Calida’s security guard business prospers mightily under Duterte, compared to 10 years before

For most of its 17 years, Vigilant Investigative and Security Agency Inc. owned and operated by Solicitor General Jose C. Calida was a medium size company bagging “Agency Fees” of under P10 million yearly.

That changed dramatically when Calida’s close ally Rodrigo Duterte became president and appointed Calida his Solicitor General.

In the first 18 months of Duterte’s presidency, Vigilant won 14 government contracts which gave the company a jaw-dropping ₱261 million worth of Agency Fees.

“Agency fees” – according to Vigilant’s annual financial reports submitted to the Securities and Exchange Commission – are “revenues”, described as “fees received from clients arising from rendering of Security services.”

Remarkably, the P261 million Agency Fees in 18 months – July 2016 to January 2018 – are nearly double what Vigilant grossed in the previous 10 years – from 2005 to 2015.

In other words, it took Vigilant 10 years to gross ₱134 million worth of Agency Fees. But only 18 months to gross P261 million solely from winning government contracts when Duterte came to power.

Later, in Part 2 of this Three Part Series, I will show you how some government contracts that Vigilant won under the Duterte administration could place Calida in a  direct conflict of interest situation because he’s the SolGen.

But right now, I’d like to show you the breakdown of the Agency Fees I gathered from Vigilant’s financial statements from 2005 to 2015. Its financial statements for the years 2016 and 2017 are not yet publicly available:

NOTE: Just a correction. Lo21se @louise107 on Twitter noted that the 2006 Agency Fees were the same as the 2007 Agency Fees. I went over my files again and saw that I had mistakenly copied the 2006 Agency Fees twice. I have corrected the 2007 Agency Fees to P4.872,185. All the other figures stand. Now compare that to the Agency Fees that Calida’s company bagged during the Duterte presidency through public bidding. I obtained the figures from the government site PHILGEPS (where many awarded bids are posted), Notice of Awards, and from news reports of ABS-CBN and Rappler.

Before Calida joined Duterte’s government, he was President and Chairman of Vigilant from 2005 to June 2016. The last government posts he held were in October 2004 as executive director of the Dangerous Drugs Board and before that (2001-2004) as a Department of Justice undersecretary.

When he became SolGen, Calida left the company but continued to personally own 60% of Vigilant (with the rest being owned by his wife Milagros and their children Michele, Josef and Mark Jorel). That means, Calida continued to have the final say in the company.

His wife Milagros assumed his posts and his son Josef became the Vice President and Corporate Secretary.

For this piece, as well as the next two, I tried to reach Mrs. Calida and/or their son Josef over a span of five days. I must have dialed their office number and Josef Calida’s mobile number more than 40 times.

But I had no luck. I was told Mrs. Calida was in Davao while Josef was “attending a court hearing in Cebu.”

In part 3, I will explain why I wanted to reach them both as officers of the company.

SolGen Calida has defended Vigilant’s success in landing government contracts. He emphatically said Vigilant won through pubic bidding fair and square by submitting the “lowest” bids. Not all the time, he hastened to point out. However, it did so successfully 14 times in 18 months.

That’s a very good batting average.

He also stressed he was no longer with the company since he had resigned as its President and Chairman after his appointment as SolGen. A disclosure filed with the Securities and Exchange Commission actually confirms this.

However, it is not very clear whether he had disclosed the same to the government agencies where Vigilant had joined the bidding.

Online news site Rappler found that 13 of the 14 “Notice of Awards” to Vigilant from August 2016 to January 2018 still listed Calida as the security agency’s “contact” person.

Did that give Vigilant an edge in the bidding process?

We don’t know. That’s why I wanted to talk to Mrs. Calida and Josef.

However, we can easily see the advantages for a government official and his agency to be on the good side of someone like Calida who is personally close to Duterte and is the chief government lawyer.

Why didn’t I talk to the SolGen? Because he said he is no longer active in the company and has kept a distance from its operations.

    Can the “contact” person, be the Middle Man at the same time? What better position to name drop should there be any queries, clarifications, disputes, either party may seek to resolve contract non-compliance (T&Cs), and what have you?

    How does he know, and how much does he know all about these (e.g. approved budgets)?

    In which capacity, Solicitor for whom?
    Did he use his office to make inquiries, liaise, SOLICIT or make representations, or at least lobby, if not make unSOLICITed referrals or recommendations on behalf of his family’s company interests? as the top gov’t lawyer? … suggests or changes to his family’s company bids? … proof read if not provided consultations (e.g. legal, for compliance) to his family’s company bids?

    What were the frame of mind of the author(s) behind RA 6713 (to wit Rule IX of the Implementing Rules and Regulations (IRR)), RA 3019 or the Anti-Graft Law? With out much thought and consideration (i.e. absence of minutes/transcripts) of late, is it once again an oblique, alternate redefining of ‘may’? How convenient.

      weird ha? congress has threatened to choke off supreme court’s budget if sereno is not ousted, likewise human rights com has been threatened with zero budget if it wont stop yapping about ejks, then ironically, calida’s sekyu firms are assured of budgetary fund, no constraints! friends talaga sina alvarez at calida, then friends din si calida ni bong marcos na walang trabaho na ngayon except to harangue and bully his way in to vice presidency thanks mainly to trolls. calida is acting trolls personified na, instead of working for govt agency like the comelec, working for private citizen na si calida, the private citizen being bong marcos. ka-vested interest baga, ka-partisan.

      all the more reason not to let federalism barge its way in. under the present conditions, federalism is going to be more hellish than marawi city. sasabogin not only our democracy but also our way of lives. people supposed to govern us are behaving ubber badly na. dont reward them with federalism po. they should be whipped instead.

    “contact” person Did Vigilant have an edge in the bidding process?

    Was the ‘lowest bid’ enough to win-win security service contracts? Where gov’t clients be accorded an outstanding service for a bargain?

    … a very good batting average? What were the previous security services’ contract fees? for Transparency as an example If archive records are still available (from any or all of the aforementioned gov’t clients), would tenders’ records of bids of security service providers seeking to renew their contracts show the same (err close or almost) fee charges or unusually spiked amounts? If so, was there a connivance amongst the bidders to show leeway where The “contact” person is obscene?

    on going service contracts Was there a degradation of services; quality of service, less number of personnel, lower workers’ pay, sacrifice penalty rates, missing benefits & no entitlements to make up for the lowest bid, … to win-loose a bid service?

    Is there somewhere in the service contract agreement that would allow the sercurity service provider (i.e Vigilan ce) to claim for additional fees or incurring charges for whatever ‘reason’ that may arise during their contract term?

        resolved by terminating the contract like breaching it? aba, guevarra is walking into quick sand, better armed himself with life savers like vines to grab in case quick sand is deep, slippery and dangerous. better still to review the contract dahil there could well be misrepresentations. and any misrepresentations could be ground to terminate the contract.

    Included in the government agencies which gave contract to VISAI is NACP. It is headed by Liza Maza, former representative of Gabriela Party List. Ever since she joined Duterte admin she has been a dissapointment. She is silent on issues of corruption and Duterte’s mysoginist attitude. She is one of the highest paid cabinet member of Duterte. Nilamon ng pera at ng sistema. Pweh!

      the late mayor halili was fond of parading supposedly erring people sa walk of shame, pinaikot sila sa palengke, some were inside cages, shamed and blamed and made fun of paminsan with people pointing fingers at them, pics nila posted sa internet, also in nationwide tv.

      mga supporters ni halili said he ate death at breakfast, only this time, death ate him!

          Another municipal mayor shot dead around 4:30 PM today – Mayor Ferdinand Bote of General Tinio, Nueva Ecija – just a day after Mayor Halili of Tanauan, Batangas was shot dead by an sniper.

          Mayor Bote had just left the NIA compound in Cabanatuan City and about to cross the highway when a man dressed in black approached and pumped bullets on the mayor. The driver immediately rushed him to a nearby hospital but declared dead on arrival. (more)

          in the meantime po, kapolisan is busy accosting only, and not arresting, tambays. so many tambays rounded up and accosted, punong puno na ang mga presinto. habang killers at riding suspects are flourishing and booming like wild mushrooms! still on the go and reigning sila, still on killing spree.

          so far, eight towns and two cities lost their mayors under 2yrs of duterte. if this karahasan goes on baga . . . well, the dead cannot run for re-election come 2019, he, he, he. their electoral influence cut short, their endorsement of other candidates cut short, mayors are being made modern day dodos na, dead as a dodo. their ownership and collections of gun did not protect them. lesson of the story po, dont be lulled into thinking having guns will make for safety.

          mayor kasi si halili and methink po power has got to his head, lumobo ng husto ang ulo, pardon the expression po, and mayhap mayor thought it’s within his divine right to shame people who had committed minor crimes as stealing food sa palengke, etc. di bale na kung mahina sa isip yong culprit. nothing is bawal for said mayor yata, what mayor wants, mayor gets. then, na gets siya.

    There is no IOTA of doubt Solgen Calida and/or Vigilant Security Agency is violating R.A. No. 6713.

    Calida’s Agency is grossing P261 million solely from winning government contracts when Duterte came to power. Four (4) more years. It will not be a BAG but SACKS of money.

    The question is: who will stop Calida or his Security Agency from BAGGING more money from the Gov’t Agencies? The OMBUDSMAN? There will be a NEW chief OMBUDSMAN come July 2018 or thereafter.

    Investigation will probably come AFTER 2022 under a new Administration if at all the opposition party is IN. Or it might just be EARLIER depending on the circumstances later.

    Law on PLUNDER:
    Section 2. Definition of the Crime of Plunder; Penalties. — Any public officer
    who, by himself or in connivance with members of his family, relatives by affinity or
    consanguinity, business associates, subordinates or other persons, amasses, accumulates
    or acquires ill-gotten wealth through a combination or series of overt or criminal acts as
    described in Section 1(d) hereof in the aggregate amount or total value of at least Fifty
    million pesos (P50,000,000.00) shall be guilty of the crime of plunder and shall be
    punished by reclusion perpetua to death. Any person who participated with the said
    public officer in the commission of an offense contributing to the crime of plunder shall
    likewise be punished for such offense. In the imposition of penalties, the degree of
    participation and the attendance of mitigating and extenuating circumstances, as
    provided by the Revised Penal Code, shall be considered by the court. The court shall
    declare any and all ill-gotten wealth and their interests and other incomes and assets
    including the properties and shares of stocks derived from the deposit or investment
    thereof forfeited in favor of the State. (As amended by RA 7659, approved Dec. 13, 1993.)

    depending on the gravity of the offense after due notice and hearing by the appropriate body
    or agency. If the violation is punishable by a heavier penalty under another law, he shall be
    prosecuted under the latter statute. Violations of Sections 7, 8 or 9 of this Act shall be

      still, there are good people not affected by the rot being perpetuated, there are still pockets of resistance. principles and discipline instill in childhood still strong and able, viable.

    I found their FB page, and upon reading through the comments of previous employees, they were very dissatisfied about the method of payment, non existence of payslip, no benefits and very inconvenient pay transaction through ATM where one is still required to sign the payroll in person and travel to the office to do this.

    Some were said to be terminated after working for a time and many are still waiting for their salaries while others were not paid at all.

    I may ask is this due to illegal contractualization (endo) or breach of contract? Both are anti labor practices.. If that is the case, then the Solgen’s family company is the # 1 maker of the labor rights abuses.

    So much for the close-ally friendship of the SOLGEN and theDO30 govt. Who is going to investigate such bad labor doings if the SOLGEN is bagging all the govt contracts handed by the govt without question , without conflict and almost automatically handed over and granted.
    How is this fair and legal?

    Reading the comments on the site is an eye opener what kind of employer this agency is. SAYS A LOT ABOUT taking care of employees rights.

      maybe, I’m being mexican jumping bean, but sekyus make me wary. and you could be right po, netty. his own sekyus could well be calida’s eyes and ears in govt agencies, not only gathering info for calida but also all kinds of dirt and data. lalo na’t may access sila sa cctv at logbook, knows who goes in and out of the premises and all that conspire within.

      and for all their efforts, calida could well be not forthcoming, short changing sekyus and not paying them enough.

      I dont know if there is still a working labor union looking after welfare of sekyus, dati rati ang anak ni gloria arroyo represented sekyus.

    So Calida’s security guards provide security protection to the House of Representatives, DOJ, Pagcor, and other government agencies? This is a terrific way for him to exercise some control over the lives and safety of public officials and employees working in those offices. These guards are armed with short firearms and/or shotguns. They are capable of killing anyone and yet say that the killing was due to accident. “Sorry lang po, basta pumutok lang po yung baril ko, aksidente po nangyari.” Scary.

          japan offered pinas loans with lower interest, pero digong chose chinese loans with higher interests.

    Why not send Vigilant Investigative and Security Agency Inc. on PATROL in Samar-NPA-infested since it appears this security Agency is loaded with AMMO/MONEY/GUNS?

    Surely there won’t be a any MISS ENCOUNTERS. Missions will be always accomplished.

    This Agency can beat all poor units of AFP & PNP’s patrols!

      after reading netty’s comment above, methink calida’s sekyu could not be deployed sa samar dahil their pay is less than ideal despite the millions calida has gotten for their services. he, he, he, calida keep most of the dosh and moolahs to himself, methink, while sekyus niya got peanuts! pay peanuts, and you get monkeys! fist pumping monkeys, he, he, he. not being good boss yata si calida, pihikan sa sweldo.

      dont send his sekyus on patrol sa samar, baka they’ll end up joining the rebels, he, he, he.
