Did Duterte know Yasay was most probably NOT a Filipino citizen when he REAPPOINTED him THRICE as foreign secretary?

The rejection of Perfecto Yasay as foreign secretary could raise questions about President Rodrigo Duterte’s hand in trying to push the appointment to chief envoy of someone who is most probably not a Filipino.

Juliet Labog-Javellana’s report dated February 27, 2017 clearly showed that Yasay only lost his American citizenship last year –  on June 28, 2016. The government has not produced any document, and neither has Yasay for that matter, that he has reacquired his Philippine citizenship since then. An appointment to a government position is not proof of reacquisition.

Did he tell his former college roommate Duterte about his citizenship status?

And if he did, what did Duterte say or advise him to do?

An ordinary person may be forgiven for not knowing immigration and citizenship laws, especially those of the United States.

But not Perfecto Yasay.

According to a report by Interaksyon’s Camille A. Aguinaldo, Yasay’s work as a lawyer in the United States included handling immigration cases. Aguinaldo wrote that:

“He represented Filipinos in deportation and de-naturalization cases in the United States. He also hosted a radio show in New York, giving legal advice to its listeners and served as visiting professor of law at the University of Hawaii’s Richardson School of Law.”

This means, Yasay knew when an American citizen ceased being an American and how a Filipino reacquires Philippine citizenship.

Javellana’s article showed an affidavit that Yasay said he wrote back in 1993 when he swore that he had already renounced his citizenship earlier. The funny thing with that affidavit is that it has no official stamp that it was received by any US government agency.

Yasay said he had sent it by registered mail. Yasay must have known that this registered mail thing wasn’t legally valid because he had followed it up by formally filing a renunciation of his American citizenship before an American consul in Manila. Only last June 2016.

Did he tell Duterte about this? In 1993 – the year Yasay wrote an affidavit about his renunciation – there was no such thing as a dual US-Filipino citizenship, except for those lucky Filipinos born in the US of a Filipino mother or father, or anywhere else of an American father and Filipino mother.

So in 1993, after Yasay wrote that affidavit, did he reacquire his Filipino citizenship?

Yasay will have to show proof that he did because in 1995, President Fidel V. Ramos appointed him associate commissioner of the Securities and Exchange Commission. He could not have been appointed to that post if he was not a Filipino citizen.

Then in 1996 Ramos appointed Yasay SEC chair.

Later, Yasay ran for senator in 2001 and 2004. A senator is an elective position reserved for Filipinos ONLY.

On October 20, 2016, Duterte had to reappoint Yasay ad-interim as foreign secretary because Congress took a break. All presidential appointments that have to be confirmed by the bicameral Commission on Appointments lapse whenever Congress takes a break.

On October 22, 2016, someone asked me whether Yasay had a green card or was a dual citizen. I mentioned this in the following post –

This became a hot topic on Facebook. By then, Malacañang Palace would have been alerted and we could reasonably assume that someone would have done a due diligence on Yasay, or Duterte himself would have asked Yasay about it.

But when Yasay’s appointment lapsed again in January, Duterte again reappointed him – FOR THE THIRD TIME.

The last administration was severely castigated for appointing mga kaklase (classmates) at kabarilan (shooting mates). Should we now suspend such outrage because it’s a different administration?

The oath of every Philippine president includes a solemn promise to “execute its laws”, including its citizenship laws.

Which is why it is important to determine – at what point did President Duterte know or was told that Yasay’s appointment most probably violated Philippine laws? And if Duterte knew this at any time before he reappointed Yasay THRICE, can Duterte be accused of a cover-up?

Which also raises other very interesting questions: If Yasay cannot show proof of reacquisition of Philippine citizenship, can he be deported?

If he shows he did reacquire just before Duterte appointed him, can he be sued for violating passport, election and civil service commission laws? And for masquerading as a citizen all these years?

    While Duterte is focused on his drug war which has outlasted its effectiveness, growth of Philippine economy is left unsolved by Duts. Goods will start to be priced higher as early as late March. Petroleum and liquified gas price continues to rise despite lower oil price in international market.

    Trump’s aggressive action to improve US safety and improve its economy will directly affect the Philippines:

Call centers abroad will be required to identify their locations to american consumers dealing with them. After identification of location, whether it’s the Philippines, India, China, Australia or other countries consumer will have the option to be transferred to a call center based in U.S. to talk to an American call center agent who better can explain clearly to the consumer the intricacies of the problems sought by the consumer. If this happens, BPO Centers will start relocating to US to service their US corporate clients. The new regulation is expected to be issued by 2nd quarter of the year.

    16 million voters elected Duterte to act as president but so far his mental instinct is local mayor.

          Military rule follows. Why allow a civilian to mix with them?

          The problem is no soldier or cop knows how to run the state government.

          Soldiers and cops should not follow blindly illegal orders of civilian leaders. They have their role to play.

          Rule of law and the Constitution. Protect the PEOPLE.

          leona, darl, true na at the front line silang mga kapolisan at military, but sorry to say this: they are not there stumbling blindly. may intel sila, may mga gizmos sila and have scouts and reconnaissance to the extent that they knew their terrain as well as they knew the backs of their own hands. they got eyes in the dark and ears on the wall.

          and if they so desire, they can bring down a govt, form an interim govt in the meantime until a civilian leader is found.

          there is military court for erring soldiers, I’ve heard of court martial but not sure about its role. dishonorable dismissal, that’s a soldier’s nightmare, be stripped of rank and whatnot.

          I believe polis and soldiers have transferable skills, if they’re good in managing polis and military businesses and affairs, they can manage a nation. their is stark difference though, but nothing is impossible for one willing to learn, be they man or woman.

    Digong’s minions could have railroaded Yasay’s confirmation if not for the alert and vigilant media particularly Rappler and followed by the relentless Congresswoman Ramirez-Sato.
    It looks like Digong is also throwing Gina Lopez’ under the bus with his halfhearted “try to listen to her” appeal to the CA. It should be remembered that Dominguez, his mining relatives, friends and associates were important financing components of the 16 million idiots. Zamora is a mining surrogate of his brother Manuel and so is Paquiao (Chavit Singson’s Satrap).

          Taking into consideration how Duts reversed several of Gina’s high profile mining bans, wouldn’t it be safe to assume that he’s more than inclined to throw the environment secretary under the bus if the profits of his mining oligarchs and allies are under threat?

          His lukewarm endorsement of her on the CA doesn’t inspire much confidence either.

          I dont believe digong’s oligarch friends will lose much. their monies are already in banks and earning high interests, some are invested in stocks, properties and trusts, at meron pa silang diversified economic portfolio. they also have insurance that cover loss of income, etc.

          I think, their pride wont let them back down and lose face to newbie and lone woman: gina lopez. but they’ll surely lose more than face if digong got pushed out of office, shoved because people are getting sick and tired of his management style.

    His rise to power is based upon a foundation of deception – Numbeo, his SALN, his wives and their businesses and properties, his close Chinese ties, his campaign being bankrolled by the Marcoses and his own set of oligarchs, the DDS, the PNP murders, etc. He got away with all of it. His followers lapped it all up. Surely he won’t mind telling the country another lie just to further his stranglehold on the reins of government.

      The problem though are the Filipino voters – during the campaign period, he was affront of what he has done and of what he will do – replicate the Davao formula all over the country; bury Marcos; free Gloria; federalism, etc. – YET, Filipinos lapped it all up; i mean, the 16Million voters elected him to office and still are cheering him on…

      It’s time to check on our fellow Filipinos and NOT just on the president… We need a total re-awakening from our deep slumber and believe in the truth, for once.

        Too many of his supporters have invested too much in his presidency. It’s cultish fanaticism. Parang yung pagkapanatiko ng mga pinoy sa Ginebra or Aldub – kahit wala na sa lugar minsan, eh todo suporta pa rin. Sobrang tindi ng emotional investment eh they seem to be willing to bend time and space to accommodate his madness.

        Are you sure we’re not the ones deluding ourselves with the notion that the Filipinos are actually decent? Di kaya ngayon lang tayo nagigising sa katotohanan na karamihan sa bansa mas sumusuporta pa rin sa presidenteng mamamatay tao?

          Naloko ang bansang pilipinas, ang sambayanang pilipino dahil sa principal sponsor niya na si PDU30.

          A gov’t err ex gov’t official who is not even a Philippines citizen. Not within the jurisdiction of the Phils’. Ombudsman alas. And DOJ Sec Aguirre is silent, seems disinterested to investigate Perfecto Yasay’s fraudulent claims for so many years. It is PDU30’s mistake, big time! Parehong con artists. What face can DU30 present to ASEAN member nations this year, being its chair for this season, whose appointee was caught out for lying about his citizenship.

          Remember, the media questioned Perfecto Yasay’s demeanor when the Permanent Court of Arbitration rendered its judgement in favor of the Philippines? Him, still being a US Citizen should have shown excitement and enthusiasm, rather he showed displeasure instead. Makes you wonder, he is foreign to Philippines’ expectations.

        DFA: Yasay’s passport renewal not an ordinary case

        DFA spokesperson Charles Jose confirmed the DFA decided to “hold” former DFA Secretary Perfecto Yasay’s application to renew his passport pending the result of the agency’s investigation on his citizenship.

        Yasay’s passport is set to expire in 2018.

        Last week, the Commission on Appointments (CA) rejected Yasay’s appointment over concerns on his citizenship.

        “Kasi hindi siya ordinary case no? Alam naman natin na katatapos lang ng confirmation hearing ng CA and precisely, yun ang issue levelled at him. Yung issue of his citizenship and alam din natin na Philippine passports should only be issued to Filipino citizens,” Jose said.

    It’s a good thing Yasay was not confirmed. He lied on his citizenship and callously assumed as secretary of foreign affairs. Had he got the confirmation we will have a foreign policy full of lies.

    With the much-publicized question about Grace Poe’s former U.S. citizenship one would imagine that our political leaders would be sensitive on this issue, and would learn their lesson from Grace’s predicament.

    That fact that Perfecto Yasay still tried to cover-up and get away with the issue of his U.S. citizenship only shows that the Duterte administration has little respect for our laws, and will try to circumvent the law if it could.

    Yasay was likely banking on his knowledge of U.S. immigration laws providing strict confidentiality to immigration records to cover-up his U.S. citizenship. But he probably did not keep abreast of changes in U.S. immigration law and, unfortunately for him, the confidentiality surrounding the loss of U.S. citizenship was removed and the matter become public records starting in 1996 with the quarterly publication of the Federal Register listing the names of persons who relinquished their U.S. citizenship. Alan Peter Cayetano, Grace Poe Llamanzares, and Perfecto Yasay are among the persons whose names appeared in an issue of the Federal Register.

    It is the same quarterly Federal Register that brought into public awareness Grace Poe’s official renunciation of her U.S. citizenship as publicized for the first time in Raissa’s blog site.

    And in spite of Grace Poe’s much publicized pronouncement shortly before the last presidential election that her husband Neil Llamanzares already renounced his U.S. citizenship, his name is yet to show up in the Federal Register – meaning, he is likely still a U.S. citizen.

        Alan Peter Cayetano relinquished his U.S. citizenship 1998, the year he ran for a seat in our Congress (House of Representatives).

        His name was publicized in the Federal Register in its Q1 1999 issue.

          President Rdorigo Duterte declared that Senator Alan Peter Cayetano, his losing running mate in the 2016 elections, is better off staying in the Senate.

          Duterte’s announcement comes just days after his former dorm-mate, Jun Yasay, was rejected by the Commission on Appointments and just two months before the end of the one-year ban on appointing election losers.

          “He (Cayetano) is a brilliant man, he will be needed by the Senate. Huwag ninyo walain yan,” said Duterte in a press conference in Malacanang Monday.

          Although he has yet to talk to Cayetano, Duterte said he was fine with having a Foreign Affairs Secretary on an acting basis.

          According to the complaint filed by former Pateros Mayor Jose Capco, Jr, Cayetano’s parents obtained an Alien Certificate of Registration (ACR) for him on March 18, 1976, indicating that he was an American citizen.
          Capco obtained a further record, which revealed that on January 23, 1985 Cayetano personally applied for and was granted a new ACR, where Cayetano affirmed his intention to be a citizen of the United States of America.
          According to Capco, when Cayetano campaigned for municipal councilor of Taguig in the 1992 elections, he produced an Identification Certificate, BC-1295, from the Philippine Bureau of Immigration that he was a Philippine citizen. But Capco said this identification certificate was apparently bogus and “has never been affirmed by the secretary of justice” as required by the law.
          Capco’s complaint never made it to the Philippine Supreme Court, and it is unclear as to what ever became of his accusation. But Cayetano has also never challenged his inclusion in the US Federal Register as having only formally relinquished his US citizenship in 1999.

      Congress can amend our Dual Citizenship Law by allowing stateless persons to be appointed in our gov’t offices or even being elected to gov’t posts !

      Just like what LH is doing….death penalty for ONLY in the crime of illegal drugs. And ONLi drug addicts are sentenced to death.

      Assuming that bill will pass in the Senate. Or it will pass at the Supreme Court.

    Yasay got away with pretending to be a Filipino Citizen so many times that it’s a miracle of sorts he got caught lying under oath this time around. I hope that his actions will at least lead to his disbarment, if not conviction for breaking both Philippine and American Citizenship laws.
