Now that it’s officially summer, what better time to revive “Halo-Halo”, my gossip column about everything and anything.
First off, the Foreign Correspondents Association of the Philippines (FOCAP) had an unexpected invitation from US Ambassador Philip Goldberg to see him and his embassy staff for cocktails last Thursday.
I must say, I did not expect Goldberg to place everything off-the-record. I guess I had been spoiled by previous invites from the ambassadors of France and even from China before (notably Ambassador Liu Jianchiao) who has long been transferred to Indonesia.
Since I can’t talk about what Ambassador Goldberg told us, let me share my first impression of him. He’s a thin, wiry man, shorter than the average white male American. I mean, he’s just a few inches taller than I am and I’m shorter than the average Filipino.
While he was talking I was wondering why he reminded me of someone else. And then it hit me. He looked like one of my dad’s favorite TV characters – Eliot Ness in the Untouchables, played by actor Robert Stack.

From what he told us about his activities in the Philippines, Goldberg seems to pack a lot of energy.
I wished though that I had done more homework on the ambassador before the cocktails since he has such an interesting background, as pointed out to me by Joshua Young @josh4everyoung on Twitter. I could have asked him some naughty questions.
In 2008, Goldberg was sent packing by Bolivian President Evo Morales for allegedly “fomenting civil unrest” there. Goldberg is fluent in Spanish.
Then for two years, the career envoy sat it out in Washington as the Department of State Assistant Secretary for Intelligence and Research before being sent to Manila.
Now, he’s in Manila in the middle of a noisy political transition from one administration to the next. Good timing.

I am fascinatedly watching the deadlock in Makati between the acting Mayor Romulo “Kid” Peña and the elected but suspended Mayor Erwin “Junjun” Binay. The latest news is that the employees of Makati donned black shirts last Friday to protest the situation.
If the Court of Appeals or the Supreme Court does not come to Binay’s rescue, in 11 days’ time the loyalty of the Makati city hall employees will be sorely tested.
A long public holiday is coming up and employees will need to get their salaries to enjoy the long Holy Week break. If the former Makati Vice Mayor Ernesto Mercado is right, city hall employees’ salaries are still disbursed in cash and not sent electronically to their ATMs.
Unfortunately for Mayor Binay, the Department of Interior and Local Governments is trying to make sure he won’t have access to cash. The DILG has already told the Land Bank not to honor Binay’s signature for any disbursements.
If the acting Mayor Kid Peña announces that the salaries would be made available at the old Makati City Hall where he is now holding office, what would the protesting employees do? Troop to where Pena is holding office?
Or mark Holy Week in the new city hall?
And if the courts don’t come to Binay’s rescue, the young mayor faces the prospect of spending Holy Week in his office.

As for Mayor Binay showing the media that he sleeps on a sofa inside his office, reporters, please ask him to show you the secret bedroom of his office inside the new Makati City Hall building.
His father, Vice-President Jejomar Binay, told me in a 2010 interview he had a bedroom installed there, too.
Here is the pertinent excerpt from my interview with the elder Binay:
Me: Sir, tatanugnin ko sa inyo, a. Huwag kayong magagalit. A long time ago actually, you showed me the room of Yabut (the mayor of Makati just before VP Binay).
Binay: Ah, when we had that new building so I had to leave that place.
Me: So yung office nyo ba, Sir, may nagtatanong, meron pa bang bedroom sa office nyo?
Binay: Meron siyempre.
Me: Meron pa?
Binay: Hanggang ngayon yung bago kong opisina may bedroom.
Me: Doon kayo natutulog?
Binay: Pagka nandoon ako. Tanghalian. The only time I think I slept there nighttime was when we were under siege. 2006.
Me: 87?
Binay: No. 2006 yata.

What also intrigues me about the Makati City Hall standoff is the total absence of protesters waving red banners of, you know, the left-wing affiliates.
It would seem that even they have distanced themselves from the Binay family.

Baycas, the strength of the OMB’s evidence of guilt is indeed one of the main issues the SC has to rule on in the Binay case. Whether the principle of condonation due to Mayor Binay’s reelection is a going to be a big factor in deciding this issue, based on Binay’s counsel’s statement and the CA judges’ questions.

In Capulong case the Supreme Court declared that “the CA aptly ruled that the Ombudsman abused its discretion because it failed to sufficiently establish any basis to issue the order of preventive suspension. Capulong’s non-disclosure of his wife’s business interest does not constitute serious dishonesty or grave misconduct.” Meaning that there was clear showing that the OMB gravely abused its jurisdiction.
Now let us see whether the OMB gravely abused its discretion in finding that the evidence of guilt of Binay for serious dishonesty and grave misconduct is strong. The court cannot go beyond prima facie evidence or the face of the complaint and supporting evidence attached as annexes to the Complaint. The OMB does not need to prove the veracity of the allegations in the complaint and supporting evidence.
The said pieces of evidence show, prima facie, that Junjun Binay awarded the Makati Parking Building project particularly phase 3, 4 and 5 to MANA Architecture without public bidding and with fake documents. Worse, MANA was paid even without rendering the requisite services. The OMB preventive suspension order states such allegations in the Complaint.

CPMers are fully aware of such evidence. Are the pieces of evidence, on its face, not strong enough to warrant suspension of Junjun Binay? Has the OMB established sufficient basis to issue the preventive suspension order against Binay? IMO the pieces of evidence of Binay’s serious dishonesty and grave misconduct are OVERWHELMING.

What is a ‘legal fiction’ rule in legal parlance?

We think or have thoughts in the realm of actions. About the true. Unlike the hocus-pocus of some judges and magistrates, convoluted into legal fiction.
If a judge or HURADO in arriving at a decision, senses an injustice by applying LEGAL FICTION, should the judge or HURADO insist the legal fiction? Than gatting JUSTICE done?
There are many ‘INVENTED’ legal doctrines etc., that should not be followed as against JUSTICE in its true worth. Time to be sensible. Simply sensible.

Not being a lawyer, I take it from you that there is what is known as “legal fiction” such as the topic of condonation of past crimes through reelection.
(BTW, the Catholic Church, during Galileo’s time, had its own legal fiction in the form of the earth being the center of the universe.)
But that is the whole point of my note above. This legal fiction was written by the SC; it can be revisited and consigned to the garbage that that fiction deserves, if the SC Justices are to be respected or honored as they would want to be. I may not have the gift of a legal mind but ordinary reasoning and common sense rebels against this fiction.
That is why I equate the bobotantes and the SC Justice above in their propensity to faulty reasoning although both have hugely different circumstances in financial well being and security.
In this season after Easter, do the SC Justices have to perpetuate this legal fiction? No amount of legal acrobatics can erase my suspicion that this legal fiction if perpetuated can be used to evil ends.
Can we frankly say that the benefits from such fiction is more than the losses and damage to the SC reputation as an Institution by holding on to that fiction? Surely, the Justices who I ascribe to have intellect better than the bobotantes can balance the gains against the losses. Can the SC Justices not rise above motives we ascribe to the bobotantes?

Caliphman, it is good you mentioned that the Samaniego and Parungao cases are not identical to Binay case. To me they are not also similar. Indeed the former cases are irrelevant to the Binay case.
The Samaniego and Parungao cases pertain to appeal by petition for review of decisions by the OMB (section 27), while the Binay case concerns restriction on injunctive relief in the investigation of the OMB (section 14).

In an effort to buttress our (specifically MY) desire for a ruling of the SC against Binay Jr, I am synthesizing or putting your two thoughts together on the SC-CA-OMB issue which is up before the SC, on this eve of April 6, the deliberation of which I am awaiting with great interest for its consequence among others on the 2016 Election:
– Rene-Ipil’s view of enforce-ability of the OMB suspension order if the Omb can show clearly to the SC that its order is WITHIN its Jurisdiction;
– Caliphman’s view — after explaining his five tiers: the 1987Constitution. RA 6770 Omb Act, Rules of Procedure of Omb, Rules of Court developed by SC, Specific Cases handled by SC bearing on our Binay issue — that the RECENT SC cases of TROs against Omb ruling, although not identical or similar, may have SOME substance in them assisting in a ruling against Binay.
Thus, if we have the two together – Suspension Order by the Omb is not OUTSIDE its Jurisdiction; and RECENT SPECIFIC CASES decided by the SC have SOME applicability to the Binay case, then we may have a case against Binay on the suspension order, barring hanky-panky.
To my mathematical mind Rene-Ipil’s thought that the Omb Suspension Order holds if it’s WITHIN its Juridisction is already a NECESSARY and SUFFICIENT condition (that is, RECENT SC CASES need not be appealed to). The SC, of course, will have to make the ruling that the Binay case is WITHIN THE OMB’S JURISDICTION.
I dearly hope that the majority of the SC Justices rises to the occasion and not succumb to enticements in whatever form.

We, in CPM, have been criticizing for quite some time now that indeed there is no inclusive growth and the manna has been greedily cornered by the Taipans and the Oligarchs.
Aquino recently realized that and he even berated the Chinese Businessmen to share their profits to their abused employees.
Binay saw his opening and criticized Aquino’s inclusive growth strategy. He is correct but he has ulterior motive doing that. He wanted to trumpet his “Trickle Down Economy” (TDE), Makati style and belittle Aquino’s stride in that sector.
