Senator Bongbong Marcos plans to sneak into the vice-presidency the way Binay did

Can the Marcoses be charged in court using their dad’s “Anti-Fencing” decree?

That’s the spin the first family of crime wants the public to believe. That Baby Marcos is not running for the presidency, but the spare tire position underneath.

Ho hum. Nothing to worry about. Let Baby Marcos be.

The Marcoses are clever at running national campaigns and they don’t do things halfway.

If Marcos junior DOES win the vice-presidency he will be in a very powerful position. To start off, he would be able to take advantage of political developments no matter who becomes president. If Binay runs and wins the presidency and gets impeached or overthrown, guess who’d replace him? If Poe wins and gets overwhelmed by citizenship considerations, guess who’s waiting in the wings.

Binay, Joseph Estrada Noli de Castro have shown the tremendous propaganda potential of the vice-president’s office. Just by occupying the post and doing feel-good things, a vice-president can outshine the sitting president in popularity polls.

Which is why the office is considered a launching pad for the presidency.

To win the vice-presidency, Marcos Jr can easily do what Binay did in 2010. Bongbong Marcos can graft himself to two of the leading presidential contenders – Senator Grace Poe and Vice-President Jejomar Binay. Both Poe and Binay are on very friendly terms with Marcos Jr.

And even to a third – Davao City Mayor Rodrigo Duterte – if the latter again changes his mind and runs for president. Even if Duterte doesn’t run, the mayor has already dropped the word that BBM is welcome to campaign in his city. Which should make people wonder at Duterte’s set of values – for instance, he said he would also go after “corrupt” officials but here he is happily backing the son of the most corrupt leader this country has ever had.

It is no sweat for Bongbong Marcos to print sample ballots and plaster the nation with stickers and campaign posters saying – “Poe-Marcos” and “Binay-Marcos”. There is no election law against it.

It’s probably cynical and unethical, but it isn’t illegal. And the Marcoses have the money to do this nationwide. After all, everybody knows they stole at least US$10 billion when they were in power. Who knows what that plunder is worth after interest?

Of course, at the last moment if Bongbong Marcos’ numbers do not improve, he might opt to just run again for the Senate and ask supporters to back one of the presidential candidates. That is what Imelda Marcos did in 1998. She started by running for the presidency, then backed out and supported Estrada. When Estrada won, Ate Imee gushed that they were “over the moon” with Erap’s victory.

The nation soon found out why, when Estrada tried to bury daddy big bucks Marcos’ corpse in Libingan ng mga Bayani. Failing that, Estrada still tried to forge a compromise deal with the Marcos family but was stopped cold by his ouster from office.

Senator Bongbong has to make up his mind about running for which post by December – the deadline the Comelec gave to candidates to ensure their names will be printed on the ballots.

Pro-Marcos loyalists have slammed me for heaping the sins of the father on the son, which they said Senator Bongbong Marcos should not be blamed for.

Ganito yon. (It’s like this.)

Bongbong Marcos’ dictator-father, Ferdinand Marcos Sr., signed Presidential Decree No. 1612 or the “Anti-Fencing Law of 1979.” I have printed out the entire decree at the end of this piece.

PD 1612 defines fencing as “the act of any person who, with intent to gain for himself or for another, shall buy, receive, possess, keep, acquire, conceal, sell or dispose of, or shall buy and sell, or in any other manner deal in any article, item, object or anything of value which he knows, or should be known to him, to have been derived from the proceeds of the crime of robbery or theft.”

Notice in particular the words “possess”, “keep”, “acquire” and “conceal” as the elements of the crime of fencing.
Isn’t what the Marcoses doing fencing when they insist on continuing to keep “the proceeds of the crime of robbery or theft” – but in this case, grand theft?

Please recall that in the year 2012, I asked Senator Marcos during a foreign correspondents forum (Focap) whether he still intended to pursue a compromise settlement on the Marcoses’ ill-gotten wealth cases and the wealth still out there hidden in various bank vaults from the government.

Senator Bongbong Marcos replied to me: “We’ve been pursuing a compromise settlement since 1986. We will continue to do so.”

His mother Imelda herself has publicly claimed on various TV interviews that so much Marcos “gold” and other assets are still out there, hidden. She has shown gold certificates as proof to the BBC and other media outlets.

These pronouncements suggest that the Marcoses themselves are acknowledging they have assets out there, assets concealed from the Filipino people. There is already a final and definitive ruling by the Supreme Court on the Marcos loot – that any earnings beyond what the conjugal dictatorship did not pay taxes on are considered stolen.

A forensic analysis of the various Statements of Assets and Liabilities (SALNs) filed by Imelda, Imee and Bongbong as public officials through the years could help establish what the children earned legitimately.

If you read the Anti-Fencing Marcos decree, the Marcoses could each be looking at up to 20 years in jail, if they are found guilty of fencing goods stolen from the Filipino people.

This is in Section 3 (a) of PD 1612 which states that “if the value of such property exceeds the latter sum (of P22,000) the penalty provided in this paragraph shall be imposed in its maximum period, adding one year for each additional 10,000 pesos but the total penalty which may be imposed shall not exceed twenty years.”

Please also recall that a year ago, some paintings were seized from Congresswoman Imelda Marcos. Can’t she be charged with fencing on this matter? You can read about the seizure here. 

Interestingly, the Marcos decree expanded the definition of fencing. Instead of punishing only those who buy stolen goods the mere act of receiving, possessing, concealing and/or acquiring stolen goods now constitute fencing.

Will anyone dare to file a lawsuit against the entire Marcos family using the Anti-Fencing Law?

Here below is the Anti-Fencing Law:

Presidential Decree No. 1612

ANTI-FENCING LAW OF 1979

WHEREAS, reports from law enforcement agencies reveal that there is rampant robbery and thievery of government and private properties;
WHEREAS, such robbery and thievery have become profitable on the part of the lawless elements because of the existence of ready buyers, commonly known as fence, of stolen properties;
WHEREAS, under existing law, a fence can be prosecuted only as an accessory after the fact and punished lightly;
WHEREAS, is imperative to impose heavy penalties on persons who profit by the effects of the crimes of robbery and theft.

NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines by virtue of the powers vested in me by the Constitution, do hereby order and decree as part of the law of the land the following:
SECTION 1. Title. — This decree shall be known as the Anti-Fencing Law.

SECTION 2. Definition of Terms. — The following terms shall mean as follows:

a. “Fencing” is the act of any person who, with intent to gain for himself or for another, shall buy, receive, possess, keep, acquire, conceal, sell or dispose of, or shall buy and sell, or in any other manner deal in any article, item, object or anything of value which he knows, or should be known to him, to have been derived from the proceeds of the crime of robbery or theft.

b. “Fence” includes any person, firm, association corporation or partnership or other organization who/which commits the act of fencing.

SECTION 3. Penalties. — Any person guilty of fencing shall be punished as hereunder indicated:

a) The penalty of prision mayor, if the value of the property involved is more than 12,000 pesos but not exceeding 22,000 pesos; if the value of such property exceeds the latter sum, the penalty provided in this paragraph shall be imposed in its maximum period, adding one year for each additional 10,000 pesos; but the total penalty which may be imposed shall not exceed twenty years. In such cases, the penalty shall be termed reclusion temporal and the accessory penalty pertaining thereto provided in the Revised Penal Code shall also be imposed.
b) The penalty of prision correccional in its medium and maximum periods, if the value of the property robbed or stolen is more than 6,000 pesos but not exceeding 12,000 pesos.
c) The penalty of prision correccional in its minimum and medium periods, if the value of the property involved is more than 200 pesos but not exceeding 6,000 pesos.
d) The penalty of arresto mayor in its medium period to prision correccional in its minimum period, if the value of the property involved is over 50 pesos but not exceeding 200 pesos.
e) The penalty of arresto mayor in its medium period if such value is over five (5) pesos but not exceeding 50 pesos.
f) The penalty of arresto mayor in its minimum period if such value does not exceed 5 pesos.

SECTION 4. Liability of Officials of Juridical Persons. — If the fence is a partnership, firm, corporation or association, the president or the manager or any officer thereof who knows or should have known the commission of the offense shall be liable.

SECTION 5. Presumption of Fencing. — Mere possession of any good, article, item, object, or anything of value which has been the subject of robbery or thievery shall be prima facie evidence of fencing.

SECTION 6. Clearance/Permit to Sell/Used Second Hand Articles.

For purposes of this Act, all stores, establishments or entities dealing in the buy and sell of any good, article, item, object of anything of value obtained from an unlicensed dealer or supplier thereof, shall before offering the same for sale to the public, secure the necessary clearance or permit from the station commander of the Integrated National Police in the town or city where such store, establishment or entity is located. The Chief of Constabulary/Director General, Integrated National Police shall promulgate such rules and regulations to carry out the provisions of this section. Any person who fails to secure the clearance or permit required by this section or who violates any of the provisions of the rules and regulations promulgated thereunder shall upon conviction be punished as a fence.

SECTION 7. Repealing Clause. — All laws or parts thereof, which are inconsistent with the provisions of this Decree are hereby repealed or modified accordingly.

SECTION 8. Effectivity. — This Decree shall take effect upon
approval.

Done in the City of Manila, this 2nd day of March, in the year of Our Lord, nineteen hundred and seventy-nine.

      Jpjo gets arrested and Grace is disqualified. Manuel will still be at the cellar after the counting. The wax can never be buried because it is just a wax. The person is very much alive. Benigno loses his mind after being in jail with Florencio for only four months. Gloria will be out on bail and so will Jinggoy and Bautista be. People will be in jail for treason. Bonget may be good as VP but the problems start when the cousins start entering the scenes. Hence, Leni may just be a better alternative. A mama’s boy can not be allowed to become president just as a coup plotter can never be a VP.

      too much hassle kasi if bong marcos goes for presidency. he would have to front debates campaign hard and work hard, going all over the country, smiling when he does not want to smile, shake hands when he would rather keep his hands to himself.

      bong is used to easy life, things are done for him, with many paid minions doing the hard yakka for him, the thinking and the reasoning. if people ask bong about his unfinished degree and his father’s collection of fake medals, aba, he would not want to be shamed, his reaction broadcast to the nation. he’s not used to being asked, he is used to giving orders and be obeyed. presidency via the back door is the best bong could do.

      Here is why I am taking the RORO
      1. Port to port the RORO takes a straight path (tuwid na daan)
      2. Even on rough seas, the RORO takes us to our destination (a more developed economy)
      3. The RORO interconnects the archipelago (participatory democracy)
      4. As a traveller (seeking good governance) I have faith in the RORO

      Do you know why Sweden, Denmark and Germany have very progressive economic interaction?

      The RORO system dominates the transport of their goods and passengers from/to Gothenburg in Sweden, Copenhagen in Denmark and Bremerhaven in Germany, the former countries being archipelagic like the Philippines. Once, I traveled by train from Gothenburg to Bremerhaven using the RORO vessels which predominantly occupy the sealanes in the area. Indeed, many Filipinos were sent in these countries decades ago to study and learn about the RORO system. But while these Filipinos learned fast our political leaders act so slow.

          No, they ALL went home and tried to apply what they learned. But as I said the political leaders were so slow applying the RORO system and building of infrastructure due to lack of financial resources and to unmitigated corruption. I did not say that the government did not act at all. In fact the MICT included a RORO terminal but seldom used. Other Philippine ports have few RORO terminals. Nonetheless, up to now the Philippines lacks DEDICATED RORO ports despite its archipelagic configuration.

          I pray that RO-RO would significantly improve our RORO system by establishing more RORO terminals and road infrastructure in Batangas, Subic, Mindoro, Romblon, Marinduque and other Philippine islands. This would greatly lessen cargo and container traffic in North Harbor and South Harbor in the Port of Manila, and would minimize traffic in Metro Manila. Commerce all over the country would be enhanced.

          You are right and I agree with you that a much better and efficient RORO service with improved port facilities will definitely propel our country to a much improved and strong economy.

          Sana makarating ito sa tandem ni Mar at Leni as our leaders who will take the RORO helm upang mapasama sa platform of government nila ang honest to goodness support for inter-island RORO connectivity.

          If my memory serves me right the RORO tandem came out first here in Raissa’s blog from a CPMer.

          Oh I wasn’t aware of that development. But there are already many Filipino singers supporting Mar, for free also I believe. Like Jim Paredes and Noel Cabangon among the oldtiners and Jay R, Kris Lawrence and Billy Crawford among the younger ones. He doesn’t need to pay for more soguro.

        Education is the key, not just for the youth but for the elders who keep on reproducing even if they can hardly feed themselves. Parents who have 6 or 8 children and earns 150 pesos a day will for sure sell their votes for a couple of days of food.

    I’m surprised how MAR’s brilliantly played out role as the Philippines’ chief negotiator held last November 2001 in Doha, Qatar did not get the attention and praise it justly deserves. Anecdotes and situations where MAR’s keen judgment, composure and leadership qualities were very much evident spring to mind quite easily.

    There was for instance the confrontation with EC Commissioner Pascal Lamy regarding our refusal to agree to the EC’s grant of preferential treatment in favour of ACP (African Caribbean Pacific) countries unless the resulting adverse trade effects suffered by the Philippines were adequately safeguarded. Unknown to many, the successful conclusion of the Ministerial Conference hinged on whether this issue would be resolved.

    On the last day of negotiations, Lamy finally decided to engage MAR in a face-off, walked imperiously with his army of lawyers and advisers into the meeting room where the Philippine delegation had been consulting– and receiving intense pressure– from various delegations, and condescendingly issued an ultimatum: either the Philippines (and Thailand) accept the EC’s last offer or accept responsibility for a failed Ministerial.

    Lamy then berated the Philippines for “holding the entire negotiations hostage” on account of a single issue (which obviously was untrue, since it was the EC which was forcing acceptance of the ACP preferential treatment upon us, since they needed the support of the ACP countries for the agenda the EC was pushing in Doha). Cutting him off, MAR stared down Lamy, saying, “I resent that. The Philippines is not holding anyone hostage here. If anyone is doing it, it is in fact the EC which is holding us hostage by insisting on our agreement to a deal which was never part of the Doha agenda in the first place!” Trying to rectify his faux pas, Lamy stammered that he “really didn’t intend to mean that we were holding anything hostage,” and that he “meant something different.” At which point MAR said sharply, “C’mon, Pascal, you’re far more sophisticated than that. We both know that you knew what you meant.” Still trying to regain his balance, Lamy said that “English was not his mother tongue and that…” MAR pounced on him again before he could finish, retorting “Well, Pascal, English is not my mother tongue, too, but if you want, we can negotiate in Filipino instead!”

    Minutes later, Lamy huffed out of the room, standing an inch or so shorter than when he came in. The EC had taken its best shot, going with its top honcho against MAR, and ended up contributing to MAR’s growing stature in Doha instead.

    Of course, the best part of it was in the end the Philippines got a better deal than even what the EC was prepared to give– a mechanism for addressing our concerns that went beyond what the WTO rules obligated the EC to do at that point. Plus, by getting our deal and removing this final obstacle to the adoption of the Doha Declaration, MAR had essentially saved Doha. Otherwise, coming on the heels of a failed Ministerial Conference in Seattle, the WTO itself would now be teetering on the brink of irrelevance.

      thank you. so glad to read this. i also attended a gathering where i heard anecdotes of admirable significant actions by mar that have not gotten attention. i really feel frustrated that mar is portrayed as having the image of being weak or soft.

        mar roxas is best person to be president of the philippines, best to vote him in. mar is not afraid of hard work, unlike the one who is trying to be president via the back door, namely bong marcos, vice presidential candidate from ilocos where they have a bangkay in glass case waiting to be risen from the dead.

          Du30 is the only gutsy P that can save the country from being the illegal drug capital in Asia. Look at our neighbors like Indonesia where our very own Veloso is about to be hanged for carrying illegal drugs. Here, we release them for the right price. It’s likely that El Chapo will soon settle and do business in the most expensive gated subdivision like Ayala Alabang, etc

          Less drug less crime and investors will come rushing in

      CAn somebody in the LP campaign just compile all the excellent things that Mar Roxas has done for the country and put it all in a newspaper style or komiks style, something that those in the provinces and in the lower level of society can understand?

      Baka naman in the end, it is us who will be held hostage by these so-called “bo…tantes” and will elect as President either Binay or Poe and so we are left hostage to their ignorance and preference to sell their votes…

      Then there will no more Philippines….

        Yes please let us have that komiks and both in Pilipino and English. We really need to broadcast the achievements of Mar as against the Mamapasano incident which the opposing sides keep bringing up. Like for instance, let’s toot the BPO industries which I understand Roxas has played a big part. This will then get the votes of those working in the industry as well as their families. How about the Generic Drugs Act, I heard someone mention that Roxas authored this. If true, this will get the votes of those using generic drugs specially senior citizens who take maintenance medicines.

      That’s the best you can come out trying to prove a malfeasance? What is wrong buying properties from funds earned by your company? Note that the company is a private entity so its stockholders can buy anything they want to buy. That senator may just be trying to ingratiate himself with Quo Rhee in his desire to win a contract in the newly formed government at that time. If there was anything that could have shown illegality in those deals, the State Dept would have been first to put its foot down. Kakaawa ka naman – hirap na hirap maghanap ng katibayan ng “pagnanakaw”.

    Vice President Jejomar Binay chose a presidential campaign slogan that rhymes with his name: “Gaganda ang buhay kay Binay.” (Life will improve with Binay).

    Senator Grace Poe, who has led the polls for many months now, has chosen the slogan, “Walang Maiiwan.” (No one will be left behind)

    So back to Santiago. What’s her campaign slogan?

    “Stupid is not forever!”

    It is a take-off from her book, “Stupid is Forever,” and its sequel, “Stupid is Forevermore.” Both are best-sellers.

    It wasn’t clear whether her slogan refers to elected officials, or the voters who keep electing corrupt and incompetent politicians.

I can imagine her going into self imposed hospital arrest for treatment of her imaginary cancer. and when the whim suits her, she may choose to have medical check ups overseas as often as she likes. cost is going to stratospheric. bankrupt na naman ang bayan.
