Based on financial reports Mislatel (Mindanao Islamic Telephone Company) has submitted to the Securities and Exchange Commission, it’s not clear whether it has ever been fully operational.
In 2015, Mislatel recorded ZERO sales and ZERO inventory. And that was after 17 years it got its franchise from Congress.
Because of this, it’s not clear – despite the seal of good housekeeping issued to it by the National Telecommunications Commission – whether it has ever fulfilled the conditions of its franchise. Or because of this, its franchise is deemed revoked.
The franchises granted to previous phone companies did not carry such conditions. But in Mislatel’s case, THERE WERE CERTAIN CONDITIONS it had to meet.
I discuss this and other issues involving Mislatel’s winning bid to become the third telco in a piece for South China Morning Post.
You can read my SCMP piece by clicking on this link.
Below is a copy of Mislatel’s franchise. I have highlighted the pertinent passages:
_______________________________________________________________________________
REPUBLIC ACT NO. 8627
AN ACT GRANTING THE MINDANAO ISLAMIC TELEPHONE COMPANY, INC., A FRANCHISE TO CONSTRUCT, ESTABLISH, INSTALL, MAINTAIN AND OPERATE WIRE AND/OR WIRELESS TELECOMMUNICATIONS SYSTEMS IN THE PHILIPPINES
Section 1. Nature and Scope of Franchise. – Subject to the provisions of the Constitution and applicable laws, rules and regulations, there is hereby granted to the Mindanao Islamic Telephone Company, Inc., hereunder referred to as the grantee, its successors or assigns, a franchise to construct, establish, install, maintain and operate for commercial purposes and in the public interest, wired, mobile and fixed wireless telecommunications system such as paging system, cellular phone system, personal communications network, trunked radio services related to the foregoing, now known to science or which in the future may be developed through technical innovations and advances, throughout the Philippines, for public domestic and international telecommunications.
Sec. 2. Manner of Operation of Stations or Facilities. – The stations or facilities of the grantee shall be constructed and operated in a manner as will, at most, result only in the minimum interference on the wavelengths or frequencies of the existing stations or other stations which may be established by law, without in any way diminishing its own right to use its selected wavelengths or frequencies and the quality of transmission or reception thereon as should maximize rendition of the grantee’s services and/or the availability thereof.
Sec. 3. Authority of the National Telecommunications Commission. – The grantee shall secure from the National Telecommunications Commission, hereinafter referred to as the Commission, a certificate of public convenience and necessity or the appropriate permits and licenses for the location, construction, installation and operation of its telecommunications systems. In issuing the certificate, the Commission shall have the power to impose such conditions relative to the construction, operation, maintenance, or service level of the telecommunications system. The Commission shall have the authority to regulate the construction and operation of its telecommunications systems. The grantee shall not use any frequency in the radio spectrum without having been authorized by the Commission. Such certificate shall state the areas covered and date the grantee shall commence the service. The Commission, however, shall not unreasonably withhold or delay the grant of any such authority, permits or licenses.
Sec. 4. Responsibility to the Public. – The grantee shall conform to the ethics of honest enterprise and shall not use its stations for obscene or indecent transmission or for dissemination of deliberately false information or willful misrepresentation or assist in subversive or treasonable acts.
The grantee shall provide basic or enhanced telephone service in any municipality in the Philippines where it has an approved certificate of public convenience and necessity for the establishment, operation, and maintenance of a local exchange service, without discrimination to any applicant therefore, in the order of the date of their applications, up to the limit of the capacity of its local telephone exchange, and should the demand for the telephone service at any time increase beyond the capacity thereof, the grantee shall increase the same to meet such demand: provided, that in case the total demand to be satisfied by the expansion is less than the smallest viable local exchange available in the market as determined by the Commission, the grantee shall not be obliged to furnish said services, unless the applicant for telephone service defrays the actual expenses for the installation of the telecommunication apparatus necessary for such services and in such case the Commission may extend the time within which the grantee shall furnish such services.
The grantee shall operate and maintain all its stations, lines, cables, systems and equipment for the transmission and reception of messages, signals and pulses in a satisfactory manner at all times, and as far as economical and practicable, modify, improve or change such stations, lines, cables, systems and equipment to keep abreast with the advances in science and technology.
Sec. 5. Rates for Services. – The charges and rates for telecommunications services of the grantee, except the rates and charges on those that may hereafter be declared or considered as nonregulated services, whether flat rates or measured rates or variation thereof, shall be subject to the approval of the Commission or its legal successors. The rates to be charged by the grantee shall be unbundled, separable and distinct among the services offered and shall be determined in such a manner that regulated services do not subsidize the unregulated ones.
Sec. 6. Right of Government. – A special right is hereby reserved to the President of the Philippines, in times of war, rebellion, public peril, calamity, emergency, disaster or disturbance of peace and order, to temporarily take over and operate the stations, transmitters, facilities or equipment of the grantee, to temporarily suspend the operation of any station, transmitter, facility or equipment in the interest of public safety, security and public welfare, or to authorize the temporary use and operation thereof by any agency of the government, upon due compensation to the grantee for the use of said stations, transmitters, facilities or equipment during the period when they shall be so operated.
The radio spectrum is a finite resource that is a part of the national patrimony and the use thereof is a privilege conferred upon the grantee by the State and may be withdrawn anytime, after due process.
Sec. 7. Term of Franchise. – This franchise shall be for a term of twenty-five (25) years from the date of effectivity of this Act, unless sooner revoked or cancelled. This franchise shall be deemed ipso facto revoked, in the event the grantee fails to comply with any of the following conditions:
(a) Commence operations within one (1) year from the approval of its permit by the National Telecommunications Commission;
(b) Operate continuously for two (2) years; and
(c) Commence operations within three (3) years from the effectivity of this Act.
Sec. 8. Acceptance and Compliance. – Acceptance of this franchise shall be given in writing within sixty (60) days from the effectivity of this Act. Upon giving such acceptance, the grantee shall exercise the privileges granted under this Act. Non-acceptance shall render the franchise void.
Sec. 9. Bond. – The grantee shall file a bond in favor of the National Telecommunications Commission, which shall determine the amount, to guarantee the compliance with and fulfillment of the conditions under which this franchise is granted. If after three (3) years from date of the approval of its permit by the Commission, the grantee shall have fulfilled the same, the bond shall be cancelled by the Commission. Otherwise, the bond shall be forfeited in favor of the government and the franchise ipso facto revoked.
Section 10. Right of Interconnection. – The grantee is hereby authorized to connect or demand connections of its telecommunications systems to any other telecommunications systems installed, operated and maintained by any other duly-authorized person or entity in the Philippines for the purpose of providing extended and improved telecommunications services to the public under such terms and conditions mutually agreed upon by the parties concerned and the same shall be subject to the review or modification of the Commission.
Section 11. Tax Provisions. – The grantee, its successors or assigns, shall be liable to pay the same taxes on their real estate, buildings, and personal property, exclusive of this franchise, as other persons or corporations are now or hereafter may be required by law to pay. In addition thereto, the grantee, its successors or assigns, shall pay the value-added tax under Republic Act No. 7716 or a franchise tax of three percent (3%) per annum or at such percentage as may be prescribed by law, on all gross receipts of its telecommunications business transacted under this franchise, whichever is higher: provided, that the grantee, its successors or assigns, shall continue to be liable for income taxes payable under Title II of the National Internal Revenue Code pursuant to Sec. 2 of Executive Order No. 72, unless the latter enactment is amended or repealed, in which case the amendment or repeal shall be applicable thereto.
The grantee shall file the return with, and pay the taxes due thereon to the Commissioner of Internal Revenue or his duly authorized representatives in accordance with the National Internal Revenue Code and the return shall be subject to audit by the Bureau of Internal Revenue.
Section 12. Gross Receipts. – The grantee, its successors or assigns, shall keep a separate account of the gross receipts of the business transacted by it and shall furnish the Commission on Audit and the National Treasury a copy of such account not later than the 31st day of January of each year, for the preceding twelve (12) months.
Section 13. Books and Accounts. – The books and accounts of the grantee, its successors or assigns, shall always be open to the inspection of the Commissioner on Audit or his authorized representatives, and it shall be the duty of the grantee to submit to the Commission on Audit, two (2) copies of the quarterly reports on the gross receipts, the net profits and the general condition of the business.
Section 14. Warranty in Favor of National and Local Governments. – The grantee shall hold the national, provincial, city and municipal governments of the Philippines harmless from all claims, accounts, demands or actions arising out of accidents or injuries, whether to property or to persons, caused by the construction or operation of the stations, transmitters, facilities and equipment of the grantee.
Section 15. Sale, Lease, Transfer, Usufruct, Etc. – The grantee shall not lease, transfer, grant the usufruct of, sell nor assign this franchise or the rights and privileges acquired thereunder to any person, firm, company, corporation or other commercial or legal entity, nor merge with any corporation or entity, nor shall the controlling interest of the grantee be transferred, whether as a whole or in parts and whether simultaneously or contemporaneously, to any such person, firm, company, corporation or entity without the prior approval of the Congress of the Philippines. Any person or entity to which this franchise is sold, transferred or assigned, shall be subject to the same conditions, terms, restrictions, and limitations of this Act.
Section 16. Dispersal of Ownership. – In accordance with the constitutional provisions to encourage public participation in the public utilities, the grantee shall offer at least thirty percentum (30%) of its outstanding capital stock or a higher percentage that may hereafter be provided by law in any securities exchange in the Philippines within five (5) years from the commencement of its operations. Noncompliance therewith shall render the franchise ipso facto revoked.
Section 17. Separability Clause. – If any of the sections or provisions of this Act is held invalid, all the other provisions not affected thereby shall remain valid.
Section 18. Repealability and Nonexclusivity Clause. – This franchise shall be subject to amendment, alteration, or repeal by the Congress of the Philippines when the public interest so requires and shall not be interpreted as an exclusive grant of the privileges herein provided for.
Section 19. Reportorial Requirement. – The grantee shall submit an annual report to the Congress of the Philippines on its compliance with the terms and conditions of its franchise and on its operations within sixty (60) days from the end of every year.
Sec. 20. Effectivity Clause. – This Act shall take effect fifteen (15) days from the date of its publication in at least two (2) newspapers of general publication.

Andaya bares favored Palace contractor

How did a single contractor bag 30 government projects worth billions of pesos before Congress could even approve the national budget for 2019?
It could only happen through “a miracle,” Majority Leader Rolando Andaya Jr. said on Monday as he defended the House of Representatives from allegations that some of its members benefited from a pork bonanza because they were close allies of Speaker Gloria Macapagal-Arroyo.
Worse, Andaya said the Bulacan-based construction firm, CT Leoncio Construction and Trading, was not even a registered corporation but a single proprietorship owned by a certain Consolacion Tubuhan Leoncio.
“That is bad business practice. It’s wrong. It cannot be done, but it already happened,” the House leader said in a privilege speech during the House plenary session.
“A single proprietorship from Bulacan cornered contracts from even the farthest areas of the region. A miracle happened here,” he said.

Parang Napoles-like scheme.

not a miracle yan, kundi conspiracy, may connivance of the highest order, bent heads nodding .together, eyes on the money.
tama po kayo, rolly. once it was janet napoles and now another evil woman follows the same modus, consolacion tubuhan leoncio. baka patay na po itong si concolacion, only her name remains, he, he, he. baka ho far reaches from the dead and abot ni concolacion.
it all starts with fake signature at lusot si revilla. tange kasi ang majority of three at tinanggap kaagad ang lamest of excuse ni atty mendoza. two signatures did it: one fake kuno, the other presumably tunay. kaso, no one has witnessed the tunay signature, what if it was the fake one? to be sure, dapat pinaperma uli si revilla sa harap mismo ng korte and then, compare his signature to the other two and see which signature his new signature resembles.
gaya po ng uaap final between the maroons and the eagles, a series of games to get to the end. so to be sure, dapat talaga pinaperma uli si revilla and see how his signature compares to the other two before the korte decides what is fake and what is truth. many tuloy think na not after justice ang sandigan, but for covering up.
favored palace contractor, the palace is into the great conspiracy.
repeat po, not miracle yan, but fraud.

apparently sabrina meng wangzhou ay nadampot sa canada for attempting to evade trade embargo imposed by estados unidos on iran. she probly has been selling re-branded american goods to iran, passing them off as chinese goods, that’s what I think. as of now medyo sketchy ang details of her arrest. no one is talking, yet. though her lawyers are saying she has not done anything wrong while in transit sa canada. saka na lang daw siya dinampot.

pamana ni digong sa pinas. style ng panunungkulan ni prrd.
for the record, we still engage with China, on entrepreneurial business relationships. apart from that, cautious and skepticism are the keywords.
arc says
right po, we still deal with china no matter what, gotta keep enemies closer, e? despite all, estados unidos still deals with china as well, same with canada, magaling silang sa compartmentalization, got well developed eyes behind the backs of their heads. cautiousness and skepticism, but what can senate do? play the game of cat and mouse? dangle a contract not signed? give hope and nothing but hope? let mislatel stew further? dont do today what can be done tomorrow procastinate and procastinate and hold off mislatel for futute whatnots. we can be just as vague and as inconclusive as the memo of understanding signed by lito digong and incoherent jin ping.
there are so many important things that our bayan needs, our people need to eat first and have shelter over their heads, children need to go to school, corrupt politicians need to be freed, he, he, he. prices of commodities to be stabilised and not allowed to go nearly out of reach of common tao. measles outbreak nearing epidimic needs to be curtailed, universal health care walang pondong pera, many baryos walang health clinics let alone hospitals, kulang ng doctors. habang si digong naman is being gastador and buying up motorcycles for kapolisan, more riding suspects soon to be roaming the streets and committing crime anew.

so unlike digong that mainly goes after small fishes.
digong recently telling the nation of his blood test. before it was biopsy of suspected cancer he talked of, even went to hongkong for 2nd opinion of biopsy test result. and in a way, digong informed the nation of his health status, just what the nation asked him to do.

heard po that it’s not only japan that is beefing up its navy and armed forces, india is doing the same na, spending big and buying up naval equipment from estados unidos. apparently, india being landlocked with china, shares a border and have experienced chinese soldiers crossing the border into india. there have been skirmishes.

if pinas makes a stand against china, we will not be alone.

as we all know now, meng wangzhou (english name sabrina) is the daughter of huawei’s founder, also heir apparent to huawei’s big fortune and her arrest is big blow to huawei.
huawei is the world’s largest manufacturer of telecommunications equipment, but only 2nd largest manufacturer of smartphones, samsung is 1st, then there is apple.
huawei is cheaper than both samsung and apple for a very good reason, may spyware na kalakip! risky ang huawei for anyone doing internet banking.

For some reason almost everyone, the US and other countries are very paranoid of China. You can tell and feel by their covert and unconcealed actions that they wanted to encroach on everything, like tech, lands, soil, drugs, politics, economy and has the ambition to become the number one powerful country in the world in this era.But for obvious reasons , too, the PH is just being cozy with whatever, however China manipulates and inserts itself into the activities of the PH inland and at sea. That you know why and leaders just sit and relax and watch the game going.

BTW, while pro Do30 supporters malign and attack the other side regarding yellowish or yellowtards, there is a growing opposition protest here in Canada and even it started in France and protesters wearing yellow vest against the gov’t carbon tax, spiraling fuel tax and thousands of immigrants that are suddenly coming from Muslim countries. I don’t like to dwell on that but something is not tolerable to the citizens especially with the crimes done by newcomers. The difference only between those countries is the presence and non presence of violence.Paris had and still having ongoing violent yellow anti govt protest while it is peaceful here in Canada. It may change if many people participated with the unrest.
Kailan kayo?
arc says
begging your pardon po, maybe dili paranoid and america, kundi cautious lang kaayo and for very good reason. china has been knocking off american products, copying off american products and then selling those products. walang respeto ang china sa IP, intellectual property, of others, kahit those na may patent, kinopya pa rin. sold them cheaper too, inferior kasi ang quality. and in doing so, china destroys the american brand name. people think tuloy na inferior ang american product when it fact it was chinese product masquerding as american product they were buying. many american firms lose business because of this.

by the way po, it was not just a huawei princess na nadukot ng canada. it was the crown princess of huawei, the 2nd in command who’ll take over all of huawei when daddy dies, or becomes indisposed.

nagkaruon kuno ng high blood pressure ang crown princess and needs to be looked at by doctor. methink the famed chinese bird’s nest soup did not work wonders for her august health. proud pa naman kaayo si duterte sa chinese bird’s nest soup, promoted it big time and attributed his ‘good’ health to it. he, he, he. I’ll enjoy it more if crown princess maging mukhang uling din po.
crown princess reminds me of the one time dowager empress of china, both tougher women and both harder ‘nuts’ to crack. while the princess is for world business domination of daddy’s telco, the dowager empress was into protectionism, wanted to keep china for the chinese and wanted desperately to expel foreign devils (westerners) out of china, even sent boxer gangs to harass the westerner, and failed.
cheers po, I’ll wait for further development from canada.

This time around, are we witnessing a European Spring?
netty says
Yes Mel, European Spring, for it goes unabated and even if Macron resigns, the people are fed up with all,,, its not only with taxes , politics refugees, against banks, elites, globalism, immigration, world finance,, wages, etc. more serious matters AFFECTING THE PEOPLE.
Now the military are used slowly against citizens.
It’s not being Islamophobia but the reality is once they are in , they can’t be out of the country. That is why I am not liking any deals with the PH rushing with any Muslim deals. I can understand some agendas. And it is not for the majority. Peace is not the end all.
As per here in Canada, issues are almost the same, but the huge thing is about the acceptance deal with UN ON REFUGEES AND MIGRATION PACT that divides and gives concern to the Canadian citizens. On both countries, migration now is a perceived cover for invasion, more seriously in France and Germany for they have already Islam refugees inside their countries.
The yellow vests are either someone else’s agenda NWO, ELITES for protest and chaos, but it could also be from patriots taking care of of their OWN countries and citizens interest.
The Canadians are still in the process of waking up for we are usually called the peacemakers, but time is fast a changing.
Whatever happens, I believe it is still the people that wins. Ever.

While the U.S. has been a net oil importer since 1949, over the final week of November, U.S. net imports of crude oil and petroleum products fell to minus 211,000 barrels per day (bpd) — which means America exported more than it imported, according to data from U.S. Energy Information and Administration.”
