I’ve included those portions about Aquino’s meeting with Vice-President Jejomar Binay, his attitude towards threat of critics to have him arrested and jailed after his term; and how he keeps tabs on social media postings like Facebook.
During this morning’s Foreign Correspondents Association of the Philippines forum with President Benigno Aquino among the questions I was able to ask him was the following:
VP Binay’s spokesperson Jonvic Remulla said the President had “asked about (Binay’s) family and the Vice President replied that the family was hurting from all the lies and baseless accusations, especially [against his wife).” Remulla said“At this point, the President asked how he can help or ‘paano ako makakatulong?’”
Is this true?
I was referring to the recent over-an-hour long conversation between Vice President Binay and President Aquino.
PNoy basically told me that what actually happened was “the reverse” of what the Binay camp disclosed to the press. He told me:
“I didn’t offer to help.”
It was VP Binay who had asked him for advice, he added.

Senators castigated Tiu for claiming ownership when he was not holding the land title yet and it was not apparently a done deal.
Tiu said he acquired the 150-hectare Batangas property from Laureano Gregorio in a P446-million contract, which was subject to certain conditions.’ PDI newspaper.
A P446M worth FARM and only P11M paid as down-payment, and VP Binay AGREES to this deal? Worst, Mr. Tiu CAN ENTER the FARM and DO A LOT OF THINGS? Where’s the COPY of the CONTRACT [to Sell]?
Is Mr. Tiu saying VP Binay went into a boboventa? At siya into a boboBILINAY? What a jack- of- all trade STORY Mr. Tiu! A slipper deal but got stuck up.

Tiu said that:
“2. Mr. Gregorio shall deliver to Sunchamp documents to evidence Sunchamp’s real and enforceable rights over the property.”
Apparently, the senators missed the implication of the phrase “real and enforceable rights over the property.” It simply means that the real rights of Tiu over the property concern the improvements or buildings. The ownership rights on the land is excluded. Both the building and the land are immovable or real property but the agreement between Tiu and Gregorio pertains only to the buildings, roads and other improvements on the land.
This is confirmed by the clause in the agreement that says:
“3. Mr. Gregorio shall likewise cause the registration of the improvements in the name of Sunchamp, again as evidence of Sunchamp’s real and enforceable rights over the property.”
The said clause relates to registration of IMPROVEMENTS only. Had the land been the subject of registration, there is no need to mention the improvements anymore. To the owner of the land belongs the improvements on it unless a contrary agreement is made.
Tiu also said:
“6. By June 2014, tax declarations on the improvements within the Property have been issued in the name of Sunchamp.”
This attests to the fact that the agreement between Tiu and Gregorio pertains to the IMPROVEMENTS only. Tax declarations on the improvements in the name of Sunchamp were issued but not over the land which should take precedence over the improvements. The improvement or building is merely an accessory to the land.
It simply means that no TCT in the name of Sunchamp is forthcoming ever by virtue of the agreement between Tiu and Gregorio. Meaning also that the ownership of the land would remain to person or persons other than Tiu or Sunchamp.

But Tiu was very emphatic that the 446 million includes the land and its improvements. Even Martin Subido confirmed that the contract is for ownership of the land but that they paid only 11 million pending delivery of the ownership of the land. And Martin Subido stated that it is contrary to law to own more than 5 hectares of agricultural land.
Towards the end, the Senators asked the liability clause of the contract on the deliverables. And it seemed that the “successful businessman” whose 2 companies are listed in the stock exchange, was quite shocked on the question of liability.

There was a very interesting question by Koko to Tiu about the contract not having a default/exit clause. This is very unusual especially for a deal worth almost half a billion pesos. It presents a most likely scenario of Tiu and the real owner agreeing to delay the full payment of the contract price, and then at the right time Tiu will default on the payment and the contract will be rescinded. Ownership will the retained by the real owner, and Tiu would have functioned as a caretaker during the time he had the rights to the farm. But would Tiu be not worried about losing money? As the hearing today showed, he apparently doesn’t mind that his companies are losing money year after year, as long as there are “unknown” investors putting in billions into his intricate web of companies where money goes around like a game of sungka.

Chit, thanks for the update earlier on regarding Tiu having to produce a copy of the complete Sunchamp purchase agreement. It should provide some definitive answers to some of the these questions as to what is in the agreement. In the short video clips of the Tiu hearing in the online news I was able to view, I tend to agree with your impression that it also covered ownership of the hectareage. What is very intriguing to me is the abscbn coverage which had Tiu saying that he had confirmed Gregorio’s legal ownership of the hectarage. This response was elicited by the senators asking the amount of due diligence he exerted as a buyer of land not titled to the seller in the agreement. As I have also been saying earlier, the trail leads to Gregorio who has been buying expensive real estate in the US recently and it seems like he showed proof of legal ownership, if Tiu is to be believed.

also, the link between Tiu and Binay has been established via campaign contributions. There was also the log cabin in Highlands, who Binay says he is “renting” but he (or his wife, she signed it) is paying for membership dues. As far as I know, Highlands (or any highly exclusive clubs) is strict when it comes to membership. Can anyone verify this?

The Binays will be able to get away with the Highlands fiasco easily. I was kind of disappointed with Mercado presenting charge receipts as evidences. Anyone, as long as they are endorsed by members, can rent rooms and houses in Highlands and eat at restaurants and avail of its facilities and services. The customer can opt to pay for these themselves upon check out, or it can also be charged to the member.
However, it looks like that the Binays are members themselves, judging from the information on the charge slips. Mercado would need to present more evidence on the ownership of the log cabin, aside from the initial notice for the downpayment.

Mercado presented all the checks issued for payment of the logwood cabin as well as the note from Gerry Limlingan to make the checks payable to Henry Sy, Jr.
One of the manager’s check application was also presented showing that the buyer of the MC is Gerry Limlingan whose address is the same address as that of the VP in Makati City.

It will be difficult to get a credible information from Tagaytay Highlands regarding Binay’s supposed ownership of one log cabin. Willy Ocier, who spoked for Tagaytay Highlands, is a well known crony of Erap Estrada. Remember Erap’s plunder conviction? This Ocier was instrumental in that case.
So, since Binay is currently allied with Erap, expect Ocier to make things covered for Binay.

So the great Show Me your Documents/I Will Show Mine between Trillianes and Tiu never happened. Tiu as I have been saying all along admits he doesnt have title/legally own the 145 hectares where the Sunchamp sits but instead has ‘usufruct’ or the rights to use the land even though he doesnt own it. He did enter into an agreement to acquire everything including the land for almost half a billion pesos. He said though he only paid 11 milliom pesos down on the agreement until titles to the land starts being transferred to him. Tiu did not explain why the transfer of land ownership was delayed.
The 446 million peso agreement must be a very interesting document since it identifies who owns the land, what was being sold and when, and who was being paid and how much. The sort of information most helpful in pointing out anyone acting as a dummy whether it be Tiu, Gregorio, or someone else. Hopefully, a subpoena is issued to have it produced and examined at the next hearing.

For a person who paints himself as a successful businessman, look at his face when Sen. Cayetano was ticking off the operating profit/losses of his companies, specifically Sunchamp & Greenergy Holdings that run losses to millions in the past 4 years of operation. He can not even say when he made his 1st million. He says he has 36 companies…. Why the need for 36 companies when these are all interrelated in the same industry = agriculture and real estate? He says it is sound accounting practice to not book an asset when its not yet fully paid but have made already a down payment of 11 million pesos. Ask any accounting graduate when to recognize an asset and a corresponding liability. As long as there is a contract, whether an installment contract or a contract to sell or whatever type of contract, as long as there is an exchange of goods and services, there is a corresponding asset and a liability,.He maybe a plain dummy – he can not even remember when the payment was made. He talks about a contract to purchase the property for 456 million but made a down payment of 11 million. Who in his right mind will part with his property worth billions with just 11 million down payment? And he can not even point out in the cash flow statement where the 5 million payment made is shown.
Antonio Tiu is simply one over-confident person; he thought by ticking off his awards, etc., he will mesmerize the Filipinos with what smart kid he is…. Wait till BIR check on the tax returns of his brother James Tiu and his wife for their capacity to contribute 15 million to VP Binay.
Bravo for these 3 senators – they are well-prepared and calm and collected and ask simple questions that rattle the so-confident “successful businessman” operating companies losing millions in 4 consecutive years….Piercing the corporate veil of ownership – that seems to be their forte.

Stock fraud, if his companies related to hacienda are sold in stock exchanges, would be his next problem.
If he can do this kind of monkey business with fraudulent claim of ownership, it would not be surprising that fruit and juice products sold under his ARI are adulterated or chemically manipulated.

I once played chicken with a wang wang convoy. It was along Gilmore Street and they were doing a counterflow. Mind you it was past 10pm at night and there was very little traffic. Antonio Tiu claims he owns usurfruct rights to 150 hectares of land, made a down payment of 11 million, when unknown. What taxes was paid to the government on that point of sale ?to whom did he pay the check? Where is copy of cancelled check and specifically the copy of usurfruct rights? More questions to Tiu?
Who is paying for real estate taxes of 150 hectares?
The loser in this 150 hectares transaction is the govt, specifically the province of Batangas and Rosario town treasuries. Gov Vilma Santos should investigate the cheating on taxes and if unpaid by registered owners should start foreclosing the properties then Batangas could own a nice property it can promote as tourist attraction in the province.
Senators could start legislating how to make laws about Usufruct rights and taxation. Meanwhile BIR DAR, LRAshould be instructed by the president to investigate if taxes were paid, if not who is responsible? BIR should investigate the income tax paid on the 11 million Tiu paid for. Who was recipient?

It seems that Laureano Gregorio is out of the loop insofar as Hacienda Binay is concerned. Both Binay and Tiu point to him as the future and past owner, respectively, of 145 hectares of Hacienda Binay. But it is ironic that nothing is heard from Gregorio himself whether in media or senate despite the fact that he is the fulcrum that balances the ownership – past and future – of Hacienda Binay.
Rightly so because it was Binay who bought all the parcels of land comprising the Hacienda Binay from the poor farmers. He it was also who conspired with Tiu to perpetuate the unlawful scheme to acquire more than the 5 hectares of CARP land by foisting an agri-tourism project. The rules also require that subsequent purchaser of CARP land after the ten-year prohibition shall continue the cultivation of the land and maintain its productivity.
Apparently, Binay is really fond of creating a MAZE to daze and confuse the public by putting an obstacle course between him and Tiu.

What is happening to VP Binay now is similar to what happened to Erap Estrada during his term. Jonvic Remulla has been caught painting his own boss into a corner several times now:
a. when Remulla stated that there was indeed massive corruption in Makati city hall (by Mercado et al) during Binay’s term as Mayor, he was at the very least saying that Binay knew it but did nothing. Of course, it is unbelievable that a corrupt VICE MAYOR could all that without the MAYOR above him knowing.
b. Remulla has claimed that Binay had never been interested in horse racing or fighting cocks or betting on them. But commenter Sam here on Raissa’s blog has found an online resource showing Binay once owned racehorses. And there are published news reports in the past of Binay hosting cockfights.
c. And now this one on the Malacanang meeting between Binay and Pnoy.
During Erap’s time, Jerry Barican (bless his soul) was always contradicting his boss’ statements, leading people to believe either one or both of them were lying.
Remulla is way in over his head. Hindi niya kaya ang trabaho dahil laging may inconsistent sa statements niya.

The problem is not so much with Remulla’s ability being the spokesperson but rather on the situation he is in which is defending the indefensible or covering a lie. The moment he put forward details of argument to make a position looks true, he expose himself to requiring to put more details to cover the ever expanding positions/situations. To defend a lie, he have to concoct lies, half-lies and half-truths that requires their own defense for them to be considered truthful. Its a loss-loss scenario for Remulla.

If one tells you that a President could stop the wang-wang’s and jail a former President for corruption and a Chief Justice for corruption and a former President of the Senate for corruption and an Ombudsman that resigned because of her corruption, and a Vice President for corruption??? Then you would never believe it!
