    DID GRACE POE EVADE PAYMENT OF PHILIPPINE TAXES?
    .
    In August, 2000, Fernando Poe, Jr. together with wife Susan Roces, Mary Grace Poe Llamanzares, Joseph Martin Sonora, and Jeffrey Stevens Sonora formed the 226 Wilson Development Corporation with business address at 23 Lincoln St, Greenhills, San Juan.

    The family-owned business was registered with the SEC on March 2001 with a capitalization of P170 million. It was involved in developing, selling, and leasing real estate properties. As of December 31, 2002 its total assets was P77.8 million.

    Although Grace Poe was involved in the business starting in 2000, her record shows that she only acquired her Philippine TIN in 7/22/2005.

    Does it mean she did not pay any taxes for income she earned from the family-owned business?

      A person can only have one TIN, and it is illegal for anyone to have more than one TIN. Grace Poe could not have paid any Philippine taxes prior to her acquisition of TIN in 2005.

        Ano na ang nangyari dito? Punta (palusot) sa kanan (nagbayad ng tax), hulog sa kanal kasi sabi mo nga @Yvonne, wala pa sya TIN ng 2000. Punta (Palusot) sa kaliwa (di nabayad ng tax), hulog din sa kanal. Kasi tax evasion naman sya.

          Nuong 2005 lamang nag-apply at nakakuha ng TIN si Grace Poe.

          Pero kasama na siya sa negosyo noon pang 2000.

          Ang ibig sabihin nito ay hindi siya nagbabayad ng tax noung panahon na wala pa siyang TIN.

          more or less ay hindi na din declare sa kanyang SALN for the year 2001 up to may be 20013. talagang maraming butas na dapat tapalan.

          Required lang siyang magdeclare ng SALN simula nuong panahon na nasa government service na siya.

          I don’t know if required na siyang magdeclare ng SALN nang maging Chair siya ng MTRCB.

          Upon joining government, one needs to file a SALN. He/she has to do this every year he’s in the government service and on the year he/she leaves the service.

          hindi lang sya na corner, double corner ang nagyayari sa kay mgl.
          wala na syang rason pa. tax evasion, lack of 10 years residency, lahat na mga sagot kasinungalinan dahil hindi na oobra ang honest mistake

          Base sa mga detalyeng nakalaad dito, it is presumptuous to say “she did not pay any taxes for income she earned from the family-owned business?” as this responsibility lies with the corporation and not with the individual shareholders.

          A corporation pays taxes for its corporate income.

          And when it pays salaries, dividends, allowances, honorarium, etc., to its officers and employees those income become taxable to the individuals.

          The corporation may provide the service of filing for the individual’s taxes but they are done separately and in the individual’s TIN.

          I’m even giving Grace Poe the benefit of the doubt – I phrased the title of my post with a question mark.

          Kanya nga, as has pointed out here, shareholders do not pay income taxes on corporate income. However, based only on these two premises –
          1.that Grace Poe was a shareholder of a corporation since 2000;
          2. that Grace Poe acquired her TIN in 2006 –
          you insinuate that ” GRACE POE EVADE(D) PAYMENT OF PHILIPPINE TAXES?”

          Can you check, though, whether it declared dividends.

          The income would come from that.

          And what GPL’s position was in the corporation?

          I tried to obtain this information before without success. Online public access to the SEC records is severely limited (I remember you wrote about this same problem before.)

          The SEC online search does not even show a 226 Wilson Development Corporation. I tried a “blind” search and it returned two companies with similar names, but other than their names no other information can be accessed online about those companies. I don’t know if it is for the reason that they are not publicly-held companies.

          Being a company-owned business, Grace Poe could have still actively participated in the business in an administrative function even while she was in the U.S. Many companies with officers and employees spread all over different locations operate this way using the internet. So she could have still derived an income from the business even if it did not pay dividends.

      Yes. GPL did evade payment of Philippine taxes from 2005 to 2009. That she has been domiciled in the Philippines since 2005 is a declaration against interest which constitutes strong evidence against the declarant.

      GPL is either guilty of non-payment of Philippine tax by evading payment of travel tax or of perjury by falsely claiming under oath that she had been a permanent resident of the Philippines since 2005. I am presently researching which offense carries a lesser jail penalty.

        That is usually the result of a lie or let us say “palusot.” You claim something now which is inconsistent with documented items you yourself did, and so magkakapatong ang kailangang palusot.

        It is said for example that a normal person may not have 100% recall or memory of a crime he witnessed, but if he is not lying he will be consistent in the main no matter what questions are posed or in whatever form. And good judges are able to discern this. In fact, it is said that if a witness is apparently very very consistent, there is probably something wrong and the answers of the witness may in fact be rehearsed and hiding something.

        In her 2014 SALN, Grace Poe declared P7,375,000 worth of inherited stocks in 226 Wilson Development Corporation.

        What is unclear is if she declared, in her SALN for earlier years, any original ownership of stocks acquired when the corporation was first organized in 2000. And equally interesting is if she ever paid taxes for any income derived from the business.

          Did she pay inheritance tax on those stocks?

          Inherited stocks is different from stocks distributed to stockholders due to realignment of stockholders. Inherited stocks meansthis was given as part of inheritance so it should be subject to inheritance tax.

          I dont care what survey say, pasaway ako! I’ll vote for tambalang roxas and robredo. roxas for president and robredo for vice president. it’s good to be pasaway, loved being one and answering only to my conscience, not to surveys.

          I dont trust faceless people participating in surveys, pretending to know what I think, and who I vote.

    What is the ‘most’ common Filipino feature or features? Squat nose? Brown or pale skin? Kinky hair? Black hair? Thick lips? Bad teeth? Mouse ears? Short or tall? Does Grace Poe L. fall under any of these features?

    What Mr. Hillbay is it really that make it OGLING to say GPL is a natural born Filipino?

      ogle as in osg likes what he saw, a composite of tight jeans and all, a pair of legs, arms, etc. many indonesians look like filipinos too, malaysians as well, predominantly dark hair, dark eyes and in varying shades of brown skins, even walk like filipinos too. por bida, some of them indonesians and malaysians speak better tagalog than me!

      I think, hilbay ought to give more weight to dna evidence, looks and physical features can be so deceptive. in paternity cases, dna trumps all. hairs can be dyed, skin whitened and noses can be made to look western.

      dyos na mahabagin, our solgen is a hillbilly. ogling must be fav pastime of his!

      And this is the darker side of things to com, if those leaders of bright minds do not do anything to improved or make anything drastic and next to impossible solutions to the biggest problem of locomotion especially in Manila in 3-4 years time.
      I personally witnessed this scenario when I came 5 years ago in the province when the vendors and people are huddled together in the middle of the road. It was very stressful. I think the words of the pope are prophetic that Pinoys should not breed like rabbits.

      And while you were sleeping or busy discussing politix, P’Noy inaugurated the Aboitiz coal mine company in Davao.You can search whether the advantages outweigh the disadvantages but I think all the pollution, CO2, Acid rain and other eco- system destruction will heap a lot of troubles for the health of the Filipino People. I would say not all the times the rallyist only wants to make some noise and attention but they are the bells and whistles for some things alarming passed by the gov’t quietly without proper consultation with the citizens.

      We’ll see if this new energy will make Mindanao into a promised land for the cheapest and affordable energy for the people or would make zombie sick like communities. There is a price for everything.

      Right: “nabawasan ang entertainment.” I note that the report in the link gives the impression that all parties are raring to go; and they as well as SC want to resolve this matter with dispatch. Handled properly, I believe that the Supreme Court has a great chance to shine here.

      Question is will there be sour-grapping by the losers. I want to be kind: win or lose I hope Grace Poe Llamanzares gain back some measure of equanimity and dignity she used to have. I hope she is prepared to act with dignity and not continue to sour-grape and blame everyone except herself considering that most of the faults are her own self-inflicted ones.

      (She needs some rest, too. I observe that the recent pictures show her anxiety has done its damage to her demeanor and looks compared to the fresh looks and comfortable expression of Leni Robredo.)

          he, he, he, reading wan linzback at 54, I’m tempted to say, grace probly has adult onset diabetes. too much sweet nothings from chiz. more sweet nothing from bautista’s comelec. she is being overloaded with sweets and carbo. supreme court will deal her treatment and like most treatments and remedies, bitter pills are hard to swallow.

    DESPERATE REASONS AND MOVES

    Of the five major Presidential Candidates, I observe that there are only two with great desperation to be President: Poe and Binay. Of course, the other three — Duterte, Roxas and Santiago — want to be President too, otherwise they would not have filed Certificates of Candidacy but not in such desperation verging on great Panic. I can think only of these reasons:

    – In the case of Binay, it is to protect his hide and that of his family from plunder charges if he loses his quest for the Presidency; and of course recoup investments already made.

    – In the case of Poe, I can only think of the desperate effort by both her and her financial donors to protect the investments they have already made, forget her so-called running as an Independent — independent from her big financial donor?; that has to be a big laugh. And oh no, not to fight for the rights of foundlings. Unless we are all stupid which she treats us all to be.

    Her ads contain subliminal message to the Filipinos “sa huli pinayagan na rin tumakbo ng Supreme Court”.

    If and when SC decides to disqualify Grace, confusion will remain in the minds of classC, D &E voters thinking that this current ad had already allowed Grace to run, then why did the SC disqualify her!

    Grace has a pending case in the SC yet her ads refer to the SC subconsciously to confuse the voters.
    Classic Contempt of Court.

    Supreme Court justices are in a no win situation here.

    If they favor Grace, critics would chastise their decision as influenced by the ads.
    If SC justices disqualify Poe, voters will be confused due to the ads and vent their ire on the justices for injustice and fickle mind.

    Grace Poe forged a pre-emptive move against the SC to put this institution in bad light whatever the outcome is!
    Comelec was the tip of the iceberg. Commissioners are now in disarray.

    Why is Grace Poe doing this?
    To force the Comelec to put Grace name in the ballot since they believe if her name is on the ballot she will either win or damage the chances of Roxas.

    According to cyberspy, Grace and her camp have surrendered to the more than greater chance of possibility that she will be disqualied based on Residency issue. Putting the blame on Comelec for removing her name on the ballot needed extreme measures., the new political ads.

      IMHO, it’s a cheap and ineffective political ads probably concocted by her equally ineffective lawyer-adviser and running mate. Citizenship issue is a question of law while residency is a matter of simple arithmetic based on submitted documents.

      It’s comparable to former selective Justice Secretary Leila De Lima’s ads that project her as “bane of untouchables” and did her job “without fear or favor”
      It’s selective since only 3 opposition senators were charged and incarcerated while 22 other incumbent & former senators on Benhur list (PDI 5/14,2014) were not “touched” due probably to their closeness/party affiliation with PNoy.

        1. Through misappropriation, conversion, misuse, or malversation of public funds or raids on the public treasury;

        2. By receiving, directly or indirectly, any commission, gift, share, percentage, kickbacks or any/or entity in connection with any government contract or project or by reason of the office or position of the public officer concerned;

        3. By the illegal or fraudulent conveyance or disposition of assets belonging to the National government or any of its subdivisions, agencies or instrumentalities or government-owned or controlled corporations and their subsidiaries;

        4. By obtaining, receiving or accepting directly or indirectly any shares of stock, equity or any other form of interest or participation including the promise of future employment in any business enterprise or undertaking;

        5. By establishing agricultural, industrial or commercial monopolies or other combinations and/or implementation of decrees and orders intended to benefit particular persons or special interests; or

        6. By taking undue advantage of official position, authority, relationship, connection or influence to unjustly enrich himself or themselves at the expense and to the damage and prejudice of the Filipino people and the Republic of the Philippines.

        Sec. 2. Definition of the Crime of Plunder; Penalties. – Any public officer who, by himself or in connivance with members of his family, relatives by affinity or consanguinity, business associates, subordinates or other persons, amasses, accumulates or acquires ill-gotten wealth through a combination or series of overt criminal acts as described in Section 1 (d) hereof in the aggregate amount or total value of at least Fifty million pesos (P50,000,000.00) shall be guilty of the crime of plunder and shall be punished by reclusion perpetua to death. Any person who participated with the said public officer in the commission of an offense contributing to the crime of plunder shall likewise be punished for such offense. In the imposition of penalties, the degree of participation and the attendance of mitigating and extenuating circumstances, as provided by the Revised Penal Code, shall be considered by the court. The court shall declare any and all ill-gotten wealth and their interests and other incomes and assets including the properties and shares of stocks derived from the deposit or investment thereof forfeited in favor of the State.         Sec. 3. Competent Court. – Until otherwise provided by law, all prosecutions under this Act shall be within the original jurisdiction of the Sandiganbayan.

Rule of Evidence. – For purposes of establishing the crime of plunder, it shall not be necessary to prove each and every criminal act done by the accused in furtherance of the scheme or conspiracy to amass, accumulate or acquire ill-gotten wealth, it being sufficient to establish beyond reasonable doubt a pattern of overt or criminal acts indicative of the overall unlawful scheme or conspiracy.

          Assuming arguendo that the plunder threshold was not met, still they can be charged for graft and grave misconduct knowing the modus operandi of napoles of non-existing suppliers leading to ghost projects. A recent example is the Ombudsman’s dismissal, forfeitures of benefits and perpetual disqualification from holding public office of former of ex-Occidental Mindoro Mayor Jose Villarosa and his treasurer and accountant for grave misconduct, dishonesty and conduct prejudicial to the best interest of the service (Inquirer.net 1/14/16)

          Benhur’s lists invariably point to billions of pork barrel allocations for senators that napoles cornered and cooked thru non-existing NGOs and the proceeds (kickbacks) divided among them.     The decision of the COMELEC Second Division on the disqualification case against Grace Poe contains the following indisputable facts:
    .

    Per her travel log, Poe used her U.S. passports on:

    July 20, 2007, July 23, 2007, October 31, 2007, October 5, 2008, April 20, 2009, May 21, 2009, July 31, 2009, August 3, 2009, August 15, 2009, December 27, 2009.

    Note that the period July 20, 2007 to July 23, 2007 was a span of 3 days only.
    Note also that the period July 31, 2009 to August 3, 2009 was also a span of 3 days only.

    Those days clearly were not for travels to the U.S. because a round-trip to the U.S. takes two days already. Those were clearly travels to nearby destinations, such as Hong Kong, Singapore, Japan, Taipei, or any nearby foreign destinations.

    Grace Poe may make the argument that she had no choice but use her U.S. passport when traveling to or from the U.S. because she was required by law to use it as a U.S. citizen.

    But when Grace Poe used her U.S. passport to any destination other than the U.S., when she could have used a Philippine passport, then it is an incontrovertible proof that she considered herself domiciled, and in fact she was domiciled, in the U.S. during those times.

    Therefore she could not have been acquired a Philippine domicile for 10-years by the time of this year’s presidential election when she was still U.S. domiciled as recently as 2009, on the basis of her travel records alone.

And I bet that in the immigration card filled up and submitted by GPL to Hongkong authorities, she indicated her residence in the US. I am almost sure she went to Hongkong for shopping purposes because one goes to Tokyo, Taipei, Bangkok, Singapore or KL to tour the place first and to go shopping second. Besides, Hongkong is the nearest of them all from Manila. But I don’t discount the probability of GPL going to Singapore in a short visit for financial and banking purposes.

      “Used” was used as past tense. Meaning that it could be 2006 to 2010 or before July 12, 2011 when her CLN was issued. And I understand GPL had undergone the process in the US embassy in Manila – not in US. BI records show that she departed from the Philippines on December 27, 2009 using US Passport.

      If it is true that she came back using US passport on March 9, 2010, that date would be the last time GPL used her US passport. Because no travel record shows that GPL used her US passport after she renounced her US citizenship on October 20, 2010.

        I can find no need or space for GPL to list her comings and goings to the US on this questionaire and I am sure she would not volunteer the information.
        Perhaps they are referring to another questionaire. They did not state which document was being examined or give the question which she is purported to have answered.
        Come on the Tribune, give us some substantiation.

      In view of the above orders of the SC, I can see SC’s moves proceed as follows taking due consideration of Comelec’s time constraints:

      1. Tackle Residency requirement first which to my non-lawyer mind seems easier to handle.
      1.1 If Residency does not pass, CANCEL the COC for the Presidency; Comelec can then proceed with its work.
      1.2 If Residency does not pass, SC STILL HAS to tackle the NBFC requirement.
      1.2.1 If NBFC passes, Poe REMAINS as a Senator.
      1.2.2 If NBFC does not pass, Poe is DISQUALIFIED as Senator.

        GPL is not a ‘natural born Filipino citizen’ . . . . cannot be qualified as senator per SC ruling.

        She cannot be qualified as candidate for P also per SC ruling.

        The Senate, in the end, will have the bitter pill to swallow and be the one to remove GPL as a senator.

          If the events do follow the route(s) of SC ruling that GPL does not pass the NBFC requirement, your note does complete the picture — the Senate will have to take the bitter pill they earlier refused to swallow.
