A family of bandits? Why Janet Napoles, her husband and 3 children can be charged in the pork scam

The multi-billion pesos corruption scandal was a Napoles family affair, documents from the Securities and Exchange Commission (SEC) show.

A family of bandits? You would never think that of this happy, happy family celebrating their daughter Jeane Catherine’s coming out party two years ago.  In the picture is Jo Christine Napoles (2nd from L), beside father Jaime, Jeane (in red) and the self-confessed Queen of Pork, Janet Lim Napoles.

The Office of the Ombudsman has charged self-confessed pork scam queen Janet Lim Napoles and two of her three children – James Christopher and Jo Christine – as co-accused in the plunder raps it filed a month ago against three senators – former Senator President Juan Ponce Enrile, former Senate President pro-tempore Jinggoy Estrada and Senator Bong Revilla.

Janet Napoles’ husband Jaime (nicknamed Jimmy) and her luxury brand and Hollywood-loving daughter Jeane Catherine were not included in the charge sheets.

However, a close examination of the financial documents filed by Napoles’ flagship company JLN Corporation show rock solid grounds for charging father and daughter, Jimmy and Jeane. In fact, for charging the entire Napoles family of being co-conspirators in the plunder cases filed against the three senators. 

The Ombudsman only indicted Jo Christine and James Christopher Napoles for “working for Napoles and (because they) served as officers of her NGOs which were selected and endorsed by Senator Enrile to implement his projects.”

But they were not indicted for their role inside JLN Corporation which was one of the mechanisms used to launder the pork.

Even under the Anti-Money Laundering Law, the Napoles family can collectively be charged because this law states that “if the offender is a corporation, association, partnership or any juridical person, the penalty shall be imposed upon the responsible officers, as the case may be, who participated in the commission of the crime or who shall have knowingly permitted or failed to prevent its commission.”

One of the “unlawful activities” punished by this law is theft of public money. The penalty ranges from seven to 14 years in jail plus a fine of “not less than P3 million but not more than twice the value” of the stolen loot.

But the Ombudsman appears intent on prosecuting the senators and their co-conspirators for the more serious crime of plunder which carries a life term.  For instance, in indicting Enrile, together with Janet Lim Napoles and two of her children, the Ombudsman said that “probable cause for plunder exists.”

However, Enrile – in his counter-affidavit submitted to the Ombudsman – appears willing to let Janet Lim Napoles take the rap without him. The Ombudsman quoted Enrile as saying that “it was Napoles and her cohorts ‘who persuaded and influenced the implementing agencies to violate their duties and functions’ ” without his participation.

An examination of the bank records and transactions of JLN might reveal a lot about the illicit transactions.

When the con was unraveling last year, Janet Lim Napoles started shuffling a lot of papers.

For instance, the financial documents filed by JLN to the SEC showed that something curious happened inside the JLN company that coincided with the period when Benhur Luy was detained by Napoles and her brother Reynald.

Let me explain.

In the plunder charges it filed, the Ombudsman explained that Senators Enrile, Estrada and Revilla received kickbacks from Napoles from 2004 to 2010. The source of money was the pork barrel of the three senators. In other words, our tax money. This money was allegedly diverted to bank accounts of three Napoles-held corporations: JO-CHRIS Trading, the flagship company JLN Corporation and JLCN Global Properties Development Corporation.

Last year, I wrote that from 2009 to 2011, JLN Corporation paid less in yearly taxes than a public school teacher earning P21,500 a month. For instance, in 2009, JLN reported a “gross profit” of P2.66 million. Deducting operating expenses of P2.6 million and tax, it reported retained earnings of only P508,241.74.

As of December 31, 2009, it reported a “cash on hand/(or in the) bank” of P3.5 million. A year before that, it had a “cash on hand/bank”of only P214,147.57.

The Anti-Money Money laundering Council can easily look at the cash going in and out of JLN’s corporate bank account. Do the fund flows reflect the expenses and income of the family “trading” business? Or do these indicate a serious case of money-laundering?

If the Ombudsman charge is correct, the massive fund flows in and out of JLN’s bank account will not be reflective of the modest “trading” business of the Napoles family.

If the Ombudsman charge is correct, JLN corporation and its board of directors can be held liable for massive money laundering.

Janet Lim Napoles’ “simple person” defense

Before I go on, I’d like to comment on what Janet Lim Napoles allegedly wrote in her unsigned affidavit.

She claimed that she never knew that what she was doing was illegal. On the contrary, her fraudulent transactions were “legitimate and righteous.” Janet Lim Napoles allegedly wrote:

“Honorable Ombudsman, please understand my situation. I am a simple person who wanted to earn for my family. As a person who is only a high school graduate, I then sincerely believe that what I am doing is a legitimate and righteous business.”

“Had I known that giving commission is illegal, I would have not done such thing. I was working in the premise that since I was delivering fully and in some instances more than what I should that it would even things out.”

I leave it to the reader to decide whether Janet Lim Napoles is lying or telling the truth. The modus operandi she used in the pork barrel scam was the same one she used in the earlier fertilizer scam – government money was allotted for buying fertilizer; diverted through her trading company, which either bought low quality fertilizer or made ghost deliveries; and commissions were paid to the government officials involved.

In 2006 and 2009, Janet Lim Napoles was summoned before a Senate investigation on the fertilizer scam. She managed to dodge appearing twice. It’s probably safe to presume that as early as 2006, she knew she was engaged in a fraudulent activity. You can read about this more by clicking here.

To claim that she is “only a simple person…only a high school graduate” is to insult all honest Filipinos who never went to college.

Honesty has nothing to do with educational attainment. Our most celebrated crooks are among the smartest and the most educated in the country.

The curious changes in the JLN corporate board after Benhur Luy’s detention

Let me start from the beginning.

Janet Lim Napoles incorporated JLN in 1999 along with four others:

  • Her late mother Magdalena Lim Luy,
  • Whistleblower Benhur Luy’s mother Gertrudes K. Luy (who has also turned whistleblower)
  • Benhur’s sister Annabelle E. Luy (also a whistleblower)
  • And a certain Nathaniel Tan

JLN’s capital stock was P5 million divided into 50,000 shares with a par value of P100 per share. Each incorporator subscribed to 2,500 shares worth P250,000 each. And each paid up P62,500.

JLN told SEC its primary purpose was the “business of trading of goods such as marine supplies, and equipment, construction materials etc.”

This corporate profile only changed after Janet’s mother Magdalena Lim Luy died on February 28, 2008.

The following year 2009, JLN filed a General Information Sheet (GIS) with the SEC showing three new corporate owners. Besides Janet Lim Napoles and Annabelle Luy , the rest of the shares were now owned by her two daughters Jo Christine and Jeane Catherine and her only son James Christopher. All three also sat in the corporate board.

In 2010, JLN filed another GIS with the SEC showing for the first time the entry of Janet Lim Napoles’ husband Jimmy into the corporate board. Jimmy Napoles assumed the chairmanship while Janet became the President. Jo Christine and James Christopher remained Treasurer and Secretary, respectively. While the fun-loving Jeane Catherine sat on the board without added responsibilities. By 2010, Janet and Jimmy owned 25% each of JLN; Jo Christine, James Christopher and Jeane Catherine, 15% each; and Benhur Luy’s sister Annabelle, 5%.

Recall that the Ombudsman charge sheets claimed that tax money was laundered through JLN Corporation from the years 2004 to 2010. Can the chairman of the board plead ignorance when the president of the board has already confessed to doing it? And what about the other board members?

Now here is where it gets very interesting and curious.

Recall that Benhur Luy was reportedly held against his will after a confrontation with Janet Lim Napoles on December 19, 2012. [NOTE: You can read about this through an eyewitness account of Merlina Sunas by clicking here.]

Through the efforts of his parents and his sister Annabelle, Benhur Luy was rescued by operatives of the National Bureau of Investigation on March 22, 2013. His family told authorities he knew a lot about the fertilizer fund scam.

Curiously, JLN Corporation submitted a GIS to the SEC on March 27, 2013 – or five days after Benhur Luy’s rescue by the NBI from Janet Lim Napoles’ control.

This new GIS dropped Benhur Luy’s sister Annabelle from the JLN board for the first time since JLN was incorporated. Annabelle was replaced by Janet Lim Napoles’ brother Jose Emmanuel Lim. Months later, Annabelle Luy would testify in court that Janet Lim Napoles and her brother Reynald illegally detained Benhur in order to pressure him into owning up to making pork deals with lawmakers behind Janet’s back.

As the news media started picking up Benhur Luy’s story, JLN Corporation suddenly filed an “amendment” at the SEC on May 15, 2013. The amended GIS retained Jaime Napoles as chairman but removed Janet, their children and Janet’s brother Jose Emmanuel Lim from the JLN board. The JLN board was reconstituted with the following directors:

  1. Jaime Napoles – chairman
  2. Filemon S Agustin – president
  3. Andres B. Atan – CFO
  4. Cheryl Jimenea
  5. Peter Lavin
  6. Anthony Dequina

However, on August 8, 2013 after the Philippine Daily Inquirer splashed Benhur Luy’s story on its front page, JLN Corporation again submitted a GIS to the SEC. The JLN Corporation no longer had Filemon Agustin, Andres Atan, Cheryl Jimenea, Peter Lavin and Anthony Dequina in the corporate board. The board had reverted control back to Janet and Jimmy Napoles, their three children Jo Christine, Jeane Catherine and James Christopher, together with Janet’s brother Jose Emmanuel.

It would be interesting for the Ombudsman to question Agustin, Atan, Jimenea, Lavin and Dequina about their sudden appointment and removal from JLN.

Did it have something to do with the public disclosure of the pork barrel scam?

In any case, JLN’s corporate records show that Napoles’ husband and three children can be charged for money laundering.

    Senators Ramon Bong Revilla Jr., Jinggoy Estrada and Juan Ponce Enrile, who are all facing potential plunder cases before the Sandiganbayan, on Monday chose to abstain from voting on a bill that seeks to speed up the anti-graft court’s action on pending cases.

    During the initial voting, 20 senators, including Revilla, approved Senate Bill 2138, which amends the Sandiganbayan Charter (Presidential Decree 1606). Enrile and Estrada registered their abstentions.

    Later in the session, Revilla manifested that he intended to abstain from the voting. He explained that he initially voted in favor of the bill, because he was talking with a fellow senator during the counting of the votes.

    “The messy handling of these cases is best shown by this administration’s treatment of the alleged list given by Janet Napoles to PNoy’s Secretary of Justice Leila de Lima. As previously pointed out, De Lima’s role here, as DOJ Secretary, is just to gather evidence through its investigating agency, the NBI.”

    “The task of evaluating, or of “vetting” said list as evidence (to use De Lima’s term) belongs to the Ombudsman who will conduct the preliminary investigation to determine whether there is probable cause.”

    With her extra-judicial confession by way of her AFFIDAVIT signed by her as assisted by her counsel of choice opting to WAIVE HER RIGHT TO SILENT that anything she says might be used against her in a court of law, fullly understanding the contents thereof, by her own free and voluntary act and deed, Janet Napoles’ will do the following before the Sandiganbayan Court:

    1. I plead guilty to the crimes charged against me. “Et autumo, ex qua rediit sanitas, ut in criminibus adversum me.”

    2. Oldie Enrile, handsome Revilla and sexy Estrada are also guilty. “Oldie Enrile, decoros forma, et parum pudici Revilla Estrada sunt, sed etiam boni.”

    3. I will testify of my own volition to my guilt and the guilt of my co-accused senators. “Et testificabor culpam sponte coepiscoporum culpae reus senatores.”

Lalo na ngayon, na pati mga pangalan ng mga kilalang reporter ay allegedly tumanggap ng “gifts”. Mahirap ng magtiwala sa mga nababasa sa news.. Only a handful does analytical independent reporting, as extensive as you do.. And I am very thankful for that. I hope more people will learn about your blog posts.

        Napansin ko rin. Ang mga kakampi ni Gloria, Mike, Rene C., Erap at Jojo ay hindi kasali sa Napolist tulad nina Arnold (GMA), Anthony (ABS-CBN), Niñez(Tribune), Doronilla (Inquirer), Tiglao (Manila Times), Magno (Philstar). Etc.

        BTW yung TV at Radio host na may 2.5M at mayroon programa nang early morning at late afternoon, di ba si Anthony Taberna ng Umagang Kay Ganda sa ABS-CBN at Dos por Dos sa DZMM?

    1. The Golden Rationalization, or “Everybody does it”

    This rationalization has been used to excuse ethical misconduct since the beginning of civilization. It is based on the flawed assumption that the ethical nature of an act is somehow improved by the number of people who do it, and if “everybody does it,” then it is implicitly all right for you to do it as well: cheat on tests, commit adultery, lie under oath, use illegal drugs, persecute Jews, lynch blacks. Of course, people who use this “reasoning” usually don’t believe that what they are doing is right because “everybody does it.” They usually are arguing that they shouldn’t be singled out for condemnation if “everybody else” isn’t.

    Since most people will admit that principles of right and wrong are not determined by polls, those who try to use this fallacy are really admitting misconduct. The simple answer to them is that even assuming they are correct, when more people engage in an action that is admittedly unethical, more harm results. An individual is still responsible for his or her part of the harm.

    If someone really is making the argument that an action is no longer unethical because so many people do it, then that person is either in dire need of ethical instruction, or an idiot.

      2. The “They’re Just as Bad” Excuse, or “They had it coming”

      The mongrel offspring of The Golden Rationalization and the Bible-based dodges a bit farther down the list, the “They’re Just as Bad” Excuse is both a rationalization and a distraction. As a rationalization, it posits the absurd argument that because there is other wrongdoing by others that is similar, as bad or worse than the unethical conduct under examination, the wrongdoer’s conduct shouldn’t be criticized or noticed. As a distraction, the excuse is a pathetic attempt to focus a critic’s attention elsewhere, by shouting, “Never mind me! Why aren’t you going after those guys?”

      Its other familiar, equally absurd but even more corrupting manifestation is the “They had it coming” variation. This argues that wrongdoing toward a party isn’t wrong because the aggrieved party doesn’t deserve ethical treatment because of its own misconduct. But the misconduct of a victim never justifies unethical conduct directed against that victim.

    Between P100 bucks stolen from me compared to P10 Billion bucks stolen by public officials who promised to be TRUSTED by the people, the latter stealing is a greater wrong inside corruption.

    The one who stole from me did not make a promise to me any trust. But lawmakers and other public officials did.

    We may be flawed but not a gravely flawed as them. We keep more to do our promises like one: pay our TAXES. They violate us by STEALING the taxes in huge billions of amounts.

    We are surprised because the amounts rans into BILLIONS of PESOS and continues with no stopping.

    It is not a white noise but THUNDEROUS noise bursting our ear drums.

    Lastly, the Philnews Editorial says:

      Very true and revolting – but not totally hopeless. Changes can still be made if we work together and elect principled and winnable politicians who have never tasted the “crispy pata” of napoles.

      The combination of Sen. Serg Osmena and Sec. Ping Lacson could be our only hope that their administration will be “pork less” and the plunder cases won’t end in acquittals.

      Serg has the integrity and money and huge bailiwicks from the cebuano-speaking visayas and mindanao and from luzon who know his records. Ping has been an anti-pork advocate and graft-crusader and can discipline our notorious police patolas.

      This may be a gamble but it could work to prevent the makati billionaire from continuing the present pork-laden administration come 2016 until 2022, and may be forever.

      tama ka dyan, leona. the editorial is just someone’s personal opinion albeit a twisted one, gloomy and probably written under alcoholic haze. mukhang old na yata siya, hapo na and has lost the zest for life. passive and miserable. overwhelmed. makes you think editorial is tragic dude, alive yet already dead inside. someone should edit and revised the editorial. or send the edtorial writer on long vacation. to recharge batteries. maybe new set of batteries is needed. the old set is proving to be worn out and showing its age. renovate it or detonate it.

    In today’s 7th of a series by the PDI on benhurLIST, highlighted the alleged payoffs to prominent media personalities like Korina Sanchez and Mike Enriquez, among others, through one Mon Arroyo, a former tv director.

    In the disbursement entry of benhur dated 9/29/04, an entry appeared “mon arroyo-cash gift for mike enriquez P50,000”
    Another entry dated 10/5/04 “mon arroyo – bday gift for korina P50,000”

    Like their counterparts in congress, both immediately denied the allegations. Mon arroyo, on his part, sent to PDI yesterday a sworn statement vehemently denying his involvement in the media payoffs by napoles, either for himself, sanchez, enriquez or any journalist.

    If the children did not knew the source of money is ALIBABA, then they may protest with the court that they are not aware of it and was innocent. If I am one of the children, I will declare immediately that “I am not aware of the source of money is BAD and here is my resignation, why ruin me?”.       I think napoles is a bad mother. not all mothers are worthy to be called mothers. some have been known to kill their own children, sell their own children, abandon their own children.

      how could napoles close her eyes to the lot of other mothers who have hard time feeding their children? can’t afford let alone find roof over their heads, have sick children and no money for medical care, samantala si napoles at ang mga anak niya ay paiba-ibang kotse halos araw-araw. may kanya-kanyang mga condo rin sila, ang gagara ng mga kagamitan nila. sobrang excess and lifestyle nila, the sky is no limit. if they look out the window, they must have seen the miseries of children sa lansangan and instead of shedding tears and lending a hand, they continue on buying very expensive goods pang instagram.

      I think, napoles is a very bad mother. she did not instill honesty in her children, love and respect for fellow being, and sharing what they have with those that have nothing.

      pain? I doubt if napoles suffers much pain in childbirth. she can easily afford the best epidurals, she probably have her own suite at the hospital too, with nurses at her beck and call. thanks to stolen money. her children were looked after by yayas 24hrs a day, fed, bathed, and taken to bed.

      napoles wont be feeling anymore pain. she has undergone operation and is pain free now.

      the only pain we will be seeing on napoles’ face is when she relinguish all that she has stolen. takot yan, baka mamulubi at manirahin rin sa lansangan.

        Percy, gma’s lawyers are far too smart to PNoy’s as shown by the dismissal of her electoral fraud case, ZTE deal, and possibly the PCSO intelligence fund. The 4th case, the malampaya fund, may likely end with the same fate.

          in jarius bondoc’s article in Philippine Star dated 15. May, he indicated that Pnoy and Abad received Pork barrel from GMA which they used for their constituencies (Pnoy in Tarlac and Abad in his hometown) and for that reason, Ombudsman Morales had to dismiss Arroyo’s case on ZTE- and the cases of Lito Lapid et al para hindi mabuksan iyong kaso ni Arroyo at madawit si Pnoy and Abad.

          You’re probably right, but at least now there seems to be a will to do the right thing. Although we have to be persistent in pressuring the Government to be diligent in their work. I believe that corruption is the main cause of our problem, corruption that magnified in unbelievable levels during the Marcos regime and became the norm after- proven in Estrada’s and GMA’s time. We can not give up now, this is a good start.

      You are right, Percy. Sa ngayon ay tulay ang kaso sa ZTE, PCSO at electoral sabotage na isinampa ng gobyerno laban kay GMA. Ang nabasura ay yung fertilizer fund scam dahil pribado na complainant at kulang ang inihain na ebidensya. Kaya ipinapa-refile ni PNoy ang kaso. At hindi ito double jeopardy.

      Kaya huwag tayo maniniwala sa mga “OPLAN LIHIS.”

Proofs are now being exposed, yet no senator, no congressman, no public official admits to it. It’s not just the Napoleses who plundered the Philippines, there’s “Sexy” and his father before him, and now it’s his mother and his brother also. There’s “Pogi” and his father; and there’s “Tanda” and his querida. There’s Gloria and Mike and Iggy, too. All of them has made the Filipino look stupid, they should all rot in jail for the rest of their lives.

          sadly, winnability will be the issue. with binay’s vast network of local gov’t officials(as attested to by the fact that nancy the non-debater was able to get a senate seat on the sole qualification of being a binay daughter). it seems that purity and nobility of character, vision and intention will not be enough to win against binay. a slew of news articles showing binay’s rotten core will certainly help. but who will we vote for? that is the question. obviously i don’t have the answer. do you?

How come it is taking so long for them to be charged, tried and jailed.. Ang KAKAPAL ng mukha,,,walang kahihiyan, Sa ibang bansa once involved in anomalies they resign or commit suicide.
