Sen. Chiz infuriates Marcos family

USE THIS - 2016 Elections UPDATES June 8-15Only a block of cheese, er, Chiz stands between Sen. Bongbong Marcos Jr. and the vice-presidency.

Which is why, one political analyst told me, the Marcos family is infuriated at Sen. Francis “Chiz” Escudero.

Who is he anyway? Just the son of Salvador “Sonny” Escudero, a former alalay of their late patriarch, President Ferdinand Marcos.

And what’s the hurry? Sen. Chiz is only 46 years old, plus his term ends yet in 2019. While Sen. Bongbong is 58 and is “graduating” next year. Meaning, if he loses next year he will have to sit out at least three years to get back into another elective post.

The least that Sen. Chiz could do – to show some gratitude to the Marcos family – is to give way to Sen. Bongbong, and perhaps even endorse him. That way, Sen. Bongbong will have an easy shot at the vice-presidency. That’s what the Marcoses are trying to tell Sen. Chiz right now.

But Sen. Chiz is stubborn, at least for now. He is not dropping out. He has been topping all poll surveys for the vice-presidential race, with Sen. Bongbong now running a far second. In the 2010 presidential race, Sen. Chiz backed out at the last minute, joined the Aquino campaign. Yun pala, DPA for Mayor Jejomar Binay. LOL. Despite this, the LP still fielded Chiz as “guest candidate” for senator in 2013, along with Grace Poe.

You could say the LP created its own problems for 2016.

What’s the voter appeal of Sen. Chiz and Sen. Grace Poe? If you look at the video clips of their rally in Tawi-Tawi, they both look like kids waving to the crowd. And the voter profile is getting younger and younger.

How about Rep. Leni Robredo? How is she doing?

The analyst told me it may be “too late” for her to spurt to the head of the pack.

From what I have seen in previous elections, nothing is “too late” unless you think it.

My favorite analyst conceded so many unexpected things could still happen. “Mahabang sitcom ito.” he said.

    • the eyes are the windows of the soul, ika. you see with your eyes, you feel with your heart, you think with your brain. fiction writers, they’re emotive lot. about kiddults, books that appeals to both kids and adults, may have shorter shelf life span, but there’s money in them, ask j.k. rowlings. the lucky ones who put both their heart and soul into writing, have done their research and targeted their specific audience become famous and raked billions. the pen is mightier than the sword. there’s barely no patent on ideas only on works.

      apparently, the author of the little prince, oscar wilde? was far away from home, in exile and feeling the cold wrath of fellow writers dahil gay yata si oscar and was found in compromising position with one of his sex. and while in exile, oscar created some somber works, he was later taken back to the fold and forgiven, thanks to his talent. this is just off my head, what I remember.

    Ano itong “alleged” opening of bank account sa rural bank sa isang probinsya ng mga taga roon para mapadalhan ng “papasko” mula kay Bongbong Marcos?

      • duterte is safe and safer with binay, both inclined to corruption, both lawyers fallen on the ways of evil, they might as well be buddy dearest, inseparable.

        but with roxas, there is strong possibility duterte will be sent for re-education if he wants to stay relevant. at his age, that might be the end of duterte, his old ideas will be challenged, he may have to learn new ways of doing things. not reaching for his gun at the 1st sign of trouble, opening himself to better and newer ideas that does not involve bloodshed right away, and thinking 1st before talking. hard stuff.

      • If Cayetano does not move fast, I expect him to be booted out with BBM taking his place. He was never Digong’s choice but was taken in as a convenient replacement when BBM teamed up with Santiago.

  7. I must admit that I once had dismissed ex-Dean Valdez’ argument as preposterous, but wait a sec…

    Does one get a natural born status twice i.e. one by actual birth to a Filipino parent, and the other by operation of law?

    There is no argument that the state thru RA 9225 or judicial order cannot grant a natural born status to anyone. Only a biological parent can.

    So even if Poe get’s a positive DNA match, Valdez’ petition will survive on the NBFC issue while the other two will fail. IMO.

According to automatic modes, nationality is acquired as soon as criteria set forth by law are met, such as birth on a territory or birth to nationals of a State. By contrast, in non-automatic modes an act of the individual or a State authority is required before the change in nationality status takes place.

          Footnote: Please note in this regard that the phrase “under the operation of its law” in Article 1(1) is not synonymous with “by operation of law”. The latter is a term of art (used, for example, in the 1961 Convention) which signifies a mechanism that is automatic in nature. The stateless person definition encompasses nationality that may have been acquired or withdrawn through non-automatic as well as automatic mechanisms.

          4. BY OPERATION OF LAW (ex lege), the 1935, 1973, and 1987 Constitutions specifically dictate a nationality of a child by right of blood or descent. In the case of foundlings, as previously explained, PH nationality was generally given by the PH State UNDER THE OPERATION OF ITS LAW.

          Starting from the 1973 Constitution, “a natural-born citizen is one who is a citizen of the Philippines from birth without having to perform any act to acquire or perfect his Philippine citizenship.”

          In the case of foundlings, the Foundling Certificate, with no mention of parentage, merely gave a foundling legal status because there was no attachment of nationality in the Foundling Certificate BY OPERATION OF LAW (There is no national law or PH Constitutional provision for foundlings) unlike in the usual Certificate of Live Birth.

          A State authority is needed to assign the PH nationality to foundlings, just like in applying and getting a PH passport. A State authority is needed to perfect a foundling’s PH citizenship.

          Obviously, the non-automatic mode is at play in the case of foundlings. Thus, if they are NOT natural-born PH citizens then they are naturalized by the State. This is the elimination process that is happening in the PH setting…not the other way around.

          However, as everyone knows by this time, BY OPERATION OF LAW (ex lege), clear proof of foundlings’ Filipino parentage will automatically render them natural-born PH citizens. DNA matching is the technology employed in our current setting.

          So therefore, sa kaso ni Grace, kahit mapatunayang anak siya ni Marcos (thru DNA or by her own acknowledgement), hindi pa rin siya pwedeng maging president, o bise man lang.

          Again, it’s a matter left for the SC to interpret.

          I believe “Philippine citizenship” takes on the general form while “natural-born citizen of the Philippines” is the specific form.

          The magic oath laid down by RA 9225 grants RETENTION of the primordial status of an individual.

          Thus, personally, I don’t subscribe to Valdez’s position and I presently don’t want to study further his line of reasoning…yet (some other time, perhaps).

          RA 9225’s infirmity, i think, is that it may foster dual allegiance and this is something the SC must have to ‘rethink’ if ever the issue of this infirmity is brought to the magistrates.

          “Section 3. Retention of Philippine Citizenship – Any provision of law to the contrary notwithstanding, natural-born citizenship by reason of their naturalization as citizens of a foreign country are hereby deemed to have re-acquired Philippine citizenship upon taking the following oath of allegiance to the Republic:

          “I _____________________, solemny swear (or affrim) that I will support and defend the Constitution of the Republic of the Philippines and obey the laws and legal orders promulgated by the duly constituted authorities of the Philippines; and I hereby declare that I recognize and accept the supreme authority of the Philippines and will maintain true faith and allegiance thereto; and that I imposed this obligation upon myself voluntarily without mental reservation or purpose of evasion.”

          Natural born citizens of the Philippines who, after the effectivity of this Act, become citizens of a foreign country shall retain their Philippine citizenship upon taking the aforesaid oath.”

          Let me emphasize the difference between retention and re-acquisition.

          1. Citizenship retention – applicable to those who become dual citizens after the imposition of RA9225 year 2003. Those who swear allegiance to other nation(aside from Philippines) are deemed not to lost their citizenship thus retaining their natural born status.

          2. Citizenship re-acquisition – applicable to those who lost citizenship before imposition of RA9225 or year2003. Those who swear allegiance to other nation lost their natural born citizenship completely and only able to re-acquire their naturalized citizenship.

          So Grace Poe having lost her citizenship year2001 can not use RA9225 to claim she was natural-born. Its even questionable whether she was a natural-born in the first place for being a foundling.

          In the case of Poe, as you particularly ascribe your comment to, AFAIK, RA 9225 is not applicable to her because, presently, she still has to prove she is a natural-born Filipina.

          As a foundling, she was only given legal status by State authorities…then was ‘naturalized’* as a Filipina…then was ‘naturalized’** as an American…(stop muna siguro tayo dito)…

          RA 9225 only applies to natural-born Philippine citizens (those nationals who acquired Philippine citizenship via the automatic nationality mode BY OPERATION OF LAW. “By operation of law” as carefully explained by UNHCR).

        • I regret to say but that line of reasoning is as unthinking and heartless to the legal and humanitarian dilemma faced by foundlings. The fundamental crux of the problem is that the biological parents of foundlings are anonymous because it was their originali intention to do so, which abandonment is cruel and no fault of the foundlings whatever the motivation of the parents. Most likely, this motivation to remain anonymous has intensified rather than decreased with the shame and stigma associated with such a neglectful and inhumane act to the most defenseless and innocent members of society, our very own young.

          And now you propose as a solution that the foundlings undo the crime of the parents and that of an uncaring society by foisting upon them the monumental if not virtually impossible problem of finding the parents who abandoned and may still may want to hide from them. There is a reason why two UN conventions came up with treaties and laws on foundling to address their hapless situation and the uncaring and inhumane societies they were born into. And it is NOT so they can declare that the internationally conscionable solution is to have foundlings find their long lost reluctant biological parents and leave it their responsibility to fix the awkward and difficult situation they found themselves thrown into.

          As for DNA matching technology, it is not quite the panacea or the solution that many mouth it to be. It leaves the foundlings the Sisyphean labor of seeking what presumably is reluctant to be found, who may be deceased or moved elsewhere, who in most cases are not senators or presidents to be, but none the less are deprived of opportunities to live or work in licensed careers because they were abandoned as babies.

          Clothing these arguments in Latin names does nothing to mask the lack of understanding pervading the legal plight of these unfortunate members of society. Lawyers and legal experts are supposed to know the basic purpose of the law is to serve humanity, not to perpetuate injustices imposed legally or “by operation of law” on its most helpless and innocent members.

        • Some say that foundlings should be given leeway when they’re running for the highest offices of the land, that it is heartless since it’s not their decision to be foundlings.

          On the emotional note, yes, that is commendable. But several Congresses went and gone but they have not addressed how foundlings should be treated by enacting laws that will protect their rights, most importantly the nature of their citizenship.

          Let us not muddle the issue with emotions. Let us even point our finger on the the present Congress for not passing a law that will protect foundlings, or better yet, let us ask Ms. Llamanzares why she didn’t pass a bill that will protect the rights of the foundlings since she was a foundling herself.

          Senator Revilla (the father) is much more commendable because he authored a law that protects the rights of the illegitimate children since he has so many children with so many women.

          Now, with the lady senator, why didn’t he authored a law to protect the interest of foundlings? And how she’s using the foundling issue as an advocacy? Why only now?

        • On day one as senator GPL should have filed a bill for foundlings if she were one of them. Is this not the best circumstantial evidence that GPL was really not a foundling contrary to her pronouncements? Her failure to take care of foundlings like her at the onset would be against human nature and experience.

          Like I said before…I am really curious how the SC will judicially legislate that foundlings are native-born Philippine citizens considering the State neglect of foundlings.

        • It has always been an appeal to emotion so that if the Comelec and the SC rule legally and judicially against Duts and Grace, they (the pro-Grace and the pro-Duts people) could antagonize the situation further. That is what I am afraid about as there are many antagonist who may want to muddle the issue.

          Assign the blame on the Congresses that came and went and also on the present Congress that didn’t legislate a law so that foundlings can be protected. Or are you blinded by your emotional bias?

          From the point of view by our SC, will depend on the VOTING. . . if 8 justices as majority or more, Poe will be DQd or will be Qlfd. . . by ‘operation of a RULING.’

          If Poe is out/DQd, Du30 will continue to run. If Du30 is also out/DQd, Du30 will support Binay.

          Where will PDP-Laban and P. Cayetano and Pimentel go? 3 Choices: to MAR; or to MIRIAM. Or NONE at all.

          . . . the best choice > to MAR LENI. RORO!

          . . . a good choice > to MIRIAM without Bongbong. If WITH Bongbon. . . Mindanao and Visayas will GO for MAR LENI with HALF of Luzon.

    If the MAYOR said HE KILLED THEM, where are the DEAD BODIES? Buried? Where? How big in area is Davao City? Any CORN FIELDS? Do people Wonder at all?

    • dead people, duterte had them minced as pet food to be feed to animals in the zoo. animals like their meat raw, fresh and quivering and still madugo. bet crocodile lolong once had tasted human meat, he, he, he, delicious and nutritous, got 1st class protein.

      now, if the dead were thrown to the sea, marine life would have feeding frenzy. the skeletons of the dead, like malaysian airplane that got lost with all the people on board presumably dead, will be hard to find too, water current taking them all the way down to the depth of the indian ocean.

      • there are many ways of disposing human cadavers. medical schools want a fair share of them for live anatomical studies. there is nothing better than the real thing. yaks!

      parents in davao ought to be asking that questions now. their sons and daughters that left home, never came back and were never heard again, might have been trafficked and sold off to human traffickers. some are probably overseas and held as virtual slaves working in sweat shops. and with no passports, money and contact, they wont be able to come home, let alone tell their families what happened to them. they may as well be dead.

      selling them to human traffickers may be more profitable thank killing them.

      The usual lecture the police trainees would hear from veteran police officers goes this way. “You can earn extra money without resorting to “hanapbuhay.” Just open your eyes and provide efficient police service “para kumita ng laughing money.” Puede rin naman na “mag-hanappatay” para sa mga punerarya.

      So, why were there no dead bodies found under the ground? Your guess is as good as mine.
