Two years ago on Bonifacio Day I wrote about former Congressman Rozzano “Ruffy” Biazon, who was newly-installed as Commissioner of Customs.

Today, however painful, I have to write again about Ruffy Biazon because the Justice Secretary said he was among the 33 former and current lawmakers to be charged for malversation, graft and bribery before the Ombudsman.
When the Commission on Audit (COA) came out with an initial report on the pork barrel scam in mid-August this year, I had scanned it and found the name of Rozzano Biazon.
The Coa report said its team of investigators had asked for Biazon’s side several times but he never responded.

Ruffy Biazon has just tendered his “irrevocable resignation.”
I commend him for doing the honorable thing. I hope he turns whistleblower.
Two weeks later on August 30, 2013 a Philippine Star news report bylined by Jess Diaz saved me from making a phone call to Biazon. The report noted that between 2007 to 2009, Biazon had given P28.7 million of his pork to three NGOs: Dynamic Filipino Citizen Civic Organization Inc., P18 million; Unlad Pinoy Organization, P8 million; and Philippine Social Development Foundation, P2.7 million.
The report said Philstar had asked Biazon for his reaction to the COA report. And Biazon’s reply was that he would review his disbursement record.
So when Justice Secretary Leila de Lima announced last Friday that Biazon was among those to be charged, I had expected Biazon to explain what he had found after examining his disbursement records.
Before I could phone him to ask, Biazon released the following statement on his website:
“Accounting for public funds comes with the territory of serving in government, whether it be at the lowest levels of local government or in the high levels of national office.
Therefore, I am willing and ready to face the allegations raised today pertaining to the Priority Development Assistance Fund (PDAF) allocated to my congressional district during my term as representative of the lone district of Muntinlupa.
I had always exercised prudence and fidelity in the performance of my duty as Representative of the Muntinlupa as well as in other responsibilities to the public, and pursued projects and programs that benefited my constituents. But as we have seen in some instances, the processes involved have been vulnerable to abuse by certain parties.
I have yet to see the documents pertinent to this issue, but I welcome the opportunity to clarify and answer the accusations whether before the National Bureau of Investigation, the Office of the Ombudsman or the courts.”
I read it inside out and I could not find any denial of wrongdoing.
What caught my attention was the sentence:
“But as we have seen in some instances, the processes involved have been vulnerable to abuse by certain parties.”
Biazon’s statement reminded me instantly of a statement issued by ex-President Gloria Macapagal-Arroyo years ago, wherein she blamed the political system for the 2004 election fraud, wherein she had been implicated.
The political system is corrupt, yes. Temptations abound. But everyone has the free will to succumb or refuse to take part in the corruption.
Biazon’s statement – that he had yet to see the documents – also rings hollow. He had the months of September, October and November to clarify with COA why he had been named in the report.
Personally, I had wanted Biazon to succeed in ridding the Bureau of Customs of corruption. But with this now hanging on his head, he has no hope anymore to do that. Resignation is the only option.
However, he may still have a chance to redeem himself. And he doesn’t need to see the President to do it.
He needs to tell his ultimate boss – the citizenry – all that he knows about how pork barrel gets funneled to private pockets.
Wish ko lang for Christmas – that Biazon will tell the people what he knows and help break wide open the pork corruption that has been going on for a long, long time. Name names. He can be protected from libel if he testifies in the Senate Blue Ribbon Committee.
What he couldn’t do in Customs he just might succeed in doing to our political structure.

True, he admitted guilt smoking crack, still he landed on Maclean’s front cover as one of the news maker persons of the year. Here in Toronto, citizens are more tolerant of a person’s personal shortcomings as long as they do their jobs and not dipping their hands on the till. In the Ph, politicians have personal issues, stealing , frequent absences non-performance and are still elected and tolerated by the voters. In my other comment I mentioned about resiliency of the Pinoys maybe now counter productive and as you have said it is time for a change of attitude and not just be passive /receptive (“amen”able) of politicians evil ways. Pinoys need to ask, ask, for explanation why this,why that instead of keeping quiet and sometimes star struck mesmerized by the glitter of personality and promises. I was about to say nutcrackers. manny being tax free for life while erap wants to raise the taxes paid by manilenyos. apparently, erap is not satisfied, manilenyos are not paying high enough taxes. suggestion ko lang po for manny’s supporters in congress that in order to make up for the shortfall in tax collection with manny being exempt for life, they ought to forego receiving their own salaries and donate such, so local govts like mayors, vice mayors, konsehales, bomberos, police, public school teachers, doctors at nurses in public health centers can be paid. so, our parks and local cemeteries can further be maintained. for manny to be exempt from tax, he might as well not use our roads so he does not have to pay for their update and maintainance, the cars that he and his family used are road huggers. they can all take to the skies and use their own private jets and not clog our roads. also, he can have his own private waste removal collection and not depend on our public rubbish and waste removal collection. the waste and the basura that he and his family generate and contribute to the degradation of the environment is enormous.

US Military has just pulled out its disaster assistance contingent. If US wants to, it can send another or same group to undertake rehab which is a different kind of mission.
Gasmin’s disaster group after a specified time must WITHDRAW to be ready for the next disaster. In addition to awareness and readiness, like the US contingent, Gazmin’s group must be strictly time specific so that regular government departments can take over, and most important so that Lacson’s group can start its mission. Time-wise and cost-wise Lacson’s rehab can afford cost-overrun and time slippage because rehab is a special kind of investment that’s adjustable in its definite beginning and ending. It should be planned to WITHSTAND another disaster while rehab is on-going. While Gasmin’s rescue and relief resources could be limited but EXPANDS with donations, Lacson’s REHAB resources are fixed and inflation adjusted. DISASTER and REHAB have less SAMENESS and lots of DIFFERENCES, EVEN IN ITS LEAKAGE TO CORRUPTION—management-wise.

So, with this ruling Leona, how can we differentiate the Supreme Court in 1994, which ruled the constitunality of the Pork Barrel, called Countryside Development Fund (CDF) at the time, and reaffirmed it in 2001, when again challenged (with PDAF as its new name).

From my reading, the SC ‘explained’ why…the reasons of the PDAF case of 1994, it was dismissed ‘NOT’ on the merits. This current case, acc to the SC, is decided on the ‘merits’. In legal minds, such things are part of due process bla bla bla.
Just like that ‘Election Ban’ case, before any presd’l election, there was a case upholding ‘all’ appointments within the prohibited period as unlawful. But SC also ‘change’ that ruling in favor of ex-CJ Corona, saying the ‘prohibition’ DOES NOT COVER the judiciary. A twist indeed.
In short, not even the SC justices, are exempt from imperfection. Nobody is. We all twist acc to the winds in due times. Not to twist one gets crumpled and ‘death’ results.

How will Congress ‘go around’ that decision of the SC? I think C will still try to… this is politics & money, money & politics involved. Just think or imagine, there was already an express prohibition in the Constitution, yet C was able to do it for DECADES!
I think the country should PREPARE a STRONGER JUDICIARY and LAW ENFORCEMENT system to CATCH ‘EM NEXT TIME…a fast and furious SYSTEM OF JUSTICE!

‘In his concurring opinion, Senior Associate Justice Antonio Carpio took the position that all lump-sum appropriations in the budget are illegal.
Carpio said Sections 35 and 23 of the Administrative Code do not authorize lump-sum appropriations in the General Appropriations Act.
“The President has a constitutional duty to submit to Congress only a line-item NEP (National Expenditure Program) without lump-sum expenditures, while Congress has a constitutional duty to enact only a line-item GAA without lump-sum appropriations,” he said.
Associate Justices Teresita Leonardo-De Castro and Roberto Abad concurred.
But Chief Justice Ma. Lourdes Sereno, who was appointed to the top post by President Benigno Aquino III, took an opposing view in her separate concurring opinion.
She countered that the Administrative Code itself speaks of how to deal with lump-sum appropriations, which implies that there are legal forms of these kinds of funds.
This, she added, was the same opinion espoused in the majority decision on PDAF written by Associate Justice Estela Perlas-Bernabe.
Sereno said that ruling that PDAF is a “prohibited form of lump-sum” fund implies that there are allowable forms of lump sum funds.”
Lawmakers and PNoy et. al., including DBM Abad must have ‘lumps’ somewhere. After PDAF on lump-sums was declared uncons…they still have lumps on DAP…
The Adm Code does not authorized lump-sums acc to J. Carpio.
No. (2) SEC. 25 Article VI Constitution clearly says:
“No provision or enactment shall be embraced in the general appropriations bill [ the GAA law ] unless it relates SPECIFICALLY [ caps supplied ] to some PARTICULAR [ caps supplied again ] appropriation therein. xxx ”
The word ‘specifically’ to my understanding means and includes ‘itemized item’ and exclude ‘lump-sum’ idea; again, that word ‘specifically’ is further emphasized with the word ‘particular’ meaning ‘item or itemized,’ which wholly exclude the idea of ‘lump-sum.’
Even without the Administrative Code, this Constitutional provision is clear: lump-sums are prohibited in GAAs or in any other source for support of spending money.
This No. 2 of SEC. 25 is clear expression. It defeats CJ Sereno’s understanding that the Adm Code speaks of dealing with ‘lump-sums’ thus, such ‘forms’ are allowed. For me, her interpretation is a Olympic high-jump beyond what is expressly stated in No. 2.
I like the DAP issue to be ruled likewise of the PDAF rationale. To differently rule otherwise is not only an error but defeats the whole reason why lawmakers cannot interfere and get what they appropriated, or what the Executive is not allowed by law to spend beyond what the GAAs and the Constitution allows.
A twist I do not like to happen on the DAP matter from the PDAF ruling.

To say further, a quote on Page 29 of the PDAF ruling, the Court said –
‘The evolution of the ―Pork Barrel System by its multifarious iterations throughout the course of history, lends a semblance of truth to petitioners‘ claim that ―the same dog will just resurface wearing a different collar.”
The DAP matter is of course another ‘same dog wearing a different collar.’
Is DAP based on a legal provision like a GAA law? The SC said on Page 58 in the PDAF case –
“To reiterate, if a legal provision designates a determinate or determinable amount of money and allocates the same for a particular public purpose, then the legislative intent to appropriate becomes apparent and, hence, already sufficient to satisfy the requirement of an ―appropriation made by law under contemplation of the Constitution.”
Are DAP funds by ‘legislative intent’ in the sense that it is by law initiated and approved by Congress?
PDAF funds ‘died.’ Will DAP funds ‘lived or survived’? Abangan!

I read the concurring opinions of Chief Justice Sereno, Associate Justices Carpio, Leonen and Briones…lastly, the unanimous verdict penned by Associate Justice Perlas-Bernabe.
They’re all confusing. To better understand I think, we disregard the concurring opinion of all the other Justices and espouse the one Associate Justice Perlas-Bernabe handed down.
I can sense bitternes to Associate Justice Carpio’s judgment…more so to that of Associate Justice Briones’.

My take: The punchline of the SC Decision on PDAF SHOULD BE:
Philippine Congress should confine itself to its sworn constitutional duty of LAWMAKING not (NEVER any longer) dipping its hands on lucrative development projects.
The SC should not define (as in deconstruct, decapitate, not make bigger) LAWMAKING but REFINE (quantize, SPECIFY) its finest form and content.
The Supreme Court DON’T NEED 72 pages, 4 HOURS to understand to say what the people wants of Congress something like this:
DAMN IT, CAN’T YOU JUST MAKE LAWS. YOU THIEVES?

Whatever you may call to this latest events in the Senate…charade, waste of time and money, satire, etcetera…it certainly caught the eye of the people.
I didn’t know the fuss about Martial Law, what and who Enrile is, who Marcos is, and what they did to our nation. The vast majority of the masses, especially the youngsters, now have some glimpse of what the past have been, and what kind of elected officals we are dealing with…thanks to the quarrelling in the Senate.

During my OJT stint in Batasan, you’d see lawmakers behaving like preschoolers during sessions. If lower house was like that, I guess it’s too much to expect that the upper house would be better even if they are fewer.

Congress[men/women] are not allowed by law to ‘accept, take or possess’ the money appropriated. But that’s what is happening now for decades – they all are taking [spending the money personally] like it was for them personally.
The Constitution is/was flagrantly violated here on people’s money! PDAF, DAP, Malampaya Funds, and all ‘funds’ … money, physically delivered unto each of them finely by hook or by crook!
Such abuse! Karumaldumal…no kagalangalang…no shame left…what a creation of public servants! At the height of their plundering what they do not own! Terrible! Horrible!
What punishments deserves them? I dunno!
