Malaysia reacts to my interview with President Aquino

I’ve always suspected the Chinese read my blog – given what I’ve written about the West Philippine Sea. Yesterday I found out Malaysia was reading it as well.

Channel News Asia and Malaysian online newspaper newstraitstimes.com separately reported that on May 19 Malaysia’s foreign ministry summoned the Philippine Charge d’Affaires Medardo Macaraig to give him an earful over what President Benigno Aquino told me when I asked if he was dropping the Philippine claim to Sabah.

Aquino had replied he was not dropping the claim and I had reported his explanation word for word. You can read it in my blog post entitled “I will not drop Sabah claim, President Aquino told me.”

Malaysia huffily told Macaraig “its position that Malaysia does not recognise and will not entertain any claims by any party on Sabah”, Channel News Asia reported.

On 19 May 2015, the Ministry of Foreign Affairs of Malaysia summoned Mr. Medardo G. Macaraig, the Philippine Charge d’Affaires over the remarks made by His Excellency Benigno S. Aquino III, President of the Republic of the Philippines, on the Philippines’ claim on Sabah in an interview by Miss Raissa Robles on 15 May 2015.

The Government of Malaysia reiterates its position that Malaysia does not recognise and will not entertain any claims by any party on Sabah. Sabah is recognised by the United Nations (UN) and international community as part of Malaysia since 16 September 1963.

Sabah telah diiktiraf oleh Pertubuhan Bangsa-Bangsa Bersatu (PBB) dan masyarakat antarabangsa sebagai sebahagian dari Malaysia sejak 16 September 1963.

As I told President Aquino during my interview with him, this is not the time to take up the Sabah issue.

However, I would just like to share with my readers and commenters the raw copy of an article I had submitted to  South China Morning Post on the issue of Sabah on August 31, 2002, in the hope that this will contribute to the understanding of the issue. I don’t have a copy of the published and edited version.

This piece is highly  interesting because it has the Malaysian ambassador to Manila then admitting that the Malaysian government pays the Sultanate of Sulu a yearly rent of 5,000 ringgit.

I also recall –  although I did not write this into the story – that Ambassador Taufik told the Foreign Correspondents Association of the Philippines then that he had just personally delivered a check to the Sultanate’s family.

Here is my draft version of the story:

Sabah: the problem refuses to die

In the southern Philippine island of Bongao, Tawi-Tawi, host to thousands of Filipinos forcibly deported from Sabah, the Malaysian ringgit is as much legal tender as the peso.

It’s not that natives of Bongao feel their island is part of Malaysia. It’s because they, as well as thousands of Muslim residents in the adjoining islands, feel Sabah is really part of Muslim Mindanao.

“They go there to shop the way people in Manila go to the malls,” noted Congressman Jose Lozada, House foreign relations committee chairman.

Sabah is five hours away by speedboat from Bongao and 12 hours on a slow ferry.

Early this year, Malaysia’s finance ministry had paid the Royal Sultanate of Sulu in southern Philippines its yearly “rent” of 5,000 ringgit for Sabah, Malaysian ambassador to Manila Mohamed Taufik confirmed to South China Morning Post.

Later, Ambassador Taufik took great pains to stress that this was not rent but a “cession fee”.

And there lies the nagging problem over Sabah.

Sabah’s official website acknowledges that the territory was originally a thank you gift by Sultan Bolkiah of Brunei in 1658 to the Sultan of Sulu for helping put down an internal revolt.

Then the website claims that in 1877, the Sultan of Sulu concluded a “treaty…ceding large portions of territory” to Baron Von Overbeck, the Austrian consul in Hong Kong, and his British financial backers, Alfred and Edward Dent.

The Sultanate’s version is quite different and is borne out by the original document. It uses the word “padjak”, which Spanish, Dutch and American linguists have defined as an “arrendiamento” or a “lease”.

Although the Baron was granted “absolute authority” over residents of the “land beneath the wind” – since Sabah was shielded from storms – the agreement forbade the Baron from transferred his rights to another company or to a sovereign state without the Sultan’s permission.

When the United States “bought” the Philippines from Spain for US$20 million under the Treaty of Paris in 1898, Sabah was not part of the deal.

However, the US officially reminded Great Britain in 1906 and again in 1920 that Sabah did not belong to the Crown but to the Sultanate of Sulu.

When the US granted the Philippines independence in 1946, the country’s constitution asserted its claim for “all other areas which belong to the Philippines on the basis of historical rights or legal claims.”

Malaya became independent from British rule in 1957
but it was only in May 1961 that Malaya’s Prime Minister, Tunku Abdul Rahman, agreed to accept Singapore, another British-administered colony, into the federation on condition that other British colonies, including Sabah which was then known as North Borneo, be integrated too.

The Sultanate of Sulu formally asked the Philippine government to act on its behalf. President Diosdado Macapagal, father of incumbent President Gloria Macapagal-Arroyo, vehemently opposed the annexation and sent a delegation to London to formalize the claim.

Both sides agreed to allow the United Nations to conduct a referendum to determine the will of Sabah residents.

To this day, Philippine officials claim that referendum was rigged with the help of British authorities to favor Malaysia.

When Mrs Arroyo visited Malaysia this May, she did not take up the Sabah issue.

However, Mr Mahathir opened up the subject and suggested that Manila open a consulate in Sabah to take care of an estimated half a million Filipinos staying there with and without papers. In doing so, Manila would have effectively dropped its claim, Philippine ambassador to Kuala Lumpur, Jose Brillantes said.

Another ranking Philippine official disclosed: “She (Mrs Arroyo) proposed that this be taken up in another setting, which if you ask me, that showed our lack of preparation on the issue itself.”

        and by the way my son, since you and koring are both busy, how about giving me apo via surrogacy? koring cannot go through morning sickness, paglilihi, suka ng suka, ihi ng ihi lalo na sa 1st trimester dahil the damn fetus is kicking the bladder, having aches and pain, putting on weight with koring looking like balyena, her hormones haywiring and making her irritable. baka makalbo pa siya because of stress hormone like what some women go through during pregnancy. so think about surrogacy, my son.

    The opt in clause of the BBL seems to be giving the Senate some food for thought. And so it should.
    Where else in the World have 10% of the population been able to decide on behalf of the other 90%?
    Proof that the BBL was either drafted by the MILF or an idiot.
    And now it is claimed that 85 MILF commanders and their rebels do not like the BBL because it is not hard line Islamic enough.
    Please, the Filipino people, the Senate and the President wake up and understand that the MILF cannot be trusted.
    Perhaps NoyNoy can explain to the people why he is pushing for an agreement so filled with holes and which ignores the rights and needs of 90% of the population.

      It takes a petition by 10% to hold a plebiscite and 50% to “opt in”. This opportunity occurs the 5th and 10th year after the agreement is implemented. I agree it is a bad provision, and opens communities up to intimidation and extortion.

      I personally would prefer that the Muslim leadership work with the disgruntled among their citizens, rather than outsiders or police trying to bring them to order. To expect everyone to find happy agreement with the document is beyond reasonable, I think. Just as we outsiders have our complaints . . . which undoubtedly seem unreasonable to Moros.

      The purpose of the BBL is to establish peace so that investments can be made and an economy developed that will make that peace long-lasting. No better path has been proposed, that I have read. And I think the goal is worth the risks.

        What the 10% means is that the Muslims alone, in any adjacent region, can start the ball rolling on opt-in.
        In my opinion it is an open door to creeping Islamisation.
        I still can’t understand why the bill should be rushed. Does not the President want to get it right? What are his priorities?
        Most importantly what is the motivation behind the President’s support for a bill full of consitutional anomalies?
        I find his approach on this disappointing and most definitely think less of him now than before the BBL.

          If there’s an opt-in, there should also be an opt-out clause to balance things out.

          But I think it’s a bad provision unless they can really explain why it had to be there.

      The Sulu Archipelago comprising of the provinces of Basilan, Sulu and Tawi-Tawi may OPT OUT of Bangsamoro.

      Better if they could exercise their right to self-determination. Meaning that they be allowed not only to opt out of Bangsamoro but also opt out of the Republic of the Philippines. From day one the people of the Sulu Archipelago have not considered themselves Filipino. So let us help them form an independent state and, if possible, regain Sabah, and choose their own leaders by any civilized manner.

      right, hindi pa kasi panahong mangumpanya, kaya tahimik muna si mar. last presidential election in 2010, mar got the 2nd highest votes next to binay, and nearly pipped binay to the vice presidential post. mar was that close, marami siyang followers. and if his followers will mobilize again with renewed vigor in 2016 election, mar might just win the presidency.

    It is likely to take Mr Borschberg five to six days of continuous flight to reach his central Pacific destination.

    Ilang araw na ring pinaguusapan ng mga CPMers dito sa blog ang mga possible kandidatong pampanguluhan. Kung ang temperature heat index ay umaabot na ng 42 degrees Celsius, nagsisimula na ring kumulo ang electoral cauldron.

    Marapat lang siguro tingnan natin ang nangyarari sa Comelec with the appointment of Andy Bautista as Commissioner. He was PCGG chair before the appointment.

    In a radio interview at DZMM Sagot ko yan, he made mention of a hybrid process of election, manual at the precint level and electronic transmission to the canvassing (municipal, provincial, national).

    Perhaps our CPMers IT experts and electoral experts could give their views on this. It’s only a few months from now before candidates fole their COCs but they have yet to approve and bid out the mechanism/s to be used.

          there are two lines of araneta people. one line is araneta with the araneta university and this is the line of the araneta husband of marcos daughter. the other line is with the araneta center in cubao and this is the line that mar belongs to. the two lines are not related at all.
          much as i really like president obama and other self-made people who are leaders, in the case of self-made millionaire binay it is totally bad news. in the case of mar roxas. his not being self made like binay should not be taken against him especially if his record of public service is good. and since he is already economically affluent means to me that he will be more focused on making and leaving a legacy for which he will be respected, loved and remembered.

My sister being the executive assistant, mayordoma, alalay of one of the lady aranetas. They are not related to the Aranetas who owned the Araneta Colisuem which Judy belongs. The two Araneta clans, however, are both political enemies of Marcos. I still remember our boss fuming because one of the cousins will marry a Marcos. That was when I became aware that there are two Araneta clans in the country. One with Judy’s and the other is the family that owns Araneta University Foundation, FEATI University among others.           You are very right there on Mar Roxas’s side of the Araneta’s.

          Besides, Sec. Mar Roxas is doing excellent service to the country from the time he joined the government. I do not remember any news about the mother meddling in his political life. If she supports him, its natural – she is his mother and she has a great heart, It’s still a long way to election day and when he has filed his CoC and has resigned from his cabinet post and start campaigning, his ratings will definitely soar.

          Until CoC’s are filed, we do not really know who is in or out.
          For now, its STOP BINAY MOVEMENT.

          2: a candidate loaded with corruption, missing friends, (horse racing, cockfighting gambling addict), a wife loaded with scandals (and botox), al least 3 children loaded with money (like 68.000.000 (for having been a P.A. of candidate for 10 years), worms eating the foundation of the city they have under control ( the worms they use to eat the hidden skeletons maybe), a son who is so lazy he needs an elevator to go to the second floor (or maybe he can not walk the stairs because his pockets are to heavy with stolen money?_

          I go for candidate 1?

          I am still thinking to find a real reason to not vote nr 2…

    Grace is not entitled to a Philippine passport.

    The Philippine Passport Act of 1996 provides:

    “A passport, being a proclamation of the citizenship of a Filipino, is a document that is superior to all other official documents.” (Section 19)

    Instead of a passport, a travel document is issued to persons whose claim to Philippine citizenship is doubtful or who are stateless. (Section 13e)

    “If the applicant is an adopted person, the duly certified copy of court order of adoption, together with the original and amended birth certificates duly issued and authenticated by the Office of the Civil Registrar General shall be presented:” (Section 5g)

    In case of an adopted person like Grace, why is the original birth certificate necessary?

    It is because our laws provide that adoption does not grant citizenship. Meaning that the citizenship of Susan does not adhere or attach to Grace. So the original birth certificate of Grace is required because Grace must follow the citizenship of her biological parents, IF KNOWN.

    Accordingly, Grace must submit also to DFA her foundling certificate together with the amended birth certificate. But since Grace is a foundling, the citizenship of her real parents are unknown. Grace’ claim to Philippine citizenship is not only doubtful. She is in fact a stateless person. And she is not entitled to a Philippine passport. But she could be issued a travel document when necessary.

          I believe there is an object of permanence when the 1961 U.N. Convention Article 2 is enforced.

          Article 2 will confer a policy of implementing jus soli (the right of the soil) principle on foundlings. It differs from domestic law which dictates a jus sanguinis (the right of blood) principle.

          Article 12 par. 3 specifies to wait for some ‘matter’ to take place before Article 2 can be enforced.

          If you consider the international agreement a treaty then that ‘matter’ is “ratification” and, perhaps, also “concurrence” by the Senate due to its ‘permanent’ implication or impact on our nationality law.

          These steps may therefore be prerequisite/s. Absent such precondition/s, the U.N. Convention on the Reduction of Statelessness won’t apply.

          I am trying to fish a discussion from @caliphman inasmuch as he volunteered to write one in relation to Macalintal’s citation of the 1961 U.N. Convention as justification for stateless Grace Poe’s questionable citizenship (See #48 in the previous blog post).

      Atty @Rene… Few years back it’s easy to get a passport so was to produced birth certificate like late registration and others…. The 1st one who saw Grace in the church could have registered her already (simulated one) so as the Haciendera who was an avid fan of Susan prior to the adoption of the POEs…Or maybe in some of Grace birth certificate especially the 1st one had stated the TRUE parents of POE….may kaibgan kalang KOMADRONA ( mga nagpapaanak sa mga Barrio’s )who will sign your birth certification , attested by the Barngay Captain and thas it , you will have one….EARLIER all of these possibilities Grace doesnt know it …let us compute @atty RENE ….I AGREE with you that from the time Grace was found in the church up to the her adoption by the POEs there must be other birth certificate and it could not be only one…..Susan must be hiding something if she knows but just ro protect their Sonora’s reputation but to accused GRACE of lying , i dont think so….amd if EVER there are really more TRUTH to come out about GRACE,,,it will be a conclusive positive responses FAVORING GRACE and i think if she will be a candidate to VP or P to whatever political parties she will be…MANANALO sya even to a point na KAPATID nya si BONG BONG they will vote for HER and not Binay or Roxas or anybody else….

        Sa totoo lang ang pakiwari ko ay panalo si Grace kung lalabas na anak siya ni Marcos. Panalangin ko lang ay sundan niya ang ugali at panuntunan nina FPJ at Susan para panalo rin tayo. Kaya lang sa ipinakikita niya ngayon ay Malabo. Tingnan mo yung ginawa niya kay Purisima at pananahimik tungkol kay Binay. Pinahamak pa si PNoy sa Mamasapano. Biased siya against Napenas. Palagay ko drama lang ngayon yung kay Binay.

        Subalit wala tayong magagawa kung aminin niya lahat tungkol sa pagkatao niya at patuloy na iboto ng mga tao.

        Kung maging presidente si Grace, ililibing na ba si Marcos sa libingan ng mga bayani? Kaya ba niya si Imelda? Tanong nga sa kanya ni Osmeña ay “kaya mo ba?”

          @Rene-Ipil, masyadong complicated ang citizenship issue although you were able to articulate it. It looks like an overkill to me because if that case could be established, she may not even qualify for a seat in the Senate. Come to think of it, her inaction or belated knee jerk reaction in some ways (Binay) or somewhat myopic stand on the Purisima and Mamasapano probes did not measure well to some people’s yardstick but they are only unpopular not illegal, let alone border or hover into the realm of impropriety. Sa tingin ko mas maiintidihan ng marami yung lack of residency requirements kasi isa sa mga basehan, for one, ay yung mismong COC na file nya when she ran for Senator.

          Trillanes is right when he went after Binay the moment the latter announced his intention to run. The standard and level of scrutiny changes. It cannot be the same as when one is running for a senate or house seat.

          Let’s see what the Binay camp will do to counter the “damage” done by Grace to her ninong. If they see that this citizenship or residency issue is worth to be used as the bullet to “kill” her, the Binay camp will exploit the issue or any other issues they could use against Grace. Knowing the Binays, they would resort to any tactic to save their skin by ruining their adversaries. Otherwise, I am inclined to believe that these are all drama. Mere verbal exchanges between them only benefit Grace more and increase her chances for the P in 2016

    As I mentioned earlier, I joined the discussion on Grace Poe solely as an intellectual exercise with no intent to either support or oppose her potential candidacy, as I remain neutral on her. It just so happened that the discussion centered on her citizenship and residency.

    To put it into a level playing field as far as the discussion on Grace Poe is concerned, I’m posting here her side of the story which seems to have not gotten into the mainstream media. The event was the Bulong Pulungan Media Forum. Here is part of the official transcript of Sen. Grace Poe’s interview, published on March 18, 2014:

    Q: How long were you in the States and what did you take up in Boston University?

    Poe: I took up Political Science. I lived in the States for about 12 years.

    Q: What state?

    Poe: Virginia, but I studied in Massachusetts in Boston

    Q: What was your status there? Immigrant?

    Poe: My husband is a dual citizen so he is a US citizen then. I was an immigrant to the US. So I tell you this so that it will finally resolve the issue, then I became a US citizen, and a dual citizen at that but when I took the role as the MTRCB chair, I had to renounce it because I am a government official and when I did so, I had to go to the US Embassy and they didn’t want to revoke my citizenship. They were saying, don’t worry, your job is not really…in short the MTRCB for them is just like a secretary level, not policy. So they said that I should go ahead and keep it but I said, No. I can get in trouble with the law so I had to give it up. So it was perfect, so when I ran for the Senate I had to present to the COMELEC all of these documents. My renunciation etcetera.

    Q: Why did you choose politics instead of showbiz?

    Poe: Because I don’t have the face for showbiz? (laughs) I was more interested in social issues and process. My parents had that exposure but they felt frustrated because they couldn’t really do much, in government you can do more.

          baka hindi pwedeng sabihin king sino talaga yong ‘couple’ dahil gay yata o kaya lesbians sila, he, he, he. the foundling story gets better with age: the church becomes jaro cathedral. tapos, yong pahayagan where the announcement was made about a foundling, that particular pahayagan is still anonymous and could not be named. state secret yata ang pangalan ng pahayagan and not accessible to the public. kindly tell which pahayagan, grace, and does it exist?

          considering na hindi maitim, at masyadong maputi ang balat ng foundling na si grace at medyo mestasahin pa, palagay ko marami at pila-pila ang kukupkop nyan. the ‘couple’ mentioned would have to fight their way in just to get their hands on baby grace.

          and to say that a foundling was left at church and that no one came to claim the foundling is hard for me to believe. we often hear people brazenly going to maternity wards in hospitals just to steal babies. even baby sitters cannot be trusted dahil they have been known to steal babies and selling them.

        Medyo malabo yung sagot ni Grace sa tanong, parang iwas pusoy siya.

        The way I interpret her answer, she was saying that his husband was a US citizen, then he become a dual-citizen also. (He is probably still a dual citizen because I did not find any repatriation record of him, only that of Grace.)

        Grace was also saying in her answer that she immigrated to the US, probably based on her husband’s petition who was then a US citizen. Grace became a US citizen, then became a dual-citizen, then she renounced her US citizenship, and is now back to being just a Filipino citizen. The records seem to support this sequence of events.

        When Grace became a dual Filipino-US citizen, it validated or legally confirmed that she is a natural-born citizen because under our law only natural-born citizens can acquire dual citizenship (without undergoing a naturalization process.) So far, so good for Grace.

        Rene-Ipil questions the validity of Grace being a natural-born Filipino citizen because she was a foundling, arguing that it was a mistake for her to be granted a natural-born citizen status because of her being a foundling. Rene also pointed out that when Grace ran for the senate she indicated on her COC that her residency is 6.5 years which would make her residency 9.5 years only by the time of next year’s presidential election, making her disqualified as a potential candidate because she would be short of the 10-year residency requirement.

        I defended Grace on these two issues: Firstly, I argued that Grace currently has a legal natural-born citizen status by virtue of her being granted a dual-citizenship and by her being qualified to serve as a senator. The burden of proof is on the person who would question her being a natural-born citizen, and that would be a very tall order. Secondly, I also argue that the 6.5 years residency Grace shown in her COC can be explained or rectified in many ways so that should not really be a big hurdle should she decide to run for P or VP.

        On the negative side, I pointed out that based on Grace’s repatriation record, and back-tracking the dates or events, she was most likely still a US citizen when she accepted her appointment as chair of MTRCB, and only gave up her US citizenship officially before she ran for the senate.

        The transcript of her interview seems to validate my finding. Grace was saying that when she accepted her appointment she renounced her US citizenship (before a Philippine government official) but when she went to the US Embassy (she had to renounce it twice – before a Philippine and before a US government officials) she said that the US official did not want her to revoke her US citizenship because the MTRCB position “is just like a secretary level, not policy” level.

        Grace explanation is suspect at best. It would appear that a foreign (US) official was interpreting a Philippine law for her, and that the official was unwilling to take her renouncement in spite of the fact that she already made the same act before a Philippine official. It sounds like a “palusot” to me.

        As I said before, I’m neutral on Grace. I will both defend and criticize her based on my evaluation of the information before me, pursuant to our goal of seeking the truth regardless of political affiliation. I’m also neutral on Roxas, so if anyone has any issue with Roxas I will both defend and criticize him depending on the circumstances. I’m only biased against Binay and Marcos – on all others, I take a neutral position.

Its one thing to post personal opinions here and another to misrepresent unsupported speculation as fact. I do not hold myself out as the final arbiter of faulty speculation but when I repeatedly find errors in the facts or logic of accusations by a chorus of cpmers here, I am compelled to speak out.

    Binay wanted to be the Lee kuan Yew of Makati.

    Binay did not say that. It was Lee Kuan Yew. Maybe they were both feared and admired by their respective constituents. Binay is a lawyer like Lee Kuan Yew. But he similarities end there. While Binay is corrupt to the bones, Lee kuan Yew was the epitomè of integrity.

    So the right formula if we want to emulate Singapore is to have a leader who is both feared and admired, and most importantly honest.

    And I could think of ONLY one man in our midst. I would vote for a president who could minimize, if not eradicate, the drug menace in our country. For that reason alone. Moreso if my president could ensure peace and quiet in Metro Manila and the archipelago. For peace and order is the condition sine qua non for economic prosperity.

    We are now in a dire economic situation and rampant lawlessness which need radical solution. And I now return to my previous post. Only DUTERTE could fill that need.

    I disagree vehemently that BINAY is the Lee kuan Yew of Makati. But I do agree absolutely that DUTERTE is the Lee Kuan Yew of Davao City.

    BTW Davao City comprises of about 244,000 hectares of land. Singapore has about 71,000 hectares. And Makati City has about 2,000 hectares. Davao City is the ninth safest city in the world. Singapore is fourth.

    I don’t know Duterte personally. Any CPMer or any body who knows him personally should educate us some more about him. Good or bad.
