Now that it’s officially summer, what better time to revive “Halo-Halo”, my gossip column about everything and anything.
First off, the Foreign Correspondents Association of the Philippines (FOCAP) had an unexpected invitation from US Ambassador Philip Goldberg to see him and his embassy staff for cocktails last Thursday.
I must say, I did not expect Goldberg to place everything off-the-record. I guess I had been spoiled by previous invites from the ambassadors of France and even from China before (notably Ambassador Liu Jianchiao) who has long been transferred to Indonesia.
Since I can’t talk about what Ambassador Goldberg told us, let me share my first impression of him. He’s a thin, wiry man, shorter than the average white male American. I mean, he’s just a few inches taller than I am and I’m shorter than the average Filipino.
While he was talking I was wondering why he reminded me of someone else. And then it hit me. He looked like one of my dad’s favorite TV characters – Eliot Ness in the Untouchables, played by actor Robert Stack.

From what he told us about his activities in the Philippines, Goldberg seems to pack a lot of energy.
I wished though that I had done more homework on the ambassador before the cocktails since he has such an interesting background, as pointed out to me by Joshua Young @josh4everyoung on Twitter. I could have asked him some naughty questions.
In 2008, Goldberg was sent packing by Bolivian President Evo Morales for allegedly “fomenting civil unrest” there. Goldberg is fluent in Spanish.
Then for two years, the career envoy sat it out in Washington as the Department of State Assistant Secretary for Intelligence and Research before being sent to Manila.
Now, he’s in Manila in the middle of a noisy political transition from one administration to the next. Good timing.
Here’s a short video I took of our cocktails just as Goldberg announced he was placing everything off-the-record. The tall man beside him is Kurt Hoyer, the US embassy information officer.

I am fascinatedly watching the deadlock in Makati between the acting Mayor Romulo “Kid” Peña and the elected but suspended Mayor Erwin “Junjun” Binay. The latest news is that the employees of Makati donned black shirts last Friday to protest the situation.
If the Court of Appeals or the Supreme Court does not come to Binay’s rescue, in 11 days’ time the loyalty of the Makati city hall employees will be sorely tested.
A long public holiday is coming up and employees will need to get their salaries to enjoy the long Holy Week break. If the former Makati Vice Mayor Ernesto Mercado is right, city hall employees’ salaries are still disbursed in cash and not sent electronically to their ATMs.
Unfortunately for Mayor Binay, the Department of Interior and Local Governments is trying to make sure he won’t have access to cash. The DILG has already told the Land Bank not to honor Binay’s signature for any disbursements.
If the acting Mayor Kid Peña announces that the salaries would be made available at the old Makati City Hall where he is now holding office, what would the protesting employees do? Troop to where Pena is holding office?
Or mark Holy Week in the new city hall?
And if the courts don’t come to Binay’s rescue, the young mayor faces the prospect of spending Holy Week in his office.

As for Mayor Binay showing the media that he sleeps on a sofa inside his office, reporters, please ask him to show you the secret bedroom of his office inside the new Makati City Hall building.
His father, Vice-President Jejomar Binay, told me in a 2010 interview he had a bedroom installed there, too.
Here is the pertinent excerpt from my interview with the elder Binay:
Me: Sir, tatanugnin ko sa inyo, a. Huwag kayong magagalit. A long time ago actually, you showed me the room of Yabut (the mayor of Makati just before VP Binay).
Binay: Ah, when we had that new building so I had to leave that place.
Me: So yung office nyo ba, Sir, may nagtatanong, meron pa bang bedroom sa office nyo?
Binay: Meron siyempre.
Me: Meron pa?
Binay: Hanggang ngayon yung bago kong opisina may bedroom.
Me: Doon kayo natutulog?
Binay: Pagka nandoon ako. Tanghalian. The only time I think I slept there nighttime was when we were under siege. 2006.
Me: 87?
Binay: No. 2006 yata.

What also intrigues me about the Makati City Hall standoff is the total absence of protesters waving red banners of, you know, the left-wing affiliates.
It would seem that even they have distanced themselves from the Binay family.

For people to ask the President to step down, or be impeached, for the debacle in Mamasapano, yet not ask other politicians to do the same for more serious offenses, such as for massive graft and corruption, then the motivations of those people are suspect to say the least because of their silence, or unpatriotic to say the worst because they are contributing to the attempts by others to destabilize our government.

Eto ang pagkakaibang nakikita ko:
Una (pun intended) marami riyan ang may mabibigat na kaso na sa Sandiganbayan pero ayaw magbitaw, at walang sumisigaw na magbitaw sila. Si Junjun Binay nga sinuspindi na ng Ombudsman pero ayaw pa rin umalis sa Makati City Hall.
Si Presidente Aquino naman ay wala pang findings na may administrative or criminal liability siya. Yun ngang report ng Senate nasa preliminary stage pa lang. At kung meron man siyang magiging liability ay wala pa akong narinig na may impeachable offense siyang nagawa. Pero marami na ang sumisigaw na maimpeach siya, o magresign sa pagiging Presidente.
So nasaan ang fairness, kung fairness din lang ang pag-uusapan?

The President is not liable for numerous reasons.
1. He has prerogative powers. It involves a decision taken by him based on his interpretation of his constitutional powers, by his own initiative.
It gives him the power to choose the person to consult when he makes plans. Calling the shots in combat mission is one of his tasks. The moment he and his field commanders decide to start to carry out a mission, they have to do it without hesitation or no looking back, it’s always final because there is no such thing as “wait a minute” in the battlefield, regardless of whether their judgment is perfect or imperfect.
Even if his “prerogative powers” is subject to constraints by other branches of government, he could overcome it because the outcome of the mission is beyond his control and cannot be changed. That said, the doctrine of partial separation of power must be applicable in this case.
2. Hindi massacre ang naganap sa Mamasapano kundi encounter.
3. Every soldier is bound by an oath to perform his duties.
4. At di naman dapat ipalagay na ang Commander-In-Chief ay mayroong leverage sa pag command sa field in the same way as the Field Commanders.
5.No nation in this world has made military officials answerable for a mission that resulted in the loss of lives of some of the troop members.

Ang importante ay kung:
1. Marami ba sa mga Pilipino na dating walang trabah eh nagkaron ng trabaho?

Ang summary ay kung nararamdaman ba ng ating mga kapatid ang pag-unlad na sinasabi ng Bloomberg at di lang eto eksklusibo sa mga may-ari ng negosyo at mga Taipan?
Ang kalusugan ng bansa eh nasusukat kung ang karamihan ng tao ay nakikinabang; kumakain ng tatlong beses sa isang araw; mas marami at matatag ang tinatawag na middle class, dahil ito ang tinatawag na indication na pangmatagalan na kakisigan ng ekonomiya at bansa!

@Rene-Ipil, I have no doubt about the statement of the technocrat Balisican on the poverty incidence. But will you kindly tell me if my impression of the following study is correct? (You seem to have a feel for this; am too lazy today to do some googling.)
I seem to have come across a study which says that in a country’s march to GDP growth, the alleviation of poverty lags considerably behind until a certain period of continuous GDP growth is achieved. Based on Balisican’s statistics, we may have the beginning of the real decrease in poverty incidence. Having made that pronouncement, I am sure NEDA have their eyes focused on this ball, among others. I hope this is not the case of “one swallow does not a summer make.”

The World Bank says that inclusive growth is the “rapid and sustained poverty reduction… that allows people to contribute to and benefit from economic growth.”
According to the Joint Foreign Chambers (JFC) a sustained gross domestic product (GDP) growth of up to 8 percent, among other factors, is needed to attain inclusive growth.

Philippine economists has a history of overpromising and fudging statistics to prop up their president’s economic policy.
Hype and exaggeration and changing the metrics to suit the desired outcome, especially in alleviating poverty!
So I take that with a grain of salt until there are actual families who could testify about the claim!

In his paper written in 2010 “An agenda for high economic and inclusive growth” Cielito Habito cited tax revenue (TR) and infrastructure investment (IFI) as key factors, among other concerns, vis-a-vis the gross domestic product (GDP) in achieving inclusive growth.
For an inclusive growth Habito required about 17% of GDP for tax revenue (Habito did not mention about IFI to GDP ratio but Malaysia and other developing countries allot 6% of their GDP for IFI). In 2010 our TR and IFI were about 12% and 1.8% of GDP, respectively. In 2014 it was about 14% and 3%, respectively. The government aims to achieve 14.5% and 4%, respectively, this year and more in 2016.

Senator Miriam Santiago backs the ombudsman in immediately implementing the preventive suspension order on Binay and on maintaining such suspension despite the TRO.
In Gobenciong versus Court of Appeals the Supreme Court ruled:
“The foregoing considered, the matters of the issuance by the CA of a TRO bearing on the implementation of the preventive suspension in question and Gobenciong’s unacted contempt motions have become moot and academic, for the preventive suspension had been served and the CA had, for all intents and purposes, denied the said motions.”

We may disparage Sen Santiago oftentimes because of her histrionics every time she speaks before the the media camera, but we must admit she knows the law, and seems so in this one.
She cited reasons why the two mayors want to to be mayor for six months — under-the-table money for a mayor and the politics of the 2016 election (for Makati Mayor).
Although implied in her citation of the Gobenciong versus Court of Appeals case at the SC — IMO, the equally important or important item is the tampering of records. Thus, even if the courts including the SC rule in favor of the Ombudsman, the delay in the effective implementation of the suspension order may have already achieved at the very least some tampering of the records. (The lawyers of Binay most probably know an unfavorable ruling, but the delay gave time for Binay to do the dirty work of tampering, IMO).

So to recap, there is settled jurisprudence that the CA 6th Division erred in even issuing a TRO because of the 2011 SC Samaniego case, and because the preventive suspension order was carried out before the TRO came out, the TRO itself and any contempt motions associated in not adhering to it are “moot and academic” according to the 2008 SC Gobenciong case. Given all these, why is the OMB still pussyfooting around and not issuing a warrant to arrest Binay for defying a lawful oder suspending him from office? It should also be immediately executory pending appeal and should relieve the deadlock in Makati.

Raissa, there is so much confusion and so many different supposedly expert opinions on whether the CA or the OMB should prevail on the latters order for suspending Mayor Binay. There seems enough analysis of relevant laws and Supreme Court cases here to lay out what the legal issues are and what the likely outcomes are. Maybe the timing is right for a piece that can clarify the current confusion in layman’s terms? There is a very good chance that the SC will be called to review the CA’s role in this matter, or perhaps the Binay camp may appeal to the SC if OMB gathers enough evidence to decide on Mayor Binay’s guilt. What do you think?

SCHOOL OF CHERRY PICKERS (SCP)
Seems to me the Senate Report and the MILF Report on Mamasapano are the handwork of authors who graduated from the world famous School of Cherry Pickers . IMO, the author of the Senate Report only has a Bachelor’s degree from SCP, whereas the author of the MILF Report has a PhD from SCP. In addition, the latter did not take an elementary subject on How to Make Sense.

Well the reports are slanted to reflect the specific agendas of the senators and the MILF. For the senators, and especially for Poe, its purpose are the two p’s: to pander to the public and to score ‘pogi’ points with next year’s looming elections. Not that the ‘look and feel’, content, and credibility was anywhere near the quality of the PNP BOI report. The MILF was even worse but its main intent apparently is to serve as a negotiating document and not as an objective tool to inform the MILF central committee what went wrong on their side and how things can be improved, not only to serve their interests, but for their supposed goal of peaceful semi-autonomy within the GRP.

i’m surprised they did not get an unbiased, independent third party to do a proper and thorough incident investigation for this. i don’t think anybody even analyzed the timelines of the testimonies. kahit yung “post-it” method lang sana, that would provide a clearer picture of liabilities and reveal gaps in the different versions of events.
for me, the senate report was insulting to the intelligence. it smacks of pandering and epal.

Can he deal with Mindanao problems? The MILF? BIFF? ABS? How about the CORRUPTION? Can he clip it to the minimal? Will trapos like him?
Who is the political party who will take me in? VP Binay? Di puede as the latter wants to run for P. VP wants MVP as his Vice P.
Is MVP charismatic in the sense people voters will know him and vote for him? How will it be done that MVP will get their votes?
If MVP did indeed run for P, can he convince the voters and many not to vote for VP Binay? Give the true reasons why? Suppose MVP fails to garner the seat, and VP Binay wins, what happens to MVP’s business empire? Will he be able to get it back and ran it smoothly again?
Is MVP really a good choice for P and not VP Binay for 2016? But we have to know this is not an assurance or guarantee if MVP is elected and will be a good P for the country. But people have to take that chance or gamble on it.
Once MVP is president, he is not into his business empire anymore. He becomes the highest elected public official. Will he be trust worthy? True to serve a clean and honest public service?
Will he be safe and sound as to his security as president? Qualifications wise MVP is more than qualified for P.
Why did Sen. Miriam endorse MVP? Will she take back this endorsement for some or any reason or reasons?
Who is any other as good as MVP in the field running for P? MVP is and never is a TRAPO.
Why did VP Binay think ahead to ask MVP to be his vice P in the next pres’l election?
Think. Yes, think. Are we thinking on this? Political parties? Voters need to think – WHO IS MVP. . .

MILF submits Mamasapano report
The report concluded that the retaliation of MILF’s Bangsamoro Islamic Armed Forces (BIAF) was justified as they were being fired upon by members of the Philippine National Police-Special Action Force (PNP-SAF) in Mamasapano, Maguindanao.
The report noted that the BIAF had to fire back as two of their men were killed on the spot during the assault of the SAF.
The MILF insisted that there is a liability on the part of the government troops for violating the ceasefire agreement.
The report further claimed that the SAF, particularly PO2 Christopher Lalan, committed human rights violations for killing four MILF men who were asleep and were in no position to defend themselves.

I like to share a short past, very short past history of Makati (city later)…
. . . a friend, much very senor, who when as a young man, used to GO FISHING in what is Ayala Avenue now. It was a vast SWAMP. He and his friends used some BANKA – small canoey, for this adventurous fishing.
Also, he said that during WWII there was an AIR STRIP for military use in Makati. Not knowing that history, I was a bit surprised. We were together in a DOJ prosecution office and OIC Binay was then the high officer administering that place.
Before EDSA 1, I did see him one early morning before 8.30 a.m. standing by the window at the City hall of another city, looking or staring into far beyond. His barong was brown faded. I asked one knowledgeable guy ‘Who’s he?’ The guy said ‘Atty. Binay.’ Another day, he was catapulted OIC of Makati.
Wow! Later elected mayor. How one’s fate can be changed suddenly and fast. Suddenly and fast furiously.
Meteoric talaga.
Tightly held onto being mayor. After that built a long DYNASTY in Makati. Now, VP of the Republic. Come June 2016, it will be another fate. This time might be ferocious, curious and obnoxious. Will luck or fate still be with him? I do not know.
