halimbawa kaibigan (at malimit nating marinig ito, or even witness to some)

i dont want to sound too tela-novela – but i guess you will agree that this is true.
what im driving at here is that – sa dami na ng questionable actions, or inactions, by this so freakin’ lucky Puno guy – hindi mo na masisisi na maging speculative ang mga naaapektuhang matinong mamamayan

        Peace to you bro!

The mere act of trying to dupe the maid into allowing them to be inside a private abode to secure sensitive documents without asking the permission of the owner whom they knew, from president Aquino to Undersec Puno, was in Naga, is the center of sinister intent. It would take a minute of phone call to Mrs Robredo, which they failed to do and not too hard to do because they were already in contact with her in monitoring the search for Jesse.

All those involved could say they did not have malicious intent but the events that ensued betrayed them. A private personal property was treated like a government entity. That is where immoral and ill intent came into play.

I would like to hear the president to claim there is nothing immoral or ill intent by Puno, Tanseco et al to try to convince the maid to allow them inside the private home without asking the consent of the owner. He already said he did not tell them to go to the condo.

If the president could not perceive this simple small matter as obviously wrong, then his judgement on more complex matters would be doubtful, whatever he says about his incorrupt attitude. Covering immoral acts of friends or relatives is mental corruption already. What else is being covered secretly?

Talk is cheap but admission of error speaks loudly on the fair judgment and moral character of a person. The president of a country has more moral obligation subscribing to this principle.

The main issue is about transparent righteousness in “daan matuwid”.

No disrespect, sir, but I do not recall reading this in the papers. I can only recall reading that the kasambahay called Mrs. Robredo to inform her that some men are trying to get inside the apartment.

It’s the news reports that have been using the word “raid” and some other news-enriching phrases.

          September 10, 2012 at 10:38 AM

What did Puno et al, tell the maid to enter the house and search for papers. Undoubtedly they introduced themselves to her as people with authority and that they were from DILG with high position they were authorized by the president. PNoy said he did not tell Puno to go to to the condo. What alibi would they use except a presidential authorization. Certainly they could not say that Mrs. Robredo gave them permission nor say that Jesse told themto pick up the documents.

Every detail could not be reported because some were obvious like their introduction and authorization to the maid.

Thus Puno “duped the maid ” but she did not believe so she called the owner

See, that is your interpretation. I have always respected your insight and your seemingly inside sources, but I think that we’re jumping the gun on this one. Maybe the guy is a crook maybe he is not, but I believe he deserves the benefit of the doubt.

Let’s assume he’s not crooked for a moment. Then we can assume that he was just overzealous in the performance of his duties. He was asked to secure the office of Robredo. He might have thought (or he knew — baka friends sila) that there were also sensitive documents in Robredo’s house, so he went ahead and tried to secure it.

Maybe he was at fault for going ahead without proper documentation or whatever it is you need to have to secure someone’s home, but I don’t think the situation reported by news media is enough to brand him a crook.

Again, he may or may not be a crook, but from what I have read (not the insinuations of news reports) I don’t think we can logically deduce that indeed he is a crook. He was overzealous maybe but I don’t yet see his acts being criminal. All I’m saying is let’s wait for a few more details.

About the jueteng and illegal logging, I was talking about the other comments here and in some other news sites. I got confused there. :)

I did not assume he was a crook, it was you concluding that. I said what he did to go to condo and to get papers was immoral and illegal without consent of the owner when he knew how to contact mrs robredo. He overstepped and the latest news is Abigail Valte said Puno was instructed to secure contents of the govt offices of Robredo but not his residence. What does this latest announcement from palace mean? Was he given benefit of the doubt by Valte? Read Inquirer on this report.

Right now, all that the media reports are doing are further muddying the issue. And when you have follow-up news that aren’t really news, people resort to speculation. And when it comes to speculation, the flavor of the conclusion will ultimately be influenced by the bias/personality of the one making the conclusion.

Right now, all we have are speculations masquerading as news. From what I’ve read online, it appears that Puno is an illegal logger, a gambling lord and a gun runner. Parang hahaba pa ata yan.

All I’m saying is let’s wait for the actual news/events to unfold before we go and bash his head in with a digital brick.

Has she gone on and bashed Puno?

Hindi pa. Why?

All that the macedas, tiglaos, doronillas have to do is to whisper a few insinuations and then eto na tayo with pitchforks and all.

So far ang sabi ni Pnoy ay may utos nga siya ke Undersec Puno to secure Robredo’s office. Maybe Puno went ahead and secured Robrero’s condo/apartment also.

That’s what we did: faced with, at least, two interpretations, we went and chose the more exciting one.

Naniniwala ako na in a few more days ay malalaman natin ang iba pang detalye. Baka magkaroon ng report si Ms. Raissa or baka naman me makatulong ang investigation ng senado.

Obviously he might be looking for a documents which is under Secretary Robredo’s possession that links his name to Arm dealings and jueteng. Maybe there are names in there too in a higher position aside from Puno that are involved in a controversy.
I hate to think that Pnoy is one of them, but I must admit I have doubts, or Puno aside from being buddies of Pnoy ay may pinanghahawakan laban sa kanya. Brenda is criticizing him and to have a Senate inquiry to seek the truth why there is a condo raid and he don’t even defend himself? Still a complete silence.
What bothers me is when Pnoy said that there is nothing wrong with Puno to be in the condo to secure the documents and he still trust Puno after all the controversy Puno has been involved with.

If conspiracy theories cannot be stopped…..the freedom to espouse an opinion must likewise be tempered with prudence. IF the suspicion is that Puno committed a crime, then that suspicion must also adhere to a “beyond reasonable doubt” yardstick. But by all means, if a crime can be proven to have been committed, prosecute Puno.
We all have a stake in the success of “Daang Maatuwid” and of PNoy’s presidency. However, I believe that correcting perceptions created by inconclusive reportage, preliminary conclusions and spin is incumbent upon the President and his communications cadre to assuage doubts that can ensue.

Facts on Puno, tanseco trying to eneter Robredo condo unit.

    1. Tanseco knocked on Robredo unit to eneter the residence but was denied by maid and subsequent call to Atty Rances.
    2. Supt Tanseco is under command responsibility of Undersecretary Tanseco by virtue of Puno administrative position and highest ranking officer upon disappearance of Robredo.
    3. Pres Aquino admitted that he orderedto secure the offices of Robreo but he was silent on reason why Puno, Tanseco and company WENT or tried to enter Jesse’s condo unit.
    4. Puno was the highest ranking DILG personnel who went to Robredo condo so he had command responsibility on the action.
    5. There is not legal or moral reason to Robredo residence without asking the permission of Mrs. Robredo. Mace Esposo of Philippine Daily Inquirer opined that there was no reason to condemn Puno on going to Robredo residence because there was no prrof he had illegal motive. He also said it was stupid too sign the names in the registry if ill motive was in their mind. Puno and company had no recourse except to sign the visitors registry because It was the only way they could justify their entry to the unit and announce to the guards they are people with authority. They did not have to lie because they did not anticipate that the maid would refuse their entry to the unit. they were caught flatfooted by the maid.

The mere fact that Puno and company tried to go to Robredo condo without any reason is proof enough that something sinister is brewing. Puno knew that Robredo was declared missing the day before. Mrs. Robredo was in Naga. Puno did not ask her permission to go to their conjugal condo unit. There was NO REASON AT ALL for Puno and company to go to the condo. That is reason enough to suspect him of doing something illegal in the condo because he was physically present in the compound.

Puno went unnecessarily to the condo without logical reason. When a person is inside the perimeter of your compound without any reason to be there, what would one think?
    1. This person wants to visit the owner whom he knows is missing and not present inside the property
    2. This person got the permission of the wife to enter the compound which is not true.
    3. This person is up to something evil, like stealing
    4. He was lost and did not know he ended in the condo compound of Robredo.

Which is the most plausible answer among the 3 above.

Puno could not wiggle his way out of this predicament. He had no legitimate reason to ask entry to Jesse’s condo unit.

Aquino and Puno made a booboo. Did not have decency to ask Mrs Robredo permission or discuss their purpose to secure her condo.
Mrs Robredo said her maid called her “that certain people wanted to go inside the house and get some papers. She told the maid to deny them”

Hoping the apologists of PNoy and Puno would not label Mrs Robredo a liar later. They are already denying true facts declared on interview of PNoy and Mrs Robredo as conjectures.

Between these poles of personalities, the print and online media used words as ‘raid’, ‘also tried to get inside ‘, ‘“The persons wanting to go inside the residence and offices of Jesse could have wanted to get papers that supposedly pertain to anomalous purchase of firearms,” the source alleged.’. AND readers picked up the conspiracy theories…

It keeps everyone’s toes’ tip toeing.

      – “… the President said he did not order Puno to go as well to Robredo’s condominium.”

      – Palace Mum On Robredo’s Investigations

Robredo said she also asked the help of Justice Secretary Leila de Lima …

“Kung may sensitive documents dun, hindi magiging secure ang mga tao dun kung babalik-balikan sila,” she said.

Not even the maid “can give consent” for Puno & Co. to enter that Condo! The maid is not the owner! Her duties are not “giiving permissions like to rummage and search for documents.” Her duties are only to WATCH the place, clean it, sweep the floor, etc.! So, had such “illegal consent” been given by the maid, Puno & Co. would still have violated the law on PRIVACY!

PNoy and gov’t must remember SEC. 2 ART. III “the right of the people to be secure in their persons, houses, papers, and effects against unreasonable searches and seizures of whatever nature and for any purpose shall be inviolable xxx” Constitution 1987 Philippines.

SEC. 2 is right to privacy.

“Signing” the Registry doesn’t disprove the lie…Not signing it proves the lie also! Either way, that group wanted to show another lie by signing the Registry, something like “in good faith.” But attempting to enter a Condo Unit belonging to someone, without any authority from the owner (or court order) is evil enough unless to rescue somone inside from immediate physical harm, etc. Was there something like that inside the Condo? None.

Not even PNoy’s “order” can Puno just disregard the ownership interests of that Condo!

    Latest News ABS CBN

Pres Aquino admits he ordered Puno to lockdown Robredo offices but he did not admit he ordered the takeover by Puno of Jesse’s condo unit.

Aquino claims THAT IT IS FINE WITH HIM THAT PUNO TRIED TO ENTER JESSE’S CONDO because the documents were secured.

It is the most irresponsible statement from Aquino as president of republic because he is condoning illegal activities.

Here is why Aquino is wrong morally and legally.

    1. Aquino, despite being president does not have the right to order the takeover of sonebody’s personal residence without court order or consent of conjugal owner who is Mrs. Leni Robredo.
    2. What Aquino is saying that as long as The documents are secyred, it does not matter the methods employed are illegal or in violation of constitutional rights. EVEN CRIMINALS ARE GIVEN DUE COURSE BY LAW UNDER THE MIRANDA DOCTRINE. VIOLATION OF POLICE FORCE OF THIS RIGHTS WOULD EXONERATE THE CRIMINALS. Applying this Miranda principle on the act of Puno, condoned by Aquino, it is an obvious violation of rights.
    3. Aquino claimed that DeLima notified him that Robredo was investigating Puno’s connection with illegal purchase of firearms. He also admitted that he ordered Puno to secure same documents. It does not make moral or legal or command responsibility sense that the president swearing on “daan matuwid” principle would order a person to secure documents in which that same person is the subject of the documents under investigation.

I hate to say it. Aquino is covering something on ths issue due to either of the following:
    1. He could be under pressure to cover up for Puno
    2. Aquino is involved in the anomaly under investigation by Robredok
    3. PNoy has skeletons that Puno knows and he is worried that Puno is going to use this secret as leverage to expose him.

    Why this 3 possible conclusion?
A responsible incorruptible authority like the president would not logically say that “it is ok with him as long as the documents are secured for whatever means”. Which includes illegal methods. Nixon thought and acted the same way with Watergate. In Nixon case, his men were able to secure the documents by unlawful entry to a private residence while Puno and company tried to enter illegally but were prevented by the maid of Robredo which was the only reason they were not able to secure the documents. Aquino is saying he condones this unlawful act of Puno.

Sorry, Mr President. High regards to your program of anti corruption us appreciated, but without punishing or condemning Puno, you are not different from those you are condemning for corrupt ways.

Stealing one peso or one million pesos are not different. They are both felonies.
Condoning massive corrupt activities or minor infraction of illegal entry or violation of rights are also the same. Both violate our constitutional laws.

Your moral judgment on this issue of violating the personal rights of Robredo by Puno, Tanseco and company is wrong, should be denounced, investigated and must be answered by you personally unless you clarify your judgment when you come back from Russia.

To you, this might be a trivial matter. But to those seeking the right path know that grand illegal moves or corruption start from small acts. There is no room to tolerate any illegal activities, even how minute or isolatedev in nature. This is the only way the people are assured that everyone is following the rule of law.

Respect on you is tarnished by your statement published by Philadelphia Inquirer: “That what Puno did (including failed entry on Robredo condo unit) was fine with you as long as the sensitive documents were secured”.

It is a stupid statement coming from the president of the country!

        September 9, 2012 at 4:18 PM

        @Victin
I dont want to speculate on the contents of documents. That is not the issue with Puno’s visit to Robredo condo.
They did not have business telling the maid the purpose of their visit was to secure papers, not necessarily secret documents held by Robredo.

Plainly, Puno and his cohorts did not have any authority from the owner asking for papers, including toilet paper. It’s that simple. They violated every simple tenet of common decemcy and respect to the Robredos.

Aquino should not have condoned his act whatever was the purpose or intent.
They made a mistake. Admit it., very simple.

Netizens are asking Sotto to have apologized.and his issue of pagiarism could have toned down. Puno could have done the same, expressing apology that he misinderstood the president order. His silence betrayed him compounded by the tolerance of PNoy on his action.

      PNoy ordered Robredo’s office lockdown
      By Lynda Jumilla, ABS-CBN News

      abs-cbnnewsDOTcom/nation/09/08/12/pnoy-ordered-robredos-office-lockdown

VLADIVOSTOK, Russia – President Benigno Aquino III on Saturday said he gave the orders for Interior and Local Government Undersecretary Rico Puno to secure the office of the late Interior and Local Government Secretary Jesse Robredo, shortly after Robredo’s plane crashed off Masbate.
However, the President said he did not order Puno to go as well to Robredo’s condominium.
Puno, along with several policemen allegedly tried to access Robredo’s condo unit in Quezon City, but was not allowed entry.
“Sometime in the early evening (of the crash), (DOJ) Secretary Leila de Lima called and pinaalala niya the need to secure Secretary Robredo’s documents, because at that time he was doing a lot of investigations,” the President said in a chat with the media while attending the 20th Asia-Pacific Economic Cooperation Leaders Meeting.
Aquino said since there are only two DILG undersecretaries–one of them Austere Panadero, who is concerned with local governments–it was but logical that the task be given to Puno who is deputy for police operations.
When Aquino was told that Puno likewise went to Robredo’s condo, he said: “Well, he probably thought there were also some documents there that needed to be secured.”

What the Filipino people would think had these sensitive documents got lost.
It would be imprudent for the President not to act on matters that could be of national interests.

Siguro, dapat hinay hinay muna tayo.

Whether there are documents kept or not by Robredo, decency dictates that permission should have been sought permission from mrs robredo since they already know she was in Naga before Puno went to the condo and tried to intimidate the maid by saying they needed to get important papers. That is the big issue.

@Johnny Lin, if PNoy reads this point of yours, can he keep quiet? He must be something boxed-into a corner! Hurried FEAR? Are they losing their marbles onto something big & important Mr. Robredo was working on?

“Documents” inside the Condo “to be secured” without permission from the owner of the Condo? Involving State Security? Tell us then.

Let us marshall the facts before making any suggestions, much less conclusion.

      FACTS

      1. Puno was ordered by Pnoy to secure Jesse’s office in the evening of August 20.
      2. In the morning of August 21 Puno proceeded to secure Jesse’s office as ordered.
      3.  The purpose of Pnoy’s order was to prevent any movement of documents – sensitive or not – without proper clearance.
      4. After securing Jesse’s office Puno proceeded to secure Jesse’s condo.
      5.  There is no report whether Puno was able to secure Jesse’s condo despite the maid’s refusal to allow Puno to enter.
      5.  There is no info whether Puno went to other places to secure the same for the purpose above said.

      MY THEORY
      1.  Pnoy’s order to Puno should have been a general order to secure ALL of Jesse’s documents, whether official or private, wherever they may be – in Jesse’s office, condo, house in Naga or any known depository of Jesse’s documents.  Access to and sorting of the documents could be done at appropriate time by proper persons.
      2.  The general order could be implemented by simple physical security measures such as locking and sealing the whole place or any part thereof, complimented by guards to prevent access of unauthorized persons and by CCTV cameras for round the clock security.
      3. The problem I think is not on the order issued by Pnoy.  He could not be expected to issue orders with all the necessary details. Puno should have made proper adjustment and coordination to attain the objective of securing Jesse’s documents.
      4. Insofar as the maid left in the condo is concerned, she could be transferred to a safe place upon securing the place.  Remember that safety is paramount in ALL instances.

      • Johnny Lin says

        September 9, 2012 at 9:25 PM

The Main point is asking the consent of the owner. The president of a country could not give order to secure a private property without a court order, consent of the owner or imminent or immediate danger in life to the occupants. The maid could not be forced to vacate the premise without the above conditions on constitutional rights. Plain and simple.

The president already said the condo was not part of his order which is legally right.

        • Rene-Ipil says

          Johnny [email protected]

Agree. Nobody can enter private dwelling without the consent of owner.  Puno should have coordinated first with proper persons like Leni or the caretaker. Anyway, he did not have to enter the condo to secure it.  Perimeter security would be sufficient such as putting guards and cameras outside the unit and placing the condo under tight surveillance. Of course that would be in coordination with condo authorities.  My point is that the State is not wanting in police power to safeguard its citizens and sensitive documents.

It is possible that the life of the maid was in peril if malefactors are really intent to pilfer sensitive documents from Jesse’s apartment.

        • Rene-Ipil says

          September 10, 2012 at 7:45 AM

One more thing. Puno should have done what he was ordered to do on the same evening of August 20, not a minute later after receipt of presidential directive. Initially by putting police mobile patrol cars in the target areas i.e. Jesse’s office, condo, house in Naga, etc.

Nobody has to enter the place unless necessary and with proper coordination/permission.

@Johnny…. Kahit mga papeles sa iyong lamesa o laman ng ating mga computer at kahit si PINOY pa ay Hindi pweding maghalungkat o kumuha o buksan ang ating mga lamesa o computer , even how confidential it was, you need the consent of the owner or a court order to be legal and will not VIOLATE OUR CONSTITUTIONAL RIGHTS.

It’s violative because during the process of searching you may accidentally ran into personnal-confidential papers of ROBREDO .

Ngayon kung it pertains papers that will endanger our National Security , PINOY will not only secure the area but to SEALED the AREA and post 24hrs guard, To his room.

But if pertains to confidential papers pertaining to GRAFT or ILLEGAL GAMBLING, OWNER’s CONSENT is BADLY NEEDED .

MUCH MORE in the CONDO of ROBREDO, mali na lahat ang ginawa nila.

I supported Pnoy and his drive against corruption. I can’t wait to see what he plans to do when he comew back from the Apec meeting.

Tibagin na yang KKK… else, I might get the Jim Paredes syndrome – ang tuluyang sumuko at mawalan na ng pag-asa sa ating inang bayan – at mangibang bansa na lamang…

Can’t wait for Raissa to write something about this. Or Conrado de Quiros – who I have always respected and admired – until he constantly hits on Roxas and never on Binay, Llamas, Torres and especially Puno. Kasama siguro sya sa Samar group – and that is what is saddening in the grand scheme of things.

The more I grieve and mourn the passing of the best, the most honest and the greatest public servant I have ever known in my lifetime – Sec Jesse Robredo.
