I told DZRH radio why Vice-President Binay owes the Marcoses big time

This morning even before I had my coffee, I had a chat with one of the country’s veteran radio broadcasters, Mr. Niel Ocampo of DZRH radio.

It was the first time in a very long time that I had chatted with Niel, who knows the ins and outs of Philippine politics.

He wanted to ask  me about a piece I wrote four years ago entitled Did VP Jojo Binay mislead PNoy on the Marcos burial issue? 

Ordinarily, I would not have agreed to be interviewed that early but this was Niel, a colleague in the trenches. We used to bounce around  gossip and analysis to while away the time in between hearings and sessions at the Senate when we were beat reporters there.

DZRH very kindly sent me an audio clip of the interview.

    According to Jonathan Defensor de Luzuriaga, president of the Philippine Software Industry Association, their $15.5 billion industry may be “the next OFW phenomenon” if its current trajectory continues on its path.

    The business process outsourcing industry as a whole is targeting $25 billion in revenues next year to be at par with remittances. Last year, total OFW remittances hit $24.3 billion. The industry association IT-Business Process Outsourcing Association of the Philippines is currently working on its post-2016 roadmap.

    Mahusay talaga itong si P-noy. Maski may “prompter” sya sa mga speeches nya ang dating palagi ay parang “extemporaneous” at malaki ang audience presence at malakas ang epekto ng “jokes” nya. Sa init ng kampanya malaking “resource” yan. Kumpara nyo sa mumbling ni Binay at ma bi BiGo and kanyang kampanya.

        leona, GMA NEWS reports that as of noon, at least 10 presidential aspirants have filed their COCs, carrying with them the motherhood promise to help the country beat the odds it faces. Among them is 38-year-old Sel Hope Kang, the lone female aspirant so far, who got emotional when she took the podium and stood before the press.

    Atty. Frank Lobrigo wrote IMO the most plausible explanation on GPL’s citizenship. He is puzzled why a child of a known Filipino mother under the 1935 constitution is discriminated against a “foundling” like GPL. Meaning that under GPL’s theory she would be NBFC because she is a foundling. But a child of a known Filipino mother and unknown father would be non-NBFC although a Philippine citizen nonetheless because he or she merely elected Philippine citizenship upon reaching the age of majority. Atty. Lobrigo said:

    “Under the 1935 Constitution, the prevailing legal regime when Poe was born, the status of natural-born citizenship could be acquired only by descent from a known Filipino father or mother. The citizen’s bloodline tie of allegiance to his/her country is the determinative factor to consider him/her natural-born. In case the bloodline ascends to a Filipino mother, the acquisition of natural-born status is subject to a positive act by the progeny—that is, the election of Filipino citizenship upon reaching the age of majority, which must be annotated on his/her birth certificate.”

    “In a paper published in the International Journal of Refugee Law, Vol. 10 No. ½, titled “Statelessness and the Problem of Resolving Nationality,” Carol A. Batchelor, legal adviser on statelessness and related nationality issues of the United Nations High Commissioner for Refugees, made this observation on the 1961 Convention on the Reduction of Statelessness: “[It] does not require a contracting State unconditionally to grant nationality to any stateless person but seeks, rather, to balance factors of birth and descent in an effort to avoid the creation of statelessness by reflecting an individual’s genuine and effective existing connection with the State.”

    “From this expert perspective, it appears that the Convention per se cannot be a source of nationality or citizenship. To confer the citizenship would still require an enabling act from the contracting State. Hence, the 1961 Hague Convention is not a self-executing treaty law. In the 2008 case of Medellin v. Texas, the US Supreme Court held the principle that a treaty or convention cannot have an automatic and directly-enforceable effect in domestic jurisdiction unless by the nature of the treaty or convention it is self-executing. Poe’s unknown biological parents, therefore, cannot be considered Filipino citizens by mere presumption of law or legal fiction.”

    “If the 1973 and 1987 Constitutions cannot be resorted to as curative remedy to a constitutional challenge to citizenship under the 1935 Constitution, there would be no plausible justification why a descendant of a known Filipino mother should be treated less under the law over one with unknown Filipino bloodline.”

        It is important to take note what the US Supreme Court said in the Medellin case that in the ‘absence of a legislation’ a UN treaty has no binding federal law or such treaty does not automatically makes it a binding domestic law.

        No automatic application of UN treaty on a nation’s domestic law. Legislation must exists for that.

      Rene-Ipil,

      Re your Post 172.3.2: Back at the time when Grace was not yet dizzy from her ratings numbers, if my recollection is right, calls to subject herself to DNA test that will disprove that either Rosemarie is her mother or F Marcos is her father were met with answers to the effect of the ridiculousness of the suggestion. This I believe at that time was motivated by the genuine desire to protect her immediate family — husband and children — from the negative consequence of such revelation from the test, even if the fact is known to her already even without a test.

      But I now believe, as you suggested in your referenced Post, that she will reveal the fact that Rosemarie is her mother if forced to, to help insure her becoming President. In other words, political consideration, once more trumps family consideration.

        At sakali mang ilabas o lumabas na katotohanang si Rosemarie ang tunay na ina ni Grace karagdagang puntos ito sa mga kasinungalingang nanggagaling mismo kay Grace at\o Susan (Roces) Sonora. Huli na kung sakaling ito ay totoo. Hindi ko masisikmura na maging pangulo ng Pilipinas

          Marami nga ang pabigat kay GPL. At saka sa paninging ko, kailangang timbangin nya and “gains versus loses” kung nagkataong ilalahad nya ang DNA na magpapatunay na si Rosemarie and ina nya. Pwedeng makasama sa kanyang kampanya. Kasi ang itatanong — sino ang tatay? Ang implikasyon nyan kay Susan at yumaong FPJ ay masama.

        if once she is ‘forced’ to reveal that fact with proof(s) (of course) and accepted, she then is a NBFC.

        The ‘IF’ problem is that: she will have the ODDS of losing the P for LYING as a CANDIDATE for P.

        Plus, she will be subject of a criminal charge for PERJURY for her verified answer before the SET.

        And pending such criminal charge, she will be a candidate for P = prison. And lose all her PPs = passports.

        . . . and find herself in the worst of both LOST WORLDS.

        Well-reasoned notes supported by references from a lawyer with credentials as against lawyers peddling the LEGAL FICTION that GPL is a NFBC absent proof positive (such as DNA) to support such contention by such lawyers.

      safest city, methink, any criminal passing by davao city is allowed safe passage; untouched, and so, law and order is maintained. safe haven nila ang davao city, their dirty business done elsewhere. and if criminals and smugglers live in davao city, duterte would protect them, if the price is right. and as long as they do their dirty business outside davao city, they’re welcome to stay.

        Not really the safest city, compared to other cities around the world which are virtually crime-free.. When I was there a shell station with mostly women crew was held up at dusk by some misguided teens reportedly from a nearby area. I don’t know what happened to the culprits, if ever something in the name of justice happened to them, what I know is that the loot was never recovered. Compared to what it was before, Davao is now more definitely peaceful and safe, but it is never the safest.

    Mary Grace said the untruth when the truth is that she hadn’t complied with Philippine law yet when she took office as MTRCB Chair still a US citizen…

    Senator Grace Poe said on Monday that she was a dual citizen and she had renounced her United States citizenship even before she entered government service and become chairperson of the Movie and Television Review and Classification Board (MTRCB).

    “Ako’y naging dual citizen noon, but I had to give it up. Kinailangan kong isuko iyan. Ang kondisyon niyan (dual citizenship), kapag ikaw ay maninilbihan sa gobyerno, sa anumang posisyon, kailangan ay isuko mo kung anuman ang naging isa pang citizenship mo,” Poe said.

    “Hindi ako maglalakas-loob na tumanggap ng posisyon sa gobyerno, sa MTRCB (Movie Television Review and Classification Board) pa lang, kung hindi ako kwalipikado at hindi ako Pilipino,” she added.

    Poe was MTRCB chair from 2010 to 2012.

    Senator Poe said she already submitted her travel documents to authorities and the public can scrutinize it.

    “Malinaw po sa mga dokumento, hindi po ito tagong yaman. Ito po ay mga dokumentong naisumite ko na sa mga ahensya na pwede ninyong busisiin,” she said.

    “To revert back to Filipino citizenship, ire-renounce mo lang ‘yung US citizenship mo. ‘Yun lang ang ginawa ko. ‘Yun kasi ay condition ng Dual Citizenship Law. Hindi iyon to-reacquire Philippine citizenship kasi it reverts back to that automatically,” she said.

      Section 5. Civil and Political Rights and Liabilities – Those who retain or re-acquire Philippine citizenship under this Act shall enjoy full civil and political rights and be subject to all attendant liabilities and responsibilities under existing laws of the Philippines and the following conditions:

      3. Those appointed to any public office shall subscribe and swear to an oath of allegiance to the Republic of the Philippines and its duly constituted authorities prior to their assumption of office: Provided, That they renounce their oath of allegiance to the country where they took that oath;

      That is, of course, if RA9225 is truly applicable to a FOUNDLING, a stateless BUT with legal status individual in the eyes of Philippine Constitution and laws.

        Unless and until this individual will apply for naturalization will he/she be able to acquire Philippine nationality, or

        Unless and until this individual will prove by any undoubtable means, e.g., clear and definite DNA test, that he/she has Filipino parent/s will he/she be able to acquire Philippine nationality.

Once rejected, it is not quick to welcome back with eager arms its prodigal if repentant children.           Our country is plagued with crimes & broken future largely caused by “Shabu” and we need a very strong leader like du30 who rid his city with this menace to society. He also made peace with the NPAs and the neighboring Muslims – no wonder Davao City is ranked as the 5th peaceful city in the world. Business flourishes as investors come in and colleges & universities are packed with students from elsewhere. Traffic jam is non-existence due to imposed discipline among drivers & installation of CCTVs along the major thoroughfares. There are no police patolas but real peace enforcers

          It’s unfortunate du30 has a very slim chance of winning due to lack of campaign funds and negative accusation of human rights violation, particularly to hardened criminals and drug pushers but they’re necessary and much welcome by law-abiding citizens and business groups.           The fact remains that unlike the other major cities in the country, one can walk alone or in group during the wee hours of the night without being molested, robbed or raped – and to prove this, one must visit the Durian City and paint the city red at night and walk your way home.

          I’m not from Davao City but my children and their children have all studied there and not in nearby cities where crimes of all kinds abound

          Absolutely. like seasoned successful battle commanders who learned from their past blunders and victories, du30 will be uncompromising in his position against illegal drugs and criminality that makes his city the envy of other LGUs in terms of peace and orderliness.

          Current leading presidential candidates are weak in leadership and the status quo will surely prevail until 2022 if one of them wins.

          Remember those numerous drug lords who were caught but later released due to bribe money. Nothing of that sort will happen during du30’s watch.

          If one is a ‘suspect’ committing a crime, had committed recently a crime or is about to commit a crime, there is no ‘foundling for a suspect’ in that case in Davao City.

          Thus, and as of now, it is true there is 99% no crime in Davao City. That appears good. There is a rule of peace. For how long? When Du30 is not around anymore,

          will it still be a rule of peace? Let us wait and watch because the rule of law may never be the norm in that City in the future.

          leona, I cannot trust crime statistics in davao city, the statistics there may not be truthful at all. hawak ng mga duterte ang buong davao, it would be easy for them to manipulate all kinds of demographics including statistics, census, data, etc.

          statisticians would not want to report and publish the true figure baka ma-rest in peace sila, binaril ni duterte, their dead bodies fed to sharks.

          I have lots of question regarding possible Duterte presidency like, can his micromanaging style work for the whole country? Can he impose discipline on territories ruled by political kingpins like the enriles and singsons? Can he impose dictatorial rules without being ousted by a military coup? Needless to say, to AFP, Duterte smells like a dog eater to a dog..

          One big question that should confront him in his soul searching is this: Can he measure up to his pronouncements he made before he seriously considered the presidency?

      It’s already a fact that Mary Grace was still a US citizen (‘dual’ citizen to some, i.e., if the law is really applicable to her) when she was MTRCB Chair…

      Disposition of Cases when Administrative Premise is Applicable

      In light of the administrative premise discussed above, a person who:

      1. is naturalized in a foreign country;
      2. takes a routine oath of allegiance to a foreign state;
      3. serves in the armed forces of a foreign state not engaged in hostilities with the United States, or
      4. accepts non-policy level employment with a foreign government,

      and in so doing wishes to retain U.S. nationality need not submit prior to the commission of a potentially expatriating act a statement or evidence of his or her intent to retain U.S. nationality since such an intent will be presumed.

      When, as the result of an individual’s inquiry or an individual’s application for registration or a passport it comes to the attention of a U.S. consular officer that a U.S. national has performed an act made potentially expatriating by INA Sections 349(a)(1), 349(a)(2), 349(a)(3) or 349(a)(4) as described above, the consular officer will simply ask the applicant if he/she intended to relinquish U.S. nationality when performing the act. If the answer is no, the consular officer will certify that it was not the person’s intent to relinquish U.S. nationality and, consequently, find that the person has retained U.S. nationality.

          Was the Transcript here accurate? Looks like a GAP is MISSING. Has GPL read this as PUBLISHED and asked for a CORRECTION or there is no GAP missing, meaning the reported INTERVIEW on this is correct?

          ‘x x x and I never used my visa after that x x x’ . . . meaning, in answer to the QUESTION beforehand, she was not a US citizen anymore. Looks like GPL must have been shown of a SC decision on ‘using a US visa after a renunciation of US citizenhip.’ Was she shown of such a decision?

          What prompts GPL to use or have the best of both worlds – US World and RP World?

          Isn’t one World enough for her? With TWO WORLDS one has a FAST WORLD.

          Until GPL renounced her US citizenship on October 20, 2010 she was a dual citizen under Philippine laws but using US passport to travel to and from the Philippines and US. As a holder of foreign passport GPL was entitled to a “Balikbayan Visa” which allowed her and family to stay in the Philippines for not more than one year at a time.

          GPL has already been issued on July 31, 2006 by BID of an identification certificate evidencing her dual citizenship. But it was her choice in which country she wished to maintain legal residence or domicile. Apparently, GPL chose US as her domicile until she relinquished her US citizenship on July 12, 2011 or, at the earliest, until she renounced same citizenship on October 20, 2010.

          Indeed, immigration records show that GPL never stayed in the Philippines for a year, in fact much less, while a dual citizen. Thus, GPL and family were exempted from paying Philippine travel tax. This also shows that GPL never acquired legal residence or domicile in the Philippines until she renounced her US citizenship on October 20, 2010 at the earliest.

          Under US laws GPL was still a US citizen until she relinquished such citizenship on July 12, 2011. Needless to say, GPL could have been a legal resident of US up to July 12, 2011 if she wished it, or maybe she did.

          If it was true that GPL stopped using her “Balikbayan Visa” after renouncing her US citizenship on October 20, 2010, she must be paying Philippine travel tax already since then. But her husband and children remained exempted provided that they did not stay continuously in the Philippines for a year.
