Traffic Condition in Metro Manila
Honasan: systematic long term planning. Holistic daw! Walastik naman si Gringo may paholi-holistic pa.
Marcos: Hit Aquino’s administration by criticizing MRT’s woe.
Robredo: public transportation. Statistics that 13% of the roads are used by public transportation tulad ng bus but the majority of roads are used by private transport. Taga-probinysa brand ay iwinagayway! Audience was reminded of Leni’s use of public transport!
Trillanes: Adopt Singapore and Sidney through integrated mass transport system.
Trumpeted Taguig’s system. Pandered the OFWs and hit Abaya on MRT. Two to three years daw ma-dedecongest ang traffic sa Metro Manila.
Escudero: blah blah blah…Watching Escudero is painful for you know thatbhe is just pandering to everybody and so fake…
Walastik!
Robredo: reminded about her initiative in funding PNR for both Bicol and North rail.
Cayetano: continued on pandering to Minadanao voters.
Honasan: blah blah blah…
Leni won this round!

VPs on Political Dynasty
Political Dynasty in relation to corruption was best pointed by Cayetano towards Marcos:
Pati ba naman isang minuto eh nanakawin mo pa?
Everybody except Leni was trying to hide behind the definition of Political Dynasty. The thing is that the minimum definition of dynasty, which is contnuing to be in power from the same elected post or related elected post belongs to Dynasty!
Leni definitely won this round!

VPs take on Human Rights Abuses
The lack of remorse from Bongbong Marcos from Marcos Dictatorship and hidden wealth which was ill-gotten!
Cayetano continued the pressure and hit Marcos with the Human Rights.
Marcos admitting that Philippine Government and Human Rights Victims just validated that the courts found Marcos guilty on their ill-gotten wealth!
Cayetano was belligerent while Leni was firm! They won this round!
Bongbong was the pinata!

Cayetano rocked and the winner in this part of Debate about kurapsyon!
Leni did well on debunking Chiz Escudero in his claim of taking out discretion in PDAF while Escudero was in office. Escudero evaded directly answering her question.
Cayetano will definitely chomp away voters from Marcos and the biggest gainer, while Leni will takeaway from Escudero. With this development Leni will be inching to the top and Cayetano will move-up and bring down Marcos and Escudero. The four will be statistically tied coming end of April!
The casualty of this debate is surely Binay and would bring up Duterte and Roxas due to anti-corruption sentiment of the audience!
Cayetano and Leni won this round while Bongbong lost by knockout in this round!

FAITH is strong belief
Voltaire: Faith consists in believing when it is beyond the power of reason to believe. @Yvonne confirms Voltaire yet should take consolation from Einstein-“The true sign of intelligence is not knowledge but imagination. @Yvonne was creative by motivation to achieve success for Roxas not necessarily to defeat Poe alone.
@vander- I may not share your absolute choice for Poe but share your faith that she is a winner. I also share the CPMERs sentiments that Roxas is the better qualified president while at the same time share the fear of the many that he is a “tough sell”.
Jimmy Dean- ” I cannot change the direction of the wind but I can change the sails of my boat to always reach my destination”
People, backers and supporters, with faith on Roxas are inspired and motivated by their love for a better Philippines. Most probably, they know or understand the difficulty against the wind to steer Roxas, being the boat, but they can’t be blame for trying by redirecting the sails. Surrender is not in their mind while there is still room for fighting. Only when the “fat lady sings” will they accept defeat. And that is human nature.
In consumerism, when the product is faulty, many problems exist to make it a best seller. A movie cast, director and studio promotions may be the best but if the plot stinks it will never be a top grosser. And that’s the problem with Roxas. Something inert within him perceived with “antipathy” by the public. When he talks for a long time, certainly before he ends his speech he will speak a word antagonizing groups of people especially the poor and minorities. His recent gaffe was expressing “yung Muslim takers”.
We also have experienced many times speaking of words that we can only discussed privately then suddenly unintentionally utter them publicly. Being a politician, Roxas should have been extremely careful to avoid such mishap. Undoubtedly, his handlers and counsellors must have scripted him to be careful but at the end of the day it all depends on Roxas. Like basketball in the last seconds of a game winning championship game. The coach can draw the X’s and O’s yet in finality it’s the mentality, capability, creativity of the ball handling player that beats the buzzer of the game.
No Goldilocks, Red Ribbon, Jollibee or McDo strategies could be devised to sell the product. As long as the product is of poor quality, it’s a tough task to become a best seller. Besides being too late for strategies, devising late strategy is similar to cramming in exams. Could be too late to top the exam, no less pass the exam for it depends on the quality of the brain of the examiner.
The buck ends with Roxas! Its Reality.
Faith is inspirational, noble is accepting the truth.

people are already dying everyday from neglect, diseases, loneliness, and there are those that harm and kill themselves, addicted to drugs. there are deaths due to motor vehicle accidents, misadventures and the like.

What the SCORP did as a collegial body (after one original deliberation and another deliberation exhausting the reconsideration motions) was to strike down “gravely abusing in its discretion” Comelec. This is the 9-6 vote. This is the only vote that matters in Poe’s petition. Let us remind ourselves that the SCORP is always passive and remained passive in Poe’s petition.
The SCORP ‘scored’ the Comelec because the Comelec, with limited powers, arrogated the job of the PET unto itself by determining the qualifications of Poe and canceling her COC. The Constitutional sole judge of P and VP electoral contests is the Supreme Court en banc which will transform itself into the independent body–the PET–only AFTER the elections.
Independent body ang PET dahil may sariling budget, staff, etc. which are totally separate from the SCORP budget, staff, etc. (J. Nachura and the collegial SCORP lambasted lawyer Macalintal on this in 2010 and repeated it in 2011).
That’s it…so, “Poe Can Run.” Fin.
—–
The rest of the Portugal Perez Ponencia on Poe may just be “prescient” (in Sereno’s own word) to the ACTUAL VOTING of the PET when the time comes if Puture President Popular Poe will face a disqualification (quo warranto case.
In the present composition of the SCORP the number combinations 7-5-3 (natural-born question) and 7-6-2 (10-year residency question) will matter when the PET will be convened post-election of 9 May 2016.
More on this in the future if time will allow…
For now, I believe it’s still status quo that the Certificate of Foundling hasn’t attained equal effect as the Certificate of Live Birth a natural-born possesses…

They have to transform and be convened first as PET, an independent body with same composition, before they can even tackle the two issues of NBPC and 10YR.
The SCORP tried to be consistent…which they did.

PET, Presidential Electoral Tribunal
NBPC, natural-born Philippine citizenship
10YR, ten-year residency requirement
Rene-Ipil says
To me the SC decision is irrelevant to Poe because she would lose anyway to Duterte big time – NBFC or not, resident or not. From now on COMELEC cannot DQ any senatorial or congressional candidate by virtue of her ineligibility due to citizenship and residency. Several SC decisions on this aspect are now overturned. COMELEC cannot DQ them anymore. Only the SET or HRET can do that.

Supreme Court en banc (Full bench, 15 Justices present)
SC en banc, 15 justices, only voted on the ‘Issue of whether to grant or dismiss the consolidated petitions’. Read Page 5 of SC SAJ A Carpio’s document for a simplified explanation.
Nasaan ang mayoryang Ocho, Ocho?
The March 8 decision, as Senior Associate Justice Antonio Carpio has revealed, that a majority of eight Justices did not vote in support of Mrs. Llamanzares’ claim that she is a natural-born citizen and a resident of the country for at least 10 years immediately preceding the May 9 elections.
In summary, there was NO votes counted in an en banc, full bench Supreme Court session. Not All SC Justices wrote their own opinions for:
Justices Opinions On Her 10 Year Residency Issue;
– Seven expressed opinions in support of GPL’s claim,
– Six expressed opinions NOT supporting GPL’s claim, and
– Two did not express for or against on the appointed date.
Justices Opinions On Her Natural-born Filipino Citizenship Issue;
– Seven expressed opinions in support of GPL’s claim,
– Five expressed opinions NOT in support GPL’s claim, and
– Three did not express for or against on the appointed date.
From the SC website, Concurring Opinion of Justice Bersamin is missing (as of 11 April 2016).
Who can discipline SC CJ Sereno for her ‘egregious error.’?
Didn’t she mislead the public? Is it enough to impeach CJ Sereno for an ‘egregious error.’?
Original Petitioner GPL is made to believe that her Citizenship and Residency issues have been decided for her to lawfully run as a “qualified” candidate for President this 9 May 2016.

When analyzing complicated issues in politics, always ask why was it done that way and who benefits? for the rest are just justifications of the purpose.

Then, go, search and ask where Butch Abad is.

Kasalanan lang din bah niya? There allies benefited from non GA aligned funds as pork largesse.
Parekoy says
Abad is more secured than Aquino.
Abad has all the evidence since his department of Budget is the one keeping the records of disbursements. kalakaran na rin kasi na bago i-release ng DBM eh may kaltas na dyan si Abad.
Mel says
blah blah blah…
the buck stops with whom?
Sa istorya mo, Noy just wants sort of a peace of mind that a crim complaint is thrown out when filed.
The second branch, lone justice insti has been compromised with his ‘egregious’ appointees. Even the current SolGen lacks principles. IMHO, both his stooges & buddies needs to be replaced, dethroned for the likes of CC Lim, SC Js de Castro or SJ AJ Carpio.

Eto nga binabasa ko, sabi dito sa dokumento, “Teodoro Llamanzares, spouse of the grantee herein hereby grants to Mary Grace Poe Llamanzares, a married woman as her sole and separate property”….blah…blah….

I fully concur Yves ?
Rene-Ipil says
Yvonne and Victin,
Makisingit lang. Our laws prohibit donation by spouse to one another. Article 87 of Family Code provides:
“Art. 87. Every donation or grant of gratuitous advantage, direct or indirect, between the spouses during the marriage shall be void, except moderate gifts which the spouses may give each other on the occasion of any family rejoicing. The prohibition shall also apply to persons living together as husband and wife without a valid marriage. (133a)”
The rationale according to famcode.blogspot.com:
“Donations between spouses during marriage are prohibited. And this is so because if transfers or conveyances between spouses were allowed during marriage, that would destroy the system of conjugal partnership, a basic policy in civil law. It was also designed to prevent the exercise of undue influence by one spouse over the other, as well as to protect the institution of marriage, which is the cornerstone of family law. (Ching vs. Goyanko, Jr., G.R. No. 165879, November 10, 2006)”
Victinluz says
[email protected] ,,, kung ganoon that amount given by Neil and Susan to Grace was a sort of contribution’s, that can be deducted to the whole portion of the conjugal partnership.Ganoon po ba?
Rene-Ipil says
To be deducted on the conjugal share of Grace. For example, if the conjugal property(CP) is worth P100M and Neil donated 10M to Grace. Now, Grace owns 60M and Neil owns 40M. Upon death of Grace the 10M would be restored to Neil’s share. Neil retains his 50M. Neil and their three children divide 50M among themselves as compulsory heirs in equal parts or 12.25M each. Consequently, Neil gets a total of 62.25M upon Grace’s death. 50M as share of the CP; 12.25 as heir.

Sorry but I cannot, in good conscience, support a Poe-Escudero-Coquangco triumvirate.
A few CPMers may want to shot the messenger, instead of the message, but I’m not a candidate here so shooting the messenger is not going to help their candidate.
I remember someone even posting that Poe isn’t his first choice for president but he is reluctantly supporting Poe because he doesn’t want Binay to win, implying that he is simply just an anti-Binay.
Now that Binay is down in the surveys his tune has changed – he doesn’t want Poe to be criticized because that would be helping Duterte. The chameleon has change colors again.

Goldilocks Strategy- the secret of Roxas’ Victory!
There is a Goldilocks Principle that is quite complicated if applied to game theory involving multi-players.
When we went for a vacation in Boston while my kids were taking enrichment classes in MIT, I happened to notice this Goldilocks Strategy when my kid joined a multi-player videogame tournament in Boston and he applied this strategy. If he fought head-on against the other players, the odds that one of his opponents might land him a lethal blow was quite high, thus he employed this Goldilocks Strategy that he only fought selectively and engage the weak ones first and avoid directly fighting the stronger players and he let them annihilate each other first, until few players remain in the race. Then he inreased his odds when only few players were left and he picked them one by one! He won despite the younges, only in high school and he was fighting the college kids from Boston! He won $250 beating 20 others gamers!
When I talked to Roxas Camp insider, he told me that Roxas did not trust this strategy at first. He wanted Poe eliminated by Aquino thru SC, but their internal commissioned surveys showed that Duterte and Binay would benefit from Poe’s supporters and would place Roxas in a more uphill battle. Drilon agreed with employing the Goldilocks Strategy in order to increase Roxas’ chances of winning the presidency. Roxas was and still skeptic for in order to apply this strategy, the executiin is quite complicated. This might also be a ploy of Aquino to be in good graces of Poe to hurdle his DAP case, if the strategy for Roxas don’t materialized, thus Aquino is in win-win situation!
In order for Roxas to win, Poe should be in the race. The plan is quite intricate and should be well executed in terms of timing and degree of demolition.
Here are the main elements in order for Roxas to win:
1. LP needs to keep their ranks intact and Prevent exodus.
2. LP needs to have plenty of feedbacks on polling and Roxas should not drop below 20% and inches his way to statistical tie.
3. There should be a concerted effort, though unplanned, among Binay, Duterte and Roxas to criticize Poe in order to convert some percentage of her supporters but just enough that won’t make Binay and Duterte strong enough to benefit from the transfer of would be votes for Poe.
4. If Binay and/or Duterte gain/s, LP should put out more negative ads against the two. The levers of power of Aquino should be employed from AMLA against Binay and Human Rights Watch and Dept of Justice run after Duterte by harping on Duterte’s complicity in Davao Death Squads and paints Duterte as a thug that he is, a would be dictator, and scares the shit out of the families of the OFWs who support Duterte. Binay is an easy problem for Binay’s name is already tarnished, but LP would like to control the degree so that Poe’s loss will be spread among Binay and Duterte equally and some are Roxas’ gain, but just right!
5. Nuclear option is available for Roxas and Hocus PCOS will do some magic just right that the result of the 2016 elections is just right that it agrees wth the manufactured publicly publshed surveys.
If you have kids or grandkids who are avid videogamers, they will understand the logic of this complicated strategy!
Extreme caution should be exercised by Roxas’ Camp, lest Papa Bear, Mama Bear, and Baby Bear will rip them to shreds and make their torn flesh as main ingredient into soup they are making that is just right for their taste!
I could have kept this to myself but I need to share this to CPM so that Roxas supporters should not throw the towel and remain steadfast for Roxas-Robredo. This info will also validate why Aquino was supporting Poe to hurdle SC and why Roxas Camp is confident that they will win!

Can a candidate file a successful PROTEST against the vote counts-RESULTS by those PCOS machines?
. . . no.
How long or short a period of time to FIND that the MACHINES gave FALSE count-results? ! 1 year? 2 years? 3 years?
But can anybody declare the MACHINES did not truthfully count-result the VOTES? What are those MACHINES for if not to BELIEVE that MACHINES Do Not Lie.
If it cannot be finally settled about POE’s citizenship and residency STATUS, how will ANYBODY declare to DISPROVE that these MACHINES will TELL it in the FUTURE?
. . . no one.
Which is EASIER to manipulate HUMANS or MACHINES? Both can be manipulated BUT machines are easier.
Now, with these MACHINES the results will be very much faster than the OLD MANUAL counting in 3-4 Weeks time. The MACHINES will TELL in fast due time.

Let us look. . . for anything here in these cases of Poe vs Who Opposes Poe –
Poe wins before the SC. Comelec/et.al. loses. The latter gravely abused its discretion and/or is without jurisdiction.
COMELEC Powers and functions:
. . . (2) Exercise exclusive original jurisdiction over all contests relating to the elections, returns, and qualifications of all elective regional, provincial, and city officials, and appellate jurisdiction over all contests involving elective municipal officials decided by trial courts of general jurisdiction, or involving elective barangay officials decided by trial courts of limited jurisdiction.
(C. The Commission on Elections, SECTION 2, Art. IX Constitutional Commissions, 1987 Constitution.)
. . . and “and qualifications“. . .’All elective regional, provincial, and city officials’. . . Does this include ‘National Officials’ who are ‘candidates for President and Vice President? How about ‘for senator’? Ar they outside of the Comelec’s jurisdiction? Members of the Lower House?
If it does not so include, who then or what OFFICE/Department has jurisdiction on QUALIFICATIONS for President or Vice President?
Art. VIII, SEC. 4 (Par. 7). . . The Supreme Court, sitting en banc, shall be the sole judge of all contests relating to the election, returns, and qualifications of the President or Vice- President, and may promulgate its rules for the purpose.
So, Art. VIII SEC. 4, Paragraph 7 – states that the SC ‘shall be the SOLE JUDGE’ for ‘all contests relating to the election, return, and QUALIFICATIONS of the President or Vice President. [ Presidential Electoral Tribunal – PET]
But PET is not yet here in the Poe cases. When candidate POE wins, it might be at the PET tribunal.
Now, the problem is at the POE cases vs Comelec and Who Opposes, the ruling is questioned. . . is there a majority of 8 of the 15? Or a majority of 7 vs. 5 (or 6)?
On the MR by those Who Opposes POE, came out another – a majority of 9 vs 5 (or 6) but counting the votes who voted that POE is NBFC is only still the same – 7 votes and not 8 votes.
Minority justices argue ‘there is still no 8 votes.’ CJ answers ‘There are already 9 votes on the MR. The Decision (by the 7 votes) still STANDS.’
Minority justices says ‘POE’s qualifications is hanging’ until then. CJ says ‘Let a quo warranto case be filed in due time when POE wins. What does this mean? That POE’s citizenship and residency qualifications is not yet settled?
The next important QUESTION this country will probably face: In any future case before the SC, will the ‘ruling’ of SEVEN (7) votes stand as a majority ruling if there are only 5 against in every important SC case or cases?
CJ says ‘To change or reverse the ruling in the POE cases will be telling’ in the near future.
Just suppose that a clear 8 votes TELLS in any other case at the SC (not necessarily the POE cases) is ‘the ruling’ (and not a SEVEN (7) votes), which is the ‘majority’ now? If it is the POE cases, will the present ‘majority’ accede that it is ‘the 8 votes as majority that carries the voting on the case or cases?
I find this discussion of mine into a MESSY FIELD.
From the sources reported, the POE is not yet clearly settled that she is a NBFC and with 10 years residency. Acc to the CJ . . . ‘It will TELL’ in the future, and
In the meantime, LET THE VOTERS/people DECIDE.
So, anyone whose qualifications and residency are in ISSUE can be a candidate for P or for VP. Comelec has NO JURISDICTION to rule on these MATTERS. Only the Supreme Court can.
The problem, whether REAL or not, is the questionable candidate who is the winner WILL seat as President or as Vice President, as the case maybe, for SIX YEARS.
Many things will or can happen during those Six Years while a Quo Warranto case is pending at the SC. And during that period of TIME, the sitting President, for that matter, may be APPOINTING new justices for the SC.
The issue or issues that the ‘sitting President’ is not qualified to be President will or can be LOST in limbo with a ‘7 or 8 strong newly appointed justices’ at the Court by such President.
And such person as President CONTINUES to govern the Nation in the MEANTIME for Six Years.
This MESS will TELL in the future.
In the meantime, cast your VOTE. Ako, I will vote for RORO so as to AVOID that mess to tell me in the FUTURE.
Let Me Decide.

The 8 March 2016 Portugal Perez Ponencia on Poe (4Ps) decision stands.
Was there a material misrepresentation on the part of Poe when she alleged she is a natural-born Philippine citizen?
The answer is NO.
It is because the Supreme Court of the Republic of the Philippines (SCORP) as a collegial body doesn’t even know if foundlings are truly natural-borns.
Only seven (7) of the magistrates think Poe is a natural-born Philippine citizen (7-5-3 warm body count).
The magic number is eight (8), that is, if they ACTUALLY VOTED upon this first issue…which the SCORP did not do.
Was there a material misrepresentation on the part of Poe when she alleged she has more than 10-year residency in the Philippines immediately preceding the 9 May 2016 elections?
The answer is NO.
It is because the Supreme Court of the Republic of the Philippines (SCORP) as a collegial body doesn’t even know if Poe has at least 10 years of residency in the Philippines immediately preceding the 9 May 2016 elections.
Only seven (7) of the magistrates think Poe has at least 10 years of residency (7-6-2 warm body count).
The magic number is eight (8), that is, if they ACTUALLY VOTED upon this second issue…which the SCORP did not do.
On April 9, there was/were no additional member/s to the SCORP’s ‘Natural-born and 10-year-residency Seven’ to further galvanize the material non-misrepresentation. Nonetheless, the final decision will suffice in order for the SCORP to readily say “Poe Can Run” by a count of NINE (9) votes…the vote they ACTUALLY DID.

May Poe also win the Presidential Electoral Tribunal (PET) Quo warranto case…
The question is will Puture President Popular Poe (another 4Ps) be able to hurdle the disqualification case before Perez and Brion retires in December 2016???
I guess she must have to wait the time when she’s already able to Pack The Court with two (2) more of her allies in order to cement her win as a natural-born Philippine citizen with at least 10 years residency here in our beloved Philippines.
For anti-Poe…

GRACE POE VIOLATED THE OMNIBUS ELECTION CODE
AND FACES DISQUALIFICATION FROM HOLDING PUBLIC OFFICE
.
The Omnibus Election Code of the Philippines prohibits any person from soliciting or receiving any contribution for partisan political activity from any foreigners. The pertinent provisions of the Election Code are Section 95 (h), Section 96, and Section 264, to wit:
Sec. 95. Prohibited contributions. – No contribution for purposes of partisan political activity shall be made directly or indirectly by any of the following:
(h) Foreigners and foreign corporations.
Sec. 96. Soliciting or receiving contributions from foreign sources. – It shall be unlawful for any person, including a political party or public or private entity to solicit or receive, directly or indirectly, any aid or contribution of whatever form or nature from any foreign national, government or entity for the purposes of influencing the results of the election.
Sec. 264. Penalties. – Any person found guilty of any election offense under this Code shall be punished with imprisonment of not less than one year but not more than six years and shall not be subject to probation. In addition, the guilty party shall be sentenced to suffer disqualification to hold public office and deprivation of the right of suffrage. If he is a foreigner, he shall be sentenced to deportation which shall be enforced after the prison term has been served. Any political party found guilty shall be sentenced to pay a fine of not less than ten thousand pesos, which shall be imposed upon such party after criminal action has been instituted in which their corresponding officials have been found guilty.
STATEMENT OF ELECTION CONTRIBUTIONS AND EXPENDITURES (SOCE)
In her statement of contributions (SOCE) filed with the COMELEC covering her 2013 senatorial campaign, Grace Poe declared that she received monetary contributions from her husband Teodoro Llamanzares amounting to millions of pesos. Her SOCE can be viewed and downloaded from the COMELEC web site but it is temporarily unavailable. (I will provide a direct link later.) According to news reports, access to the site is currently severely limited by the COMELEC to protect vital voters personal information because of the recent hacking of its web site.
To those who are in a hurry and cannot wait for the COMELEC link to become accessible again, here is what the PCIJ.ORG investigative news report has to say:
“Two of Grace Poe’s closest relatives, husband Teodoro ‘Neil’ V. Llamanzares and mother Jesusa S. Poe (also known as the veteran actress Susan Roces), donated P21.4 million to her campaign.”
The PCIJ report also states that Teodoro Llamanzares contributed P1.99 million to the ‘The Friends of Grace Poe Foundation’ registered with the Securities and Exchange Commission just three days after the official campaign period began on Feb. 12, 2013.
(I will provide the link to the PCIJ.ORG report later; I will include all links in a separate post to avoid this article from going into blog moderation.)
Thus, there are already some documentary evidence in the posession of the COMELEC, that are of public records, that husband Teodoro Llamanzares provided large sums of monetary contributions, and that Grace Poe accepted those contributions, to the Grace Poe 2013 senatorial campaign.
TEODORO LLAMANZARES IS AN AMERICAN CITIZEN
In her U.S. Federal Form DS-4079, on page 4 of the Questionaire, in answer to Question No. 8, Grace Poe declared: “Though my family and I now reside in the Philippines, my husband and I continue and will continue to file both Federal and State taxes in the U.S. since MY HUSBAND IS A U.S. CITIZEN.” (The capitalization is mine for emphasis.) Her Form DS-4079 was subscribed and sworn to before a U.S. consular officer on July 12, 2011.
In her verified response to the SET disqualification case filed against her, Grace Poe also declared that her husband has been a U.S. citizen since birth.
Teodoro Llamanzares, by virtue of his being a U.S. citizen, is prohibited by the Election Code from contributing to Grace Poe’s senatorial campaign, and Grace is likewise prohibited from accepting the contributions. Her acceptance of those contributions are clear violation of the Election Code and is sufficient ground for her disqualification from holding public office.
PRECEDENT-SETTING CASE WITH THE COMELEC
The issue of Election Code violation emanating from the acceptance of contributions from foreigners is not to be taken lightly. There is already a precedent-setting case pending with the COMELEC seeking the disqualification of an elected official for allegedly receiving contributions from U.S. citizens, including from dual-citizens. According to a lawyer familiar with the case, the Election Code prohibition also covers dual-citizens. The words “any foreigners” is all inclusive and includes foreigners who have local citizenship component, like the dual-citizens. The COMELEC has no decision yet on this case but it is expected that any decision it renders will eventually be elevated to the Supreme Court.
I now expect that if Grace Poe were elected President the losing presidential candidate with the second highest number of votes, and the Vice-president-elect, would seek to disqualify her from assuming the presidency on charges that she violated the Election Code – charges that could ultimately reach the Supreme Court for a landmark decision. The chance to become the next President is so tempting that Grace’s political opponents would not let the chance to unseat her to pass by without them trying to exploit it by all means.
There is sufficient direct evidence that Grace Poe accepted monetary contributions from her husband Teodoro Llamanzares who is a U.S. citizen. There is no denying about the facts of the contributions and the U.S. citizenship of Teodoro. The contributions are clearly made and accepted in violation of the Election Code and is punishable by Grace’s disqualification from public office. The only remaining issue is whether her husband Teodoro, by virtue of his being a dual-citizen, is exempted from the prohibition – but that is for Grace Poe to defend in a court of law and it would be a very tall order indeed.
Grace Poe’s most likely defense is that her husband is both an American and a Filipino citizen, and as a Filipino he is not covered by the Election Code prohibition. Clearly the burden of proof is on her to show that dual-citizens are legally exempted from the prohibition. But there is no such expressed exemption anywhere, and the absence of such exemption is now used as the legal basis of a disqualification case now pending in the COMELEC.
Her opponents’ very strong argument is that the words “any foreigners” are inclusive to all foreigners including foreigners with a Filipino nationality component – the two nationality components in a person with dual-citizenship cannot be considered as separated by mere assumption; there must be a clear and expressed declaration of exemption for dual citizens from the prohibition. But there is none.
Furthermore, the anti-Poe forces can also anchor their argument on the Constitutional declaration in Article IV, Section 5 stating that “Dual allegiance of citizens is inimical to the national interest and shall be dealt with by law.” The phrase “shall be dealt with by law” is to be construed or interpreted to mean that in case of conflict, the law is to be interpreted liberally against the benefit derived from dual allegiance, or dual citizenship, as the Constitution clearly abhors such duality or split. Based on this constitutional declaration, Grace Poe’s position would indeed be precarious if the Supreme Court would decide strictly on constitutional basis, and not on any political accomodations or considerations.
POE’S ELECTION AS PRESIDENT WILL THROW THE COUNTRY INTO CHAOS AND POSSIBLE CONSTITUTIONAL CRISES
I have not seen in recent years a political candidate that caused, and continue to cause, so much divisiveness among the Filipino people during an election – from issues of natural-born citizenship, residency, loyalty to the country, preparedness of governance, Americans occupying Malacanang, and now that of violation of the Election Code.
It is disheartening to see that the arms of our government were thrust against each other – the SET, the COMELEC, the office of the Solicitor General and the Supreme Court – and that of the people at large – just because of the political ambition of one person who has not really done much for the country to warrant such extra-ordinary accommodation. It shows the extra-ordinary clout of powerful politicians and oligarchs who bankroll her candidacy.
If Grace Poe were elected President, she would be elected by plurality, not by majority, of votes. Since many people believe that she received special, but unfair, accommodation from the highly politicized Supreme Court there would be no stopping her political opponents from exploiting the situation and formenting turmoil to destabilized her administration.
Some political leaders could refuse outright to recognize her as duly elected. And what if the Supreme Court decided that she was disqualified from holding office for Election Code violation and she refused to vacate her position, then what? Are we ready yet for another constitutional crises? Maybe that would be too extreme to think of. Maybe, just maybe.
Indeed, the most pressing issue confronting the Filipino voters today is whether they will choose to elect chaos and uncertainty over continuity and stability in the government. The choice is ours!

I attended a forum at UP-NCPAG last March 16, 2016 – Pitaka at Pulitika (PIPUL) and the speaker was very specific that contributions from a foreigner, even if a relative of the candidate, is a violation of the election laws. One of the forms that must be complied by a candidate or the party as a witholding agent is the monthly remittance return of creditable income taxes withheld (expanded). All expenses should be reflected in BIR form 1601-E to be submitted on or before the 10th day of the following month.
if the declarant is truthful, dito makikita mga election expenses whether from personal funds or from contributions.

Another source of information should be the SOCE or statement of contributions and expenditures, filed at the Campaign Finance Office of Comelec.

Is Teodoro Misael Daniel “Niel” Vera Llamanzares essentially, strictly, technically, reliably, effectively a dual citizen by birth (NATURAL-BORN PHILIPPINE CITIZEN BORN IN THE U.S. OF A. WHOSE BIRTH IS DULY REGISTERED AND WITH CORRESPONDING PHILIPPINE DOCUMENTARY EVIDENCE)???

Nice Spin, but…
Pinning Poe through legal acrobatics will not work!
I’m not supporting Poe but campaign contribution laws in the Philippines are murky as the esteros of the Pasig River.
To end this wild goose chase and not further inflate Poe’s popularity, Neil Llamanzares as husband and having dual citizenship has every right to contribute to his wife’s campaign! Neil’s campaign contributions are perfectly legal in the murky laws of the Philippines.
If SC could magically made it appear that Poe is qualified to run for the presidency, which is more intricate, complicated, and enormous improbability, then Neil’s campaign contribution is just a walk in the park.
The best way to erode Poe’s popularity is to show how uncommitted she is by having a fallback to go back to the US and be American again, once she becomes unsuccessful in her bid for the presidency. She should be portrayed as the most opportunistic presidential candidate Philipoines ever had!
Poe might not be corrupt, money-wise, but she is guilty of corrupting the entire Supreme Court and making a joke of our constitution, just for the sake of her messiah complex.
I appreciate your effort for trying, but I have a nose for this thing and the stench of this ploy is so odious which makes Poe’s malodorous opportunistic run for the Presidency seems a whiff of a very expensive perfume.
There are other ways to convert Poe’s supporters to transfer to Roxas but this one has the opposite effect and would surely make them more loyal to Poe.

@Parekoy..i respectfully submit to your wisdom.
the more we file complaints on poe’s qualifications and capabilities the more sympathy poe gets from her supporters and possibly from the “undecided” voters. enough is enough about all this brouhaha. the most respected SC has reiterated (9-6) with finality poe’s candidacy.
we have heard & learned enough of this thing. and i guess only a miracle could reverse the progress of hers.
there’s only 1 thing i learned and am convince about is her tenacity to claim that she is truthful to all these things and she proves that she is indeed determined to pursue her ambition to be the next president of the country no matter what it takes.
in the eyes of those who see it otherwise which i admit am one of them could just exclaimed in awe, disgust and exasperation. uncertainty is what lies ahead of this country when she gets victorious comes may 9 elections. God forbids!
her tendency to extemporaneously defend herself of all the deceptions she made is very alarming. plus the perseverance she showed have earned her the empathy of the many. she is “d king II”!
shrewdness behind that angelic gracious smile…..

IMHO, whatever money that comes into their union is considered conjugal property unless Neil got it before their marriage. When grace married Neil, he was serving in the US Air Force for one 4-year term, and therefore not earning much. Where would he get the P1.99 million he contributed to the campaign kitty of his wife in 2013?
This may add to grace woes if the money is not reflected in her SALNs similar to renato corona’s agony – and her opponents may scrutinize minutely her SOCE vis-a-vis her SALNs

I heard about that, too.
If Leni Robredo, and as you added below Mar Roxas also, accepted political contributions from foreigners then by all means they should be prosecuted also. Let there be a level playing field for everybody.
What I mentioned in my post are subscribed and sworn to documentary evidence, already in the possession of relevant government agencies, confirming the contribution and the foreign nationality of the contributor.
I just hope those who claim Leni and Mar to have violated the Election Code also present such acceptable authenticated documentary evidence. Because the last time I heard, the accusation against Leni was based on postings from Facebook. And I have not heard anything about Mar.

“A few weeks before martial law was declared, a dying man had been brought to the Veterans Memorial Hospital in suburban Manila. He was a frail figure in late middle-age, with face that mirrored pain from a massive brain tumor. Although his manner was aristocratic, he did not look wealthy. His wife and children crowded in the little room where he waited for the end to come. He called his wife to come closer and whispered his last wish. The man was Norberto Romualdez Jr., the former governor of leyte, and Imelda’s nemesis. Before his death in pitiful circumstances, he asked his wife, Rosa, to bury him in Leyte where he had served as governor before Imelda forced him out. It would be his last card in the continuing saga of the Romualdez family rivalry.
The hapless widow to whom he had entrusted this task lacked even the money to pay the huge sixty-thousand-pesos hospital bill to claim his body, let alone to pay for transporting him to Leyte. There had been no money since he’d become ill a long time before, and Imelda’s promises that he would be given an honorable job in exchange for giving up the governorship were never fulfilled. In fact, he had been given an obscure clerical job in Manila and was forced to leave his big family behind in Leyte to make ends meet. With Filipinos, as with most Orientals, a dying man’s wish cannot be denied. Norberto’s wife had no one she could turn to but Imelda and Benjamin. After all, the widow reasoned, if Imelda could dispatch a plane to bring Norberto to Manila, she could as easily provide the plane that would take his body home. She also hoped to get a loan from Imelda to cover the hospital bill. She felt that a loan from Imelda would be small compensation for what her husband had given up. Severed from Leyte, Norberto had become increasingly despondent, before his death he was all but a broken man.
Rosa thought that Imelda would consider the sacrifice he had made, but her pleas were met with only scorn and venom. “Why does he need to be buried in Leyte? He is nobody in Leyte. What is wrong with Manila? Bury him here, in any corner” was Imelda’s reply. Times had changed their fortunes, and Imelda was been on exacting her last ounce of revenge.
Norberto’s widow took the humiliation, hopeful that Imelda would at least accede to her request for a loan so she could claim her husband’s body. This too, was denied with a toreent of insults. Face with Imelda’s intransigence, Rosa begged and borrowed from friends until she had twenty thousand pesos and pleaded with the hospital to release Norberto’s body on part payment. His last wish still remained: to be buried in Leyte. In desperation Norberto’s widow sought an unlikely benefactor — Senator Benigno Aquino, chairman of the Liberal Party, to which her husband had belonged, and the Marcoses’ mortal enemy. Although surprised that Rosa was unable to get Imelda’s help, Aquino generously offered his personal plane.
On the day of the funeral, officials and townsfolk in Leyte prepared a hero’s welcome for their former governor, much to the consternation of Imelda’s brother Benjamin, the incumbent governor. Benjamin, in fact, had tried desperately to keep the crowds away by making false radio broadcasts as to the funeral schedule. When Imelda learned that Aquino would frustrate her last act of revenge against her cousin, she became fearful that he would use the incident as political propaganda. Accordingly, she quickly informed her cousin’s widow that she and the President would preside over Norberto’s funeral services. The widow was stopped from boarding the plane, but she curtly refused Imelda’s attempts to honor her husband. Thus was Norberto Romualdez Jr. buried under the blazing sun of Leyte, as his father had been — all through the intercession of the hated Benigno Aquino Jr.
Four years later Imelda would call her cousins to Malacañang to recall Norberto’s death and funeral. To Loreto’s surprise, Imelda was in tears and asked them why they hated her so. Unable to understand what she meant by posing now as the offended party, Loreto pressed her to explain. Imelda replied, “They” — referring to Norberto’s wife, Rosa, and her children — “were willing to run over me, just so the plane could take off”. This was Imelda’s astonishing version of the day Norberto was returned to be buried in Leyte.
But her brother Benjamin was more candid. Through the Romualdez grapevine the family learned why he and Imelda would not help Norberto’s widow. “They, too, must suffer the way we have suffered.”

Diary of Francis Burton Harrison April 9, 1936
Interview with Johnson who has been here since ’99 and was an agent for Governor Frank Carpenter whom we discussed–he said Carpenter was a public servant thru and thru and perfectly coldblooded; knew everything that was going on from his agents and especially from Filipina women. Said the only way for a white man to succeed down here was by keeping active every day. Most of the fifty Americans who had settled in Zamboanga Province had gone in for loafing and booze, and lived on their Filipina wives. He was broke when in 1932 copra went down and he was left with nothing but debts–subsequently, he paid them all off and last year was assessed for the largest income tax in the Province, on an income of 50,400 pesos. It came from dealing in cutch and copra, and from stevedoring and automobile agencies. He remarked that the Chinese down here come as coolies, get a little tienda at some cross-roads and in ten years own all the property around–they plant nothing and create nothing–send to China for their “sons” (made by parcel post)! The Japanese on the other hand created plantations and improved and developed the country, and lived like highly civilized beings with all the modern conveniences. He greatly preferred the latter.

Diary of Felipe Buencamino III April 8, 1942 (April 8-9)
After the general heard my report, I took the field telephone and asked for Bat 108 –Manny’s code name in Corregidor. “What’s up, Primo?” he asked. I said: “the line in the east sector won’t hold. By tonight, the Japs will be here. Tell Leonie to stay there.” Manny didn’t believe me, but I was in no mood to argue… so I said: “So long, Primo… If I get home first… I’ll tell the folks you’re O.K.” Ten minutes later, the field phone rang again. I thought it was Leonie… but I was wrong. It was Oscar. “Say, Phil,” he said… “this is the end. I’m in Kilometer 165.5 with all my troops. Where shall I go?” Oscar sounded serious… in fact, nervous. I knew what had happened. The Japs had already broken through and there was general disorganization. The reserve lines had also probably been captured. It was as Oscar said “the end.” I told Oscar to retreat to kilometer 182.2 near Mariveles… because all Filipino troops were going there. “We better stick together,” I explained, “because the Japs might give us better treatment.” Oscar didn’t answer immediately… then he said, “O.K. kid… I’ll bring my men there. Good luck… and if you see Ramon… tell the old fellow not to be nervous.” That was just like Oscar… joking at a serious moment. For all his carefree, devil-may-care attitude… we needed more men like him in Bataan. To begin with… he had no business volunteering. But he did. General Valdes told him he would be a fool to leave his wife and two-day-old baby. But he did… and he told me one evening: “Phil… if I don’t ever get home… tell my kid why I fought. Tell him… I wanted him to be able to tell the other boys… ‘My father fought for his country.’”
