I have a confession to make. I have never watched any of the fights of Manny Pacquiao, although I consider him a great boxer. And I’ve seen clips of his fight.
I can’t bear watching a blood sport, I guess. The frenzy, the excitement and the violence transports me back to the Roman times of the gladiators. Which is why the place where they are fighting now is so aptly named – the Arena.
You know that there is always that possibility that one of them might end up seriously injured.
You know that being punched by Floyd Mayweather is like being hit by a truck at breakneck speed.
You know that they are mauling each other until only one man is left standing and the other too bloodied up and dazed to care for the crown.
And so I would rather watch the crowd watching the fight. And in this case, the crowd happens to be pretty much the entire nation. Except for me and a few others who feel like me or whose hearts are too weak to take the excitement.
I will be posting here, for posterity, some of my observations of what’s happening. And link it to how the fight could possibly affect the political climate in the Philippines.

I can follow the Pacquiao bout without watching the fight, just by listening to my neighbors erupt in screams and cheers. @Dave Tabaniag retweeted this photo from @BleacherReport
Pacquiao seems to have the upper hand right now. But my hubby Alan told me that Mayweather is a methodical fighter who plans his moves and fights defensively. He may be trying to tire his opponent before going in for the kill.

This morning I got a call from my sister all the way in Canada asking me if I was going to watch the Pacquiao fight live. I said I wasn’t. It turned out she was. She had shelled out around 100 Canadian dollars to follow the excitement.
She also told me that she heard a TV announcer say that Pacquiao had bought 900 tickets for the fight. that’s around US$1 million she said.
Well, I told her, Manny Pacquiao must have wanted to bring his own cheering squad to counter Floyd’s home court advantage. And he can afford to pay.
Come to think of it, that expense must be tax-deductible for Pacquiao.

If Manny Pacquiao wins, he’s a step closer to the presidency.
If he loses, he could still make a go of it.
I am looking at his presidential prospects in an impartial, analytical way.
His problem would be – how to make his money last long enough for a shot at the highest office. Because like billionaire ex-senator Manuel Villar, he may have a hard time soliciting campaign funds since the wealthy businessmen will say that Pacquiao has enough money to finance his campaign.

I am going into the last item, specifically, dabble into the mind of Poe
Assumptions:
– Let us give credit to Poe’s earlier statement regarding her needing more time to prepare for the Presidency
– Preparing for the Presidency after her short but productive stay at the Senate is best at the VP position
– Poe is assured of the Vice Presidency in 2016 if she is a candidate for that office
– Poe is an educated, intellingent, effectively articulate, fast-learning, manager, shrewd politician as manifested by her handling of the Purisima and Mamasapano Investigations
Given the tandem,
– Roxas-Poe
– XXX-Poe
– Binay-Poe
it is a no-brainer to me that the last option is discarded outright — why monumentally stain herself in her bid for the in-the-bag Vice Presidency. The question is between tandem options 1 and 2. The question is then not only the machinery to deliver her to the Vice Presidency (any machinery worth its salt will deliver her the position anyway), but which to her view has a GOOD-SOUNDING PLATFORM from which to start her bid. MEANING, continuing the good milestone programs of this admiinistration (there are certainly negatives, no doubt) and the concept of the daang matuwid (though stained in some ways, no doubt) compared to what the still unknown XXX-Poe tandem has to offer by way of platform. My bet is the Roxas-Poe tandem.
Question: What if Binay wins along with her winning the Vice Presidency. So what, she will not owe a centavo to Binay; and she will not be a lackey to Binay, who will likely be impeached during his Presidency.

That alleged leak from the OMB is very suspicious and seems like the disinformation and denials streaming out from the Binay propagandists and the Binays themselves. If the OMB office really wanted to clear up false news and confusing rumors that the Binays criminal investigation has submitted a resolution with probable guilt conclusion, an official clarification or denial by its spokesman or by Morales herself would have been the source instead of coming from anonymous officials. Using anonymous officials would just take away from the OMB’s credibiity and sow more confusion which is maybe what is intended. So far this is the only paper and the only article that has this ‘ news’ and you can bet in the last 24 hours everyone has been checking with their contacts inside the OMB for confirmation and additional details. Doesn’t it seem strange that Certeza even confirmed the original Inquirer article on the the resolution recommending an indictment by saying he had received a copy of it and would respond with a position paper? There is a possibility I could be wrong since philstar was fooled along with some smart cpmers but…I doubt it! Hehehe

From the official horse’s mouth herself, confirmation of the recommendation by the investigative panel to indict. This is definitely worth posting and not one from a spurious unnamed source that just confuses matters. Its worth reiterating what I previously posted in case others still do not get it. The special panel charged with the preliminary criminal investigation submitted its final report and recommends indicting and/or filing an impeachment complaint on both Binays. Their work is done; no furher investigation, preventive suspension or position paper from the Binay camp needed. This is all according to procedure as described previously. It is Morales however who decides and not the panel. Even the timing for the indictment decision is prescribed, a little over a couple of weeks. The decision as it relates to VP Binay may take longer as it involves constitutional issues on immunity and an impeachment complaint is full of political obstacles for it to be successful.

The procedures relating to arrest in a criminal case filed by the Ombudsman with the Sandiganbayan should be found in the Sandiganbayan website. It usually entails issuing a warrant of arrest after the judge has examined the resolution accompanying the criminal case filed by the Ombudsman. The judge reviews the judicial probable cause based on the resolutiion and accompanying nature and strength of the evidence to determine what type of arrest warrant to issue.The OMB does not itself issue the warrant but acts as prosecutor in major cases.

It is again a tribute to the diversity of talents in CPM that a report of significance such as this Carvajal report is shown to be false gold — a brass, especially as it puts the Ombudsman in a bad light. It is good that the Ombudsman clarified. It puts to shame the machination behind that report. (We did not hear any explanation from Carvajal or the Inquirer?)
It seems we will have more of this kind of report; it is the season for it — and plenty of mullah to spend on Mission Deception.

Please note that both reports of PDI’s Carvajal and Rappler’s Rufo were truthful enough insofar as the existence of “an Ombudsman Panel’s findings” is concerned. But there was, as a consequence, the tendency to mislead readers into thinking that the Ombudsman herself had resolved the issue of a probable cause to already file the “information” to the Sandiganbayan.
Incidentally, I believe @caliphman was referring to the report of Philstar’s Punong-Bayan.

To date there has been a lot of talk about his death but no proof whatsever.

The Bureau of Internal Revenue (BIR) yesterday hinted that religion doesn’t influence a person to be honest or law abiding.
BIR Commissioner Kim Henares admitted this as she is waiting for people’s champ Manny Pacquiao to honestly declare how much he would pay the Internal Revenue Service of the US so that the Philippines will charge him of approriate tax.
When The Daily Tribune said that Pacquiao must be honest because he is a Born Again Christian, Henares said, “That is a generalization. We are a Catholic nation but it does not follow.

It can be recalled that the BIR chief warned that the Philippines stands to get nothing from the people’s champ’s P5 billion prize from Floyd Mayweather bout due to a double taxation treaty with the US.
The treaty mandates that the country where the prize was obtained has the right to charge taxes. After the taxes was extracted, it is the turn of the country where the winner originates to charge taxes.

I think manny knew all there is to know about taxes. this is not the 1st time he has fought abroad, not the 1st time he has to file tax too, on money earned overseas. plus he must have lots of tax deductions like promoter’s fee, training fee, maybe travel to and from america is also tax deductable. all manny has to do is show official receipts to kim henares, proving that he has indeed paid tax in america. then, his tax payable to kim’s bir will be lot less, discounted yata.
local celebs like vice ganda, etc, who held concerts overseas and got money through ticket sales may also have to pay similar tax as manny, discounts and deductions included.
and those foreign celebs who have concerts here in our country and got money through ticket sales, may also be required to pay tax to bir as well.

Just a quick note to say that it appears that the the second OMB investigating the criminal case against the Binays in connection with the construction of that infamous city parking structure has concluded its preliminary investigation. Apparently there was no need for a preventive suspension being that they reached a belief of probable guilt by the Binays sufficient to indict at the Sandigangbayan. This is in contrast to the the administrative case where the separate panel investigations order for a preventive suspension against Mayor Binay are before the Supreme Court and where the process supports an OMB adjudication of guilt or innocence and a corresponding penalty.
The next steps to expect based on the Rules of Court 112 Section 3 and onwards is for the panel to submit its findings to Morales and for her to decide whether to move forward with filing an indictment with the Sandigangbayan and having a warrant of arrest issued against Mayor Binay and initiating an impeachment process with Congress.

I do not know what Certeza has been smoking but if he reads the Rules of Court sections 3 and 4 carefully, it is pretty clear that a response to the criminal and administrative complaints filed with the Ombudsman is before the investigating panel reaches a conclusion that the respondents; ie the Binays, should be indicted or an impeachment complaint filed. Nowhere in the Ombudsman’s process is there any mention of a position paper by the respondent allowing further counterarguments or rebuttals of the panel’s conclusion to indict conveyed in its resolution. As the Rappler points out, the counteraffidavits filed on behalf of VP Binay questioned the the disciplinary authority of the
Ombudsman over an official who is removable only through impeachment. That of Mayor Binay’s argued that the doctrine of condonation absolved the younger Binay of any liability arising from the complaints against him.
If a timetable of critical events subsequent to the investigation is of interest, the rules of court stipulates that within 10 days, an investigating judge (presumably from the Sandiganbayan) will review and confirm or not the conclusion of the panel and the evidence supporting it. If he concurs in the probable guilt conclusion, he submits a resolution with his conclusion to the Ombudsman within the 10 days. The panel also submits its resolution to the Ombudsman within 5 days who has 10 days to act on the resolution. Once the Sandiganbayan judge receives the resolution, he has 10 days to agree with resolution and issue an arrest order, in this case for Mayor Binay. In the case of his father the VP, a certified impeachment complaint.

Addendum: The latter action of course performed by the Ombudsman. As obsessed as some might be with the Pacquiao postfight legal melodrama, the looming indictment and arrest of Mayor Binay for non-condonable criminal complaints may be of more crucial national interest. Not to mention the possible the political and legal repercussions of an Ombudsman issuing an impeachment complaint against VP Binay that congress is reluctant to act on and is not brought to trial before the Sandiganbayan because VP immunity is granted in the 1973 although omitted in the current Constitution.
