The recent hearing of the Arbitral Tribunal was supposed to be closed to the public.
“However,” according to an official press release from the Permanent Court of Arbitration in The Hague dated July 13, “after receiving written requests from interested States, and having sought the views of the Parties, the Arbitral Tribunal permitted the Governments of Malaysia, the Republic of Indonesia, the Socialist Republic of Viet Nam, the Kingdom of Thailand and Japan, to send small delegations to attend the hearing as observers.”

An international relations expert whom I asked about this and who declined to be identified, described the presence of representatives from the four countries as “unusual.”
“Because if hearings are not open to the public, representatives of other countries theoretically should not be allowed. Since the countries made a request to the tribunal, the tribunal consulted the Philippines and the Philippines agreed,” the expert said.
My source pointed out that except for Thailand, the other three observer countries also have overlapping claims with China. Malaysia and Vietnam have claims to an extended continental shelf, which in 2009 had prompted China to send a memorandum to the Secretary General of the United Nations that contained for the first time the nine-dash line.
“But we should be looking closely at Japan’s maritime dispute with China,” the expert also said.
What caught my source’s attention, though, was the excessively large delegation sent by the Philippine government. Local newspapers said they numbered around 35 in all. But the official press release issued by the Tribunal said:
“The Philippines’ delegation comprised some sixty attendees, including the Solicitor General as Agent for the Philippines, the Secretary of Foreign Affairs, the Secretary of Justice, the Secretary of National Defense, members of the Supreme Court, members of the House of Representatives, Ambassadors, government lawyers, officials, legal counsel, advisors and technical experts and assistants.”
Justice Secretary Leila de Lima said that for her, it was like taking a crash course on international law. Her choice of words are unfortunate: it gives the impression she’s doing this using the people’s money.

International law expert Harry Roque pointed out that the presence of such a large number was really not necessary to argue the Philippine case before the tribunal. Strictly speaking, he’s right. (And by the way, he is not the expert I’m quoting here.) Because if you look at the press release, only four people were allowed to speak before the Tribunal: Foreign Secretary Albert del Rosario, Solicitor General Florin Hilbay, counsel for the Philippines Paul Reichler and Professor Philippe Sands.
Should we be angry at government spending the people’s money this way?
From the legal standpoint, their presence was wasteful since they were not necessary for arguing the Philippine case. My source said the Philippines could have made do with a much smaller delegation consisting of senior Philippine government officials, the international counsel and their staff.

However, I can also understand why the government sent such a large delegation. It was meant for propaganda effect, to show that the case has the backing of the three branches of government.
The large crowd was intended to fill the room in the same manner that Philippine boxer Manny Pacquiao flies a planeload of supporters to watch his boxing matches and cheer him on.
If the Philippines wins the case, government can claim the cost was worth it. But if it loses the case, there will be an outcry over the expense.
Personally, I wish the government had sent a smaller delegation befitting a third world country. But I cannot close my eyes to the propaganda value of showing a tribunal hearing the case in a roomful of Filipinos.
I just hope the delegates were not billeted in plush five-star hotels. And that they flew straight home after the event.

Her statement to the American Ambassador suggesting a change in foreign policy, plus her connections with the Chinese business community, plus a bit of deduction that has weak ground, and which we can call it intuition. Of course, she can prove this wrong by simply stating that she will continue the Aquino policy of carrying through the arbitration case to conclusion, multilateral negotiation as an alternative, backed up by EDCA.

One is allowed to speculate here, Joe. That is what intuition is. But it is usually good journalism and just plain fairness to label such an accusation as opinion and not fact. Now as to Marcos and Binay, I do agree they have that position. And it’s not necessary to whip up Filipino hatred of the Chinese by asking questions of Poe’s racial ethnicity in an attempt to cast aspersions about her patriotism . As as American who is just a guest in this country and with the US record on slavery and betraying the General Aguinaldo in Manila, it is hardly fitting for you to be making this sort of statements.

Yes, I wasn’t really there at the time. Besides my comment had nothing to do with Poe’s racial heritage, which is irrelevant, but with her allegiances . . . as Yvonne correctly read, with the information she provided below. I have written two blogs defending Poe against “parentage” issues, saying she should be measured only by her deeds, not by such trivial matters. Race is a trivial matter. However, it is a DEED if Poe supports bilateral agreement with China and the ceding of Philippine territory to China because businessmen with interests in China funded her campaign.
The idea that I should not bring this concern forward is ludicrous. I mean, what’s the fear all about?

Of course we should all be concerned, Joe. BB Marcos is an idiot, but I believe he is so brainless, he really believes bilateral talks is the way to go. Binay on the other hand is quite clever and greedy. He will say anything if it advances his candidacy or makes him richer. Poe, we know little about her views on this issue but happily we get a chance to look at her platforms on major national issues she declared she was putting together if she decides to run for the presidency.
You seem very supportive of Pinoy. He seems to trust Poe to consider anointing her as his chosen presidential candidate. Why not hold off demonizing her until we really know what her positions are?

Because it is important to put hard issues on the table for hard debate. The campaign has started, no matter what COMELEC says, at least the popularity hyping part, the sneaky, non-transparent part. I find it more interesting that anybody at any time would try to suppress discussion of hard issues that define what a candidate will actually do.
I have the greatest respect for Mr. Aquino. He and his staff are a part of the audience I try to reach and I have no interest in burying anything that is crucially important. This topic will be the subject of my Sunday eve blog, and I thank CPMers for helping me crystallize my thinking.

I wonder if those advocating for bilateral talk with China can guarantee that China will agree with Philippines position on its EEZ in a bilateral talk. There was already an instance of bilateral talk that took place in Scarborough when there was a standoff. It did not seem to work.

That’s why it is such an important question. The Philippine argument at the arbitration tribunal recounted the history of bilateral negotiations, all failed, because the starting point for China is Chinese sovereignty, even for contested properties withing the Philippine EEZ. That is known as a “non-starter” in negotiating terms. Or deal killer.
So those willing to talk bilaterally are willing to dismiss this argument, undermining the whole case, and accept Chinese sovereignty of properties in Philippine economic territory.
To me, that is a non-starter, or candidate killer. Senator Poe needs to make herself clear, I think.

A pause to digest that: For the Philippines, it is clear that China is taking the country for a fool. The Philippines reasons thus — it is as if China says I have sovereignty or ownership over this whole cake; now let us negotiate on the sharing of this cake.
MINOR PREMISE 1: One who negotiates under the stipulation insisted on by China is not only irrational and unpatriotic but is a fool.

My concern is starting to build to significant proportions, because this is like the US, when the Koch brothers are supporting a US candidate, we can expect that candidate to back the Canada to Mexico oil pipeline.
When rich people with their riches tied to friendly commercial relationships to China give to a Filipino candidate, we can expect that candidate will favor bilateral negotiations with China, and the ceding of Philippine sea rights to China, and the abandonment of the multilateral negotiations . . . that is, the abandonment of hard-build alliances with neighboring states.
I believe Ms. Poe has a vulnerability other than no experience, and a wise opponent will call her out on it early in the campaign. It can’t be Binay doing the calling out, because he, too, would gift Philippine territory to China for personal gain.

The dual citizenship law or RA 9225 was enacted in 2003. So that when Grace Poe renounced her US citizenship in 2010 before Philippine authorities, most if not all people assumed that she had been a dual citizen. That was a WRONG assumption.
Sometime in the last week of May 2013 – repeat 2013 – Anne Binay-Alcantara posted in Instagram a picture of Grace Poe with Anne’s family taken in the vicinity of Hollywood East and Buena Vista Streets, Anaheim, LA. The same Instagram photo was marked with “Nice to see you Senator Grace!!…”
Meaning that at the time (2013) she was using still a US passport to travel because available records show that Grace Poe was issued her Philippine passport only on May 16, 2014. So that many people including legal luminaries were wrong in assuming that Grace Poe had been a dual citizen before her appointment as MTCRB chairman in 2010. They were wrong also in assuming that Grace Poe was a Philippine citizen during the May 13, 2013 senatorial elections because she had already renounced her US Citizenship.
Due to the issuance of a Philippine passport on May 16, 2014, we could assume now that she had reacquired her Philippine citizenship on or before such date in accordance with RA 9225. This is only a presumption which could be rebutted by evidence that Grace Poe was issued a Philippine passport through “magic” or without taking that oath of allegiance accordingly required by RA 9225. But the fact remains that she used a US passport in her travel to US in 2013 due to the belated issuance of her Philippine passport in 2014.
Indeed, Grace said that she reacquired Philippine citizenship by merely renouncing her US citizenship. Meaning that here was no proper oath of allegiance before the consular or immigration officials. This was what she said in an interview with GMA News:
“To revert back to Filipino citizenship, ire-renounce mo lang yung US citizenship mo. Yun lang ang ginawa ko. Yun kasi ang condition ng Dual Citizenship Law. Hindi iyon to reacquire Philippine citizenship kasi it reverts back to that automatically.”
The SC ruled that the renunciation of foreign citizenship and taking the oath of allegiance for purposes of election or appointment to public office is NOT compliant with RA 9225. And that such acts do not result to reacquisition of Philippine citizenship.
Meaning again that Grace Poe has only two options in regard to the 2016 presidential elections. First, run as VP of Roxas. Second, stay as senator.
Oh, there is the third choice. Resign as senator and campaign for Binay or Erap. Not to mention the possible criminal prosecution for perjury.

I have a Magician friend, a friend too, of JoeAm’s bookie, Sal. Now this friend of mine — a good magician but a braggart, especially when he has more than enough beer in him, claiming to be a consultant to a consultant of DFA — has produced documents associated with the following narration:
– Shortly before May 2004, but after the enactment of RA 9225 of the Philippine Dual Citizenship Law in 2003, GP applied for and was granted Dual Citizenship;
– As a result of which, GP applied for and got a PH passport in May 2004;
– Shortly before the 5-year validity period of that passport, she applied for renewal, and so got a renewed passport in May 2009 (mind you this was before the appointment to MTRCB);
– Again, before the 5-year validity period of this recent passport lapsed, GP again applied for renewal; and so, it came to past that she got a renewed PH passport on May 16, 2014.
I am amazed that my Magician friend was able to square away these facts: the application for DC after RA 9225 enactment, the 5-year validity period of PH passports, and Rene-Ipil’s very solid fact about the May 16, 2014 issuance of a PH passport to GP. When my Magician friend narrated these events and showed me the documents, he was sober — hadn’t touch a bottle of beer for a week
So, I cannot but help write —

Maybe your magician friend forgot that the list of dual citizens starting in 2003 had been distributed to several outlets including NAIA, TEZA, media and other interested groups like the US government and others. That Poe had not paid a single cent for travel tax because she had been a US permanent resident until she officially renounced her US citizenship. That every time Poe departs from NAIA her name would be checked in that list for payment of or exemption from travel tax. Worse, your magician friend could bring PNoy down with him for falsification of public document.

I think the sacrifice comment was misread, much as the famous Tacloban conversation was presented out of context. His point was “I should not be asked that question (about sacrifice). I’ve already shown I can sacrifice.”
If there was another conversation where he flat-out said “I am ready to make the sacrifice again”, I’d love to have a reference link to the comment.

I thought what Mar meant was that as you said, he should not be asked about that sacrifice question because he has already shown he can sacrifice. If a new survey will come out in a few days, Mar’s rating will again suffer because of that statement. The respondents will exclude Mar from their choices in the belief that Mar already gave way to Poe and won’t be running for the presidency as the news made it appear to be. Poor Mar. But I am sure once Pnoy declares his endorsement as LP standard bearer, Mar’s rating will climb up slowly but surely. In 2016, it will be His Excellency, President Manuel Roxas III. :)

Mar uses ‘we’ but actually I understand it as ‘I’ [am capable of sacrificing] x x x of giving way x x x [like he gave way to PNoy before] x x x for the sake of the bigger objective x x x [he’s the only one that can be referred to – TO MAKE WAY for a bigger objective; not Grace Poe, not PNoy nor Chiz.

I think Roxas meant to sacrifice his friendship with PNoy and some LP allies if PNoy chose Poe or Escudero over him just because of the survey results. That Roxas and his LP supporters are ready to leave LP and PNoy to support a coalition party (CP) of LP Roxas faction, NP, NPC and PDP-LABAN. That Roxas and company would support whoever is the CP standard bearer including Cayetano, Trillanes, Marcos, Duterte, Lacson, Pimentel, etc.

I hate to break the news to CPM’s diehard Roxas supporters but it looks very unlikely now that Poe will be willing to slide down as his VP candidate in 2016. Moreover, my take of the situation is Pinoy will be meeting Drilon and Belmonte who are split between favoring Roxas and Belmonte respectively to finalize who to announce at the SONA in view of Poe’s continued refusal. Clearly, Pinoy is leaning towards Poe because if he was supporting Roxas, both Drilon and him would have announced Mar a while back.
The only viable options now is for Mar to slide back or announce his retirement and anoint Poe/Escudero or in his place an LP party member like Robledo. Staying with Roxas is party suicide for the LP as most pollsters including the private ones that Pinoy uses generally agree that party machinery and sponsorship are not significant factors in presidential elecions. I tend to agree, unless massive cheating and manipulation of results ala Garci are used to further Daang Matuwid. That woulld be unbridled hypocrisy if that happens.

@Caliphman, something just doesn’t add up there. If as you say that Poe is not willing to slide down, what is the point of insisting that she has not made up her mind yet whether to run or not? Roxas has neither confirmed nor denied that he is running but he did indicate that he is flexible and has a record as such. The contrast between the two is quite glaring and a no-brainer IMO. You can clearly who is more mature, sincere and selfless. Mar seems focused on the mission for the greater good. Poe looks like a battle tactician.

Sorry, but reading from vyonne’s #s 14 & 14.1, there is this knocking nuisance I noticed before on Grace Poe’s answers to Raissa’s question received last June 10, 2015 about Poe’s citizenship. Her answers:
1. ‘Ako po ay sumumpa doon renouncing–October 2010. Ngayon tungkol dun sa US, nirelease po nila ang aking renunciation 2012.’
Renounced it October 2010. US released such renounciation (or the acceptance of such renouncing of her citizenship 2012. Poe uses the reason due to the ‘long processing.’
But US ‘processing’ is part of their US laws and one is obligated to respect such long processing for the renounciation to be officially effective. So, following that argument,
Poe’s renounciation of US citizenship was officially done ‘in Year 2012.’ Not in October 2010.
Let us ask this: (A) Would Philippine laws on renouncing foreign citizenship be dependable on Philippine laws and not on the laws also of the foreign country – like USA, for purposes of duly recognizing that the renounciation of US citizenship is effectively done? Or it is enough, by Philippine laws to ‘unilaterally’ make the renounciation effectively already as according to Philippine laws disregarding what the US laws says that one is still a US citizen?
Raissa repeats her question. And Grace Poe answered:
‘ . . . kailangan kong balikan ano, pero parang 2011, kalagitnaan.’ Poe added: ‘Bakit?’
And Poe said: ‘Sapagkat sa Batas [she is referring to Philippine laws], complied na ako just by a public officer na Pilipino.’
Is Poe correct? (B) She uses the word ‘complied’ to conclude it was done [like a lawyer but she is not.] Again, on the (A) discussion above, can Poe a US citizen ignore US laws including the US processing of one’s renouncing US citizenship? Isn’t she obligated to honor such laws also before saying ‘complied na ako’?
Note also: Is it alright for Philippine laws as maybe interpreted by our court agencies that ‘complying’ only with Philippine laws to renounce a foreign citizenship, like a US citizenship status, not to follow and ask also whether US laws including it’s processing method has been fully complied with before publishing the renounced foreign US citizenship? If the first answer is ‘Yes’ it is alright, aren’t Philippine laws disregarding US laws that obligated a former Filipino citizen to honor and follow such US laws?
If the answer is ‘No,’ why would it be so? Is it because in the particular case of Grace Poe, she had ‘dual citizenships’: Filipino and US, and Poe is duty bound to follow each laws – US and Philippine laws, in renouncing the former for the latter. This situation is intertwind, so to say. One cannot inexcusably believe that one law was followed and the other law was not. That is not correct. Both laws must be ‘complied’ one after the other becomes effective.
It may not be so crucial having been appointed to the MTRCB office for all of the above discussion. But it becomes crucial or important when she filed her CoC as candidate for Senator which requires ‘. . . and a resident of the Philippines for not less than two years immediately preceding the day of the election.
Two years residency for Senator before the day of election. If it is correct to say that the renounciation of Poe’s US citizenship became effective only sometime in Year 2012, per US laws and it’s long processing method for approving her renounciation, then did Grace Poe have that ‘two years residency’?
In the same manner and question immediately preceding, if Poe aspires for either VP or President, will she have such required 10 years residency for such either such offices?
There is no case law I have yet seen that ruled that a person with dual citizenship like Grace Poe’s situation, where our courts have said it is not necessary to await for the US laws to effectively say that a US citizen has per renunciation of US citizenship has complied fully to such US laws for validity purposes, meaning: Philippine courts or laws can disregard such awaiting the US process and disregard the US foreign laws on that and consider one a Filipino citizen already.
This discussion is about Grace Poe’s ‘residency’ status for her being an elected Senator and for any other higher office(s) at that. If I have erred on bringing anew this or just wasted your time, I am so sorry. Please disregard awaiting my further explanation.

You posted here not too long ago that it is confusing enough to understand and adhere to the maze of Philippine laws without the latter requiring one to grasp and be subject to US laws at the same time. Mercifully,our laws on renunciation of foreign citizenships are clear enough and only require the oath of renunciation sworn before an authorized Philippine official. As Chief Justice Panganiban has explained, continued use of a passport or US events not under our control may call into question the sincerity of the previous renunciation, but an acceptable explanation and retaking the oath would reconfirm eligibility.

i am not a lawyer but common sense tells me, under philippine laws grace poe technically renounced her us citizenship on the earlier date. grace poe has to satisfy the philippine requirement of renounciation and she did under philippine law. so to make sure her former country gets her wishes not to be a us citizen any longer she put this officially with the us gov’t so as to satisfy us laws. and the later date is when grace becomes officially a non-us citizen under us laws. will the philippine gov’t (justice system) follow us laws or philippine laws. my opinion is naturally philippine law takes precedence over the us law here in the philippines because it is to be effected in the philippines, if it was to be effected in the us (like paying taxes) us laws apply.
for purposes of candidacy, did grace poe comply with the law, i believe she did and her true intention to be a non-us citizen got further manifested with her officially doing it also with the us gov but because of the process it was not officially recognized by her former country till the later date.
under us law, same sex marriage is legal. will philippine gov also recognize same sex marriage. same with divorce, two filipinos can divorce in the us and remain divorce as long as they stay in the us and they are free to remarry. when one returns to the philippines, can this divorcee. freely remarries under philippine laws.
bottomline, philippine laws are for philippine jurisdiction (within the boundaries of the philippines). other countries will honor it in their own jurisdiction if it is within their nation interest.
with grace poe’s citizenship issue, it is per individual interest…like my personal interest in Mar Roxas to be the next president to continue TUWID NA DAAN and not to have BALIKTUWAD NA DAAN. God is Great.

It appears that I was wrong because no document shows that Grace Poe took an OATH OF ALLEGIANCE before any Philippine consular or immigration official to reacquire Philippine citizenship. Meaning that she had been residing in the Philippines as an ALIEN before she officially renounced her US citizenship in 2012. After such renunciation Grace Poe became STATELESS due to her failure to reacquire Philippine citizenship in accordance with RA 9225.

Do we really have to know that much on Grace Poe? I am sure it was a legitimate business in US; she was the CEO on that; employed 10 people and gross earning, let’s say $500,000/year. What was the business about? Maybe Travel Tours Office?
Well, for transparency disclosures are okay. I think Poe will reveal all these once she is officially a candidate – if it happens. So far, Mar Roxas ako pa rin. he he – – if also.

Oh, they were just trivia questions geared toward getting to know more about Grace Poe especially because she lived outside of the country for many years, and people lost track of her until she becomes a senator.

From what you are implying, Grace Poe has not been forthright in her business dealings while in the US. I have searched the internet here, and it only talks of the FPJ Productions as the possible family business venture she handled, but it’s based on the Philippines not on the US.
Unless…. a “trust fund” can be considered a family business….

In my search for an answer which I failed, I found that Grace Poe was somewhere in the vicinity of Hollywood East and Buena Vista Streets, Anaheim, LA sometime ago. She had a picture taken with the family of Anne Binay-Alcantara and posted in Instagram 110 weeks ago or sometime in the last week of 2013, repeat 2013, where she was tagged as Senator Grace.
