To commemorate Philippine Independence Day, 15 Filipino youth volunteers and one US national volunteer sailed to Scarborough Shoal yesterday. We reached Bajo de Masinloc at 7:30this morning.
Our fishing boat was initially intercepted by two Chinese coast guard speed boats. After a few minutes, the mother ship and two big boats arrived. They ordered us to go back to the Philippines. The standoff lasted for four hours.
At 11 AM, five of us attempted to swim to the rock to plant the Philippine flag and United Nations flag but they harassed us. They chased us with their two speed boats and blocked our path, sprayed water on us using the propeller of the boat. The harassment was caught on video, this lasted for an hour.
Two of the swimmers however were able to reach the ring of the shoal and raised the Philippine flag.
At 12:30 noon time, we decided to leave the area. The Chinese coast guard mother ship escorted our boat out. We are on our way back to Masinloc, Zambales. Expected time of arrival is 3 am tomorrow.

By this time, many farmers have already gone to their graves and the list of farmers who are supposed to receive their return of investment like my family, would have lost these coupons or investment papers that most farmers considered worthless after sometime. Which should Pres.-elect Duterte choose?
On No. 1 is faster, unlimited (as long as within the laws) and making it effective. Could be abused though.
On No. 2, tackle and debate muna to make it longer with months of delays. Put chains around new Adm. Could also be abused.
What is the goal? Take down and eliminate Abu Sayaff without unnecessary delay. Risks in both choices exists.

Oath taking of the highest government officials is a patriotic duty to the country and people. It should be administered by the highest recognizable authority in government. Since oath taking Legalitimizes the acceptance of the honor to serve the country; tradition dictated that the Chief Justice of the Supreme Court or if incapacitated its equivalent authority or subordinate must perform the swearing in except in cases of emergency like swearing the Vice President upon demise of incumbent president.
FILIPINOS are full of dramas and telenovelas. For different reasons, some presidents and Vice Presidents swear to an authority to add dramatic flair to their inauguration, whatever their motives mean. Arroyo hastily sworn 2 times, when she took over Estrada and in the eerie morning hours in the Comelec tabulation center after winning in 2004 by cheating, according to Poe’s camp.
Cory Aquino was also sworn in swiftly upon takeover from Marcos by her impending CJ, then Associate Justice Teehankee. Similarly Ramos and Estrada were sworn in by no less than Chief Justice Narvasa. Noynoy was sworn in by another Asociate Justice Carpio Morales for the simple reason he did not recognize Corona as CJ. In All presidential and vice presidential oath taking times the Vice President was sworn in the same ceremony.
Except this time! Duterte does not want to have joint inaugural ceremony with VP elect Leni Robredo. Not surprising, considering that the 38% of the voters elected this “whacko”. Why he tries to be different on traditions is not surprising? His many decisions so far have been disgusting despite his motivation on excluding Robredo in the ceremony and her no cabinet appointment remains unrevealed. Qualified as a government official this barangay chairman might be but his inclusion in the historic win of Robredo in a tight VP contest is NO LONGER NECESSARY. Nothing has to be proven on the love of Leni of the poor and her humble virtue. By going thru this telenovela plot, Leni is trekking the psychopathic highway of Duterte. Leni is stooping to Duterte’s mental level. She should reconsider her decision and take the high road, expected of her by the people. Although, we should not be surprised because she was still insisting to commute by bus from Manila to Naga. Again, What was she trying to prove on the bus ride, now that she is going to be Vice President of the country? Seriously!

I think, that’s leni’s gift to the poor, her swearing to the barangay captain of one of the poorest place in our country, and so, honor the poor. the rich are already spoiled and if she swears to a famous magistrates and other influential bigwigs, they’ll prob’ly just take it for granted. they’ve already sworn in so many high profilers before, the act of swearing may mean nothing to them anymore. but for the poor barangay captain, this means a lot: a once in a lifetime happening and something to be proud of. barangay captain will be able to tell his children and they in return will tell their children’s children that once in a while some rain has fallen. that their grandfather/great grandfather has the honor of receiving the oath of the vice president.
leni is pro-poor and her advocacies are mostly for the poor. she has not been corrupted, some day she will, but that day is not today.

In 2010, Aquino contemplated taking his oath with a barangay chairman of. Tarlac. After so much deep thoughts and professional advice, the idea was shelved. One main reason was that a barangay captain has limited jurisdiction on official powers, that is the authority is confined in the barangay locale.
Will Leni swear in the barangay in Camarines Sur to lend full authenticity in her oath taking officiated by her chosen Barangay captain?

A parish priest cannot officiate official wedding of his parishioners outside of his parish without getting consent and authorization of the archdiocese of the wedding site. Parishes would not allow the officiating of the outside priest without participation of another priest with authority in the locale so that the wedding license of the official act will come from the parish site of the wedding. Similarly a barangay captain has no legal authority to administer official duty outside of his/her jurisdiction. Rules and Protocol! Picking a barangay captain is melodramatic, smack of show business effect!

LGU officials including barangays, councilors, governors and mayors have limited jurisdictional areas covered by laws or else each one will step on each other over jurisdiction. RA 10775 does not specify extent of jurisdiction though this Act only specifies the extent of their authorization to officiate over govt officials.
Point to us in the entirety of RA 10775 or any law where it says barangay chairman can conduct official duties and issuance of licenses and permits anywhere in the Philippines. An Official Oath needs Certification Authenticated by the signature of the Admistrator, date and location of event like an official notary. Lawyers and other licensed professionals obtained their licensures covering the entire archipelago. The license of a barangay chairman upon election is limited to its jurisdiction. Will Leni swear in the barangay in Camarines Sur?
There are other ways to honor and give respect to lowly public servants like barangay officials but when legality is concerned, follow the rules. Plain and simple.
It’s not about simplicity and humility, it’s the constitutional and common laws on restrictions. Circumventing and misinterpreting laws is another pathetic culture of FILIPINOS but they follow the rules while in foreign countries.

When the US leaves its mammoth bases in Okinawa, Japan will be left literally naked from foreign aggression and would then be forced, by necessity, to rearm to the teeth since its mortal enemy, china, whom the former committed atrocious war crimes like Nanking, among many, would gladly return the favor, especially in the disputed islands in the East China Sea

On March 6, 2014, Mr. Wu Shicun, President, China Institute of South China Sea Studies, supports China’s argument on the Nine-Dash Line in the South China Sea as legal:
1. ‘the U-shaped line, etc, all referring to the maritime delimitation line set by the Chinese government in 1947 and made officially public the following year. A U-shaped chain of a dotted line (originally with 11 dots dropped to 9 after the Chinese government removed the two in the Beibu Bay area in 1953) outlining China’s territorial claims in the South China Sea has become a regular attachment to the Chinese map, constituting a key legal position of China’s claimed rights and interests in the South China Sea, and standing as an invaluable heritage of China.’
If it was a ‘regular attachment to the China map’ – the U-shaped chain of a dotted line was originally with 11 dots. Dropped to ‘9.’ Is this not irregular? I do not know what one can call it.
2. Littoral states, using Mr. Wu’s word, tacitly accepted the existence of the line in 1948. Is this word ‘tacitly’ provided as legal or valid under International Law, the UN Convention of the Law of the Sea (UNCLOS)?
3. ‘ However, since the 1970s, along with massive discoveries of oil and natural gas in the South China Sea, the signing into force of UNCLOS and the shifting geopolitical landscape in the region, both the littoral states and the international community at large have fundamentally altered their attitudes towards and positions on China’s nine-dash line, from one of confirmation, approval and acquiescence to one of suspicion and even denial.’
Mr. Wu admits (for China) that littoral states and international community ‘fundamentally altered’ their attitudes towards China’s nine-dash line position. Therefore, there was no clear factual approval, tacit or otherwise expressed approval.
3. Mr. Wu explains that there was a ‘massive discoveries of oil and natural gas in the South China Sea in the 1970s, and that China’s dotted line was made public in 1948. In what manner of publicity did China do this publication – before the UN (UNCLOS) or any International news papers?
4. If there was a publication by China in 1948 of its dotted line, is it saying it took the Philippines only recently to object or criticize such dotted line after more than 40 years since 1948? Likewise the on the part of the USA and other states in the area? Or it is because the dotted line was never really published for effectivity and notice in 1948 but only recently after the massive discoveries of oil and natural gas?
5. Mr. Wu asserts for China that the entire regime of international law, which is duty bound to regulate and adjust state-to-state relations, should protect rather than undermine this irrefutable historic right of the Chinese people but yet China, without presenting and participating before the UN Arbitration Court case filed by the Philippines refused recognition of the Court’s jurisdiction over the case at the same China insisting that other states and the international law be duty bound to protect China’s dotted line.
Like saying ‘I do not like the cake but I like to eat it and have eaten it.’
6. Mr. Wu for China, says like this that it is – emphasized that China has never regarded the South China Sea in its totality as China’s territorial waters.
Not the whole of the South China Sea totality but what? Only that portion or part where there is a massive discoveries of oil and gas? Is China unilaterally just portioning South |China Sea to its benefit where oil and natural gas are found, and not bothering to claim the remaining part or parts where no oil and natural gas are discovered?
7. China according to Mr. Wu is not making South China Sea its ‘Chinese Lake.’ Yes, but only that part where the discoveries in massive quantity of the oil and natural gas will be its sole cake as a Chinese Lake.
My opn is from Mr. Wu’s incredible defense for/of China is clearly a recent extension of being a bully. A greedy bully at that. It does not to be ‘a party’ to any case but only a bully-party.
